FISCAL IMPACT
The emergency work to install temporary piping and stabilize the slope is being completed by the City of
Encinitas. City of Carlsbad staffing to inspect the construction activities is estimated to cost $7,500.
ENVIRONMENTAL IMPACT
The issuance of an emergency CDP for the construction of the storm drain system repairs and slope repair
is statutorily exempt from CEQA review pursuant to CEQA Guidelines Section 15269 Emergency Projects
as CEQA does not apply to actions necessary to prevent or mitigate an emergency. The storm drain and
slope repair is an emergency as it is a sudden, unexpected occurrence demanding immediate action to
prevent or mitigate loss or damage to life, health, property or essential public services. In this case, the
emergency involves soil and/or geologic movements. Therefore, the CDP is exempt from CEQA review.

NOTICE OF DECISION
RE: CDP 15-51-CARLSBAD BOULEVARD DRAINAGE REPAIRS-EMERGENCY PERMIT

The City Planner has completed a review of the application for an Emergency Coastal Development Permit to
do repair work to replace the damaged portions of the City of Encinitas' storm drain system with new,
temporary, piping and structures to redirect water away from the bluff located on the western edge of
southbound Carlsbad Boulevard just north of the intersection of La Costa Avenue. The likely cause of the
bluff failure is due to storm water runoff that has undermined and washed out portions of the storm drain
system, and undermined an SDG&E power pole, a City of Carlsbad street light and associated conduits.
The City Planner APPROVES this request for an Emergency Coastal Development Permit based upon the
following:
Findings:
1. An emergency exists that requires action more quickly than permitted by the procedures for minor
coastal development permits or for regular permits and the work can and will be completed within thirty
days unless otherwise specified by the terms of the permit;
2. Public comment on the proposed emergency action has not occurred because time did not allow; and
3. The work proposed will be consistent with the requirements of the certified land use plan.
Conditions:
1. The Emergency Coastal Development Permit is granted subject to completion of the emergency repair
work within 30 days.
2. The City of Encinitas owns and maintains the storm drain facilities in the area and if it is determined that
these facilities are the cause of the damage then the City of Encinitas shall submit a formal application
for a regular Coastal Development Permit to the City of Carlsbad within 30 days of this letter to repair the
damaged portions of the storm drain system and slope repair to the satisfaction of the City of Carlsbad's
Public Works Director. · .

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN to you, because your interest may be affected, that the City Council
of the City of Carlsbad will hold a public hearing at the Council Chambers, 1200 Carlsbad Village
Drive, Carlsbad, California, at 6:00 p.m. on Tuesday, January 12, 2016, to receive a report
regarding Emergency Coastal Development Permit COP 15-51 on property generally located on
Carlsbad Boulevard just north of the intersection of La Costa Avenue.
Those persons wishing to speak on this proposal are cordially invited to attend the public hearing.
Copies of the agenda bill will be available on and after January 8, 2016. If you have any questions,
