Recommended Action
Receive a presentation from Ken Ryan, District Manager for Coast Waste Management, on a plan
to correct a billing error for recycling cart service to multi-family dwellings in the City of Carlsbad.
Executive Summary
Coast Waste Management is the exclusive provider of residential and commercial solid waste
services in the City of Carlsbad. The existing contract and recycling and trash service rates were
approved in February 2012.In May 2016, city staff were notified by Coast Waste Management
that due to an oversight on their part, they have been inaccurately billing a number of multi-
family dwelling customers since the execution of the current contract.Coast Waste
Management,in collaboration with city staff,has prepared a plan to correct this issue.
Discussion
The City of Carlsbad provides for solid waste services to its residents and businesses as outlined
in Section 6.08 of the Carlsbad Municipal Code through an exclusive contract with Coast Waste
Management, which was approved by the City Council in February 2012 and went into effect on
July 1,2012. The term of the contract is for ten years with an optional three-year extension.As
part of this contract, new residential, commercial and multi-family rates were established and
approved for the various recycling and trash services. On May 17, 2016, city staff received a letter
from Coast Waste Management stating that they had failed to initiate billing to 208 multi-family
dwelling customers for their 96-gallon recycling cart service.These multi-family dwelling
customers have received the benefit of the free services for their 96-gallon cart recycling service
during this time. City staff and Coast Waste Management representatives met and discussed a
correction plan agreeable by all parties that considers customer impact.No retroactive billing
will be charged to the affected multi-family dwelling customers. The following implementation
plan was proposed and agreed to by Coast Waste Management:
Jan. 11, 2017: Coast Waste Management will send a letter notifying all 208 affected multi -family
dwelling customers about initiating charges for the 96-gallon recycling cart service. This letter
will request that these customers schedule an appointment with Coast Waste Management in
order to have a waste audit performed to assess current levels of service and look for
opportunities to "right size" their recycling and trash services.
Jan.11, 2017 —May 2017:Coast Waste Management will proactively contact the eight multi-
family dwelling customers who will be impacted by a possible increase of $500.00 or more per
month to schedule a waste audit. This audit will include a comprehensive evaluation of each
customer's level of service and provide guidance and assistance in "right sizing" their recycling
and trash services in an effort to reduce the overall fiscal impact.
May 2017:Coast Waste Management will begin billing all multi-family customers for recycling
cart services.
Fiscal Analysis
Billing correction will increase future franchise fees remitted to the city.
Next Steps
Coast waste Management will implement the proposed plan to correct the billing error for multi-
family dwelling accounts with 96-gallon recycling cart service.
Environmental Evaluation (CEQA}
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of the California Environmental Quality Act (CEQA) in that it does not cause
either a direct physical change in the environment, or a reasonably foreseeable indirect physical
change in the environment, and therefore does not require environmental review.
Public Notification
None required, however, Waste Management will notify affected customers as described above.
