Subject Adopt a Resolution approving changes to the Master Fee Schedule.
Recommended Action
City Council conducts a public hearing and adopts a resolution reinstating Community and
Economic Development fees removed from the Master Fee Schedule during the adoption of the
Fiscal Year 2016-17 Operating Budget.
Executive Summary
Every fiscal year development fees are reviewed for relevance and to ensure the city is being
appropriately reimbursed for services provided for building and development in Carlsbad. During
the Master Fee Schedule update in June of 2016, the Community and Economic Development
Department (CED) recognized an opportunity to simplify the city's existing fee structure with the
pending implementation of the EnerGov permitting software. Staff has determined some fees
were prematurely eliminated or inadvertently removed that need to be reinstated.
Discussion
The Master Fee Schedule for FY 16/17 was adopted June 28, 2016, with fees becoming effective
on the first day first day of implementation using the EnerGov software system (November 7,
2016), but not sooner than September 1, 2016. During the process of the Master Fee Schedule
update, several fees were consolidated or removed. Permit fees in the Village Area were
removed, anticipating the adoption of the Village and Barrio Master Plan prior to the go-live date
of EnerGov. The proposed Village and Barrio Master Plan anticipated using development fee
types used throughout the city, eliminating the need for separate Village Review Area fees. Due
to the decision to conduct additional public outreach, the Village and Barrio Master Plan adoption
was delayed. Therefore, Village Review Area permit fees need to be reinstated until the Village
and Barrio Master Plan is adopted. In addition, fees for the Habitat Management Plan (HMP)-
Minor need to be reinstated as they were inadvertently removed.
Fiscal Analysis
These fees are used to recover the cost of staff time to ensure development conforms to
standards. No significant cost to the city is anticipated. No fee increases are proposed.

Environmental Evaluation (CEQA)
The city staff has determined that the action does not constitute a project as defined in Section
15378 of the state CEQA Guidelines and is, therefore, not subject to CEQA.

posted in the newspaper and on the City website are available in the Office of the City Clerk.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, REINSTATING COMMUNITY AND ECONOMIC
DEVELOPMENT FEES REMOVED FROM THE MASTER FEE SCHEDULE
DURING ADOPTION OF THE FISCAL YEAR 2016-17 OPERATING
BUDGET
EXHIBIT 1
WHEREAS, the City Council ofthe City of Carlsbad, California has the authority to establish fees
for City services; and
WHEREAS, from time-to-time said fees are reviewed and evaluated to maintain an adequate
fee structure recovering costs for City services; and
WHEREAS, the City Council has determined the cost of providing general and development-
related services; and
WHEREAS, the City Council believes it is necessary for the City Manager to have the authority
to adjust fees that were excluded from the most recent fee schedule update; and
WHEREAS, the City Council finds it necessary to recover the costs for City services; and
WHEREAS, the City Council has held the necessary public hearing and allowed for public
comment on the establishment of said fees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the changes to the Master Fee Schedule are for the fees shown in Attachment A
attached hereto, and as amended by determinations of the City Council at its meeting
of Tuesday, June 28, 2016, as set forth in the minutes of that meeting, and as
memorialized by subsequent resolution of the City Council.
3. The City Council hereby authorizes the City Manager or his/her designee to set fees for
previously removed development related service fees. These fees will be restored to the
current Master Fee Schedule.
4. This resolution shall become effective 60 days after adoption in accordance with
Government Code 66017, for the Development-related service fees and Development
impact fees.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public
hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at
6:00p.m. on Tuesday, January 24, 2017, to consider approval of additions to the 2016/17
Master Fee Schedule development related impact fees.
Whereas, on June 28, 2016 the City of Carlsbad City Council voted to approve the City
of Carlsbad Master Fee Schedule for the fiscal year 2016/17. Discussion will include re-
instating fees that had been erroneously removed pertaining to fees within the Village
Area.
Those persons wishing to speak on this proposal are cordially invited to attend the public
hearing. Copies of the agenda bill will be available on and after January 17, 2017. If you

If you challenge the Fee Update in court, you may be limited to raising only those issues
you or someone else raised at the public hearing described in this notice or in written

Village Drive, Carlsbad, CA 92008, at or prior to the public hearing.
Fees will become effective 60 days after adoption in accordance with Government Code
66017.
