Recommended Action Adopt Ordinance No.CS-314 rescinding Ordinance No.NS-551, which adopted an Infrastructure Financing Plan and created an Infrastructure Financing District for parcels 17 and 18 of the Carlsbad Ranch Amended Specific Plan Area, due to achievement of purpose and end of term. Executive Summary /Discussion Ordinance No.CS-314 was introduced and first read at the City Council meeting held on January 24, 2017.The City Council voted 5/0 to introduce the Ordinance.The second reading allows the City Council to adopt the ordinance which will become effective thirty days after adoption. Fiscal Analysis There is no anticipated fiscal impact. Next Steps The City Clerk will have the ordinance or a summary of the ordinance published in a newspaper of general circulation within fifteen days following adoption of the ordinance. Environmental Evaluation (CEQA) Adoption of the ordinance is exempt from the California Environmental Quality Act. Pursuant to CEQA Guidelines Section 15061(6)(3), "...CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." This action would not authorize, permit or guarantee the construction of any project that would have a significant environmental effect nor commit the City of Carlsbad to approve any such project. Public Notification The City Clerk will have the ordinance or a summary of the ordinance published within fifteen days,if adopted. Exhibits 1.Ordinance No.CS-314 EXHIBIT 1 ORDINANCE NO.CS-314 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,RESCINDING ORDINANCE NO.NS-551,WHICH ADOPTED AN INFRASTRUCTURE FINANCING PLAN AND CREATED AN INFRASTRUCTURE FINANCING DISTRICT FOR PARCELS 17 AND 18 OF THE CARLSBAD RANCH AMENDED SPECIFIC PLAN AREA,DUE TO ACHIEVEMENT OF PURPOSE AND END OF TERM. WHEREAS,the City of Carlsbad, California, adopted Ordinance No.NS-551 on June 27, 2000, which adopted an infrastructure financing plan (Plan) and created an infrastructure financing district (IFD)for parcels 17 and 18 of the Carlsbad Ranch Amended Specific Plan Area; and WHEREAS, costs for eligible public works projects were allocated to the IFD and then borne by the hotel developer via development impact fees and assessments.The fees were paid at the time of the issuance of building permits.Per the Plan, the total amount of tax increment committed by the city to the IFD for reimbursement of the hotel developer for eligible development impact fees and assessments was $1.76 million.Per the Plan, the IFD would cease to exist twenty years from the date of adoption (June 27, 2020), or upon the allocation to the IFD of $1.76 million, whichever came first; and WHEREAS,by January 31, 2016,a total of $1.76 million of tax increment was collected by the IFD and then remitted to the hotel developer as reimbursements for paid eligible development impact fees and assessments.Consequently, the purpose of the IFD has been achieved thereby ending the IFD term. NOW, THEREFORE,the City Council of the City of Carlsbad, California, ordains as follows: 1.The above recitations are true and correct. 2.The City Council hereby rescinds Ordinance No.NS-551. 3.The Mayor is hereby authorized to execute this Ordinance. EFFECTIVE DATE:This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City Council on the 24th day of January, 2017, and thereafter PASSED,APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 14th day of February, 2017, by the following vote, to wit: AYES:M.
