Project Name:Village and Barrio Master Plan Project No.:GPA 16-01/ZCA 16-01/ZC 16-01/MP 14-01/LCPA 14-01 Recommended Action Adopt a Resolution (1) approving a professional services agreement with RRM Design Group to assist in the preparation of the third draft of the Village and Barrio Master Plan and (2) transferring $112,727 from the City Council's General Fund contingency account for consultant and other costs related to preparation of the third draft. Executive Summary Preparation of the Village and Barrio Master Plan began in 2014 and included a two-week public charrette in September of that year.The city released the first and second drafts of the plan in November 2015 and April 2016, respectively.Based on extensive public interest and input, the city determined to prepare a third draft.On October 19,2016,the Planning Commission considered and confirmed the items staff will revise or study for potential revision in the third draft.The list of these items is part of attached Planning Commission Resolution 7207.While completion of the third draft is a staff-led effort, consultant assistance for specific tasks is needed. Therefore, City Council is requested to authorize an appropriation to partially fund master plan efforts.Release of the Village and Barrio Master Plan third draft is anticipated late this year. Discussion Core values of the Carlsbad Community Vision emphasize enhancing the city's small town feel and beach community character and revitalizing its neighborhoods,including the Village and Barrio in particular.Consistent with the vision,a fiscal year 2016-2017 City Council goal is "enhance the health and vitality of the Village and Barrio, two neighborhoods that represent the historic heart of Carlsbad."In turn, the work plan for this goal identifies strategies to improve public spaces,optimize public properties,and enhance both neighborhoods for residents, businesses, and visitors. As noted on the Planning Commission-confirmed list of items staff will revise or study for potential revision, staff will review the latest, April 2016 Master Plan's vision and objectives in light of community comments and the Carlsbad Community Vision and make changes as appropriate.Staff will also conduct an evaluation to ensure Master Plan components that flow from the vision and objectives, such as development standards (e.g., building height, setbacks) and design guidelines, are consistent with them. To support this effort, the recommendation includes the hiring of RRM Design Group,a Southern California-based firm selected by staff following a request for proposals sent to six consultants. RRM would assist staff's development of Carlsbad -appropriate design guidelines and development standards, among other tasks.RRM's scope of work, fee, and the overall project schedule are provided as part of the proposed contract with the firm.Recommended as well is the assistance of other firms to help staff complete specific, technical tasks that support master plan implementation; the procurement costs for these tasks are minor,as the fiscal analysis table below indicates. Further, staff is preparing the third draft of the Village Barrio Master Plan in accordance with the smart growth-related policies referenced in the City's General Plan and Climate Action Plan (CAP). For example,the revised draft will maintain existing policies in the Village and Barrio that promote higher density infill development, mixed use projects, and biking, walking, and transit. Fiscal Analysis The following table identifies the proposed project budget and funding sources: VILLAGE AND BARRIO MASTER PLAN -BUDGET TO PREPARE THE THIRD DRAFT Consultant services (RRM Design Group)$138,727 Consultant services (other than RRM)$54,000 •Conduct traffic studies ($20,000) •Evaluate mobility and street improvements ($24,000) •Update environmental document ($10,000) Enhanced community engagement $19,000 Printing of approved master plans by city $5,000 TOTAL ESTIMATED PROJECT COSTS $216,727 Community and Economic Development available funds $104,000 •Funds available in operating budget ($80,000) •Enhanced engagement for planning projects ($24,000) ADDITIONAL APPROPRIATION REQUIRED $112,727 The contract with RRM contains three optional tasks as well as a contingency;a breakdown of "Enhanced community engagement"covers costs associated with a facilitated,videotaped Planning Commission community meeting, similar to the community meeting held at the Senior Center last July, which could occur during the third draft's public review period.It also includes printing and mailing expenses of several thousand postcards that would publicize the community meeting as well as public hearings to follow.Sufficient funds exist in the Community and Economic Development Department's budget to fund nearly half of the total project budget. The recommended appropriation would fund the budget gap of $112,727.As of January 31, 2017, the City Council's contingency account balance was $1,471,505. Next Steps Following contract approval,RRM and other consultants will begin supporting staff in its revision efforts.RRM's responsibilities are outlined in the scope of work.These responsibilities are in line with the Planning Commission -confirmed list of items staff will revise or study for potential revision as it prepares the third draft of the Village and Barrio Master Plan. Staff anticipates releasing the third draft for public review in late September or early October of 2017.Planning Commission and City Council hearings would occur in November and December. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Adoption of the master plan is subject to CEQA.An environmental document for the draft master plan has been prepared and circulated for public review; this document will be updated to reflect the revised master plan and may be recirculated.The updated document will be presented for consideration as part of the formal public hearings on the final master plan. Public Notification Though the recommended action does not require public notice,the city has conducted extensive community outreach for the Village and Barrio Master Plan. This outreach will continue when the third draft is presented for public review. RECITALS A.City requires the professional services of a planning consultant that is that is experienced in urban planning and design and community participation. B.Contractor has the necessary experience in providing professional services and advice related to development of a master plan for the Barrio and Village areas of Carlsbad. C.Contractor has submitted a proposal to City and has affirmed its willingness and ability to perform such work. NOW,THEREFORE,in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1.SCOPE OF WORK City retains Contractor to perform,and Contractor agrees to render,those services (the "Services") that are defined in attached Exhibit "A", which is incorporated by this reference in accordance with this Agreement's terms and conditions. 2.STANDARD OF PERFORMANCE While performing the Services, Contractor will exercise the reasonable professional care and skill customarily exercised by reputable members of Contractor's profession practicing in the Metropolitan Southern California Area, and will use reasonable diligence and best judgment while exercising its professional skill and expertise. 3.TERM The term of this Agreement will be effective for a period of 18 months from the date first above written. The City Manager may amend the Agreement to extend it for 1 additional 1 year period or parts thereof. Extensions will be based upon a satisfactory review of Contractor's performance, City needs,and appropriation of funds by the City Council.The parties will prepare a written amendment indicating the effective date and length of the extended Agreement. 4.TIME IS OF THE ESSENCE Time is of the essence for each and every provision of this Agreement. 5.COMPENSATION The total fee payable for the Services to be performed during the initial Agreement term will not exceed one hundred thirty eight thousand seven hundred twenty seven dollars ($138,727.00). No other compensation for the Services will be allowed except for items covered by subsequent amendments to this Agreement.The City reserves the right to withhold a ten percent (10%) retention until City has accepted the work and/or Services specified in Exhibit "A". • Incremental payments, if applicable, should be made as outlined in attached Exhibit "A". 6.STATUS OF CONTRACTOR Contractor will perform the Services in Contractor's own way as an independent contractor and in pursuit of Contractor's independent calling, and not as an employee of City. Contractor will be City Attorney Approved Version 4/1/15 • 1 under control of City only as to the result to be accomplished,but will consult with City as necessary. The persons used by Contractor to provide services under this Agreement will not be considered employees of City for any purposes. The payment made to Contractor pursuant to the Agreement will be the full and complete compensation to which Contractor is entitled.City will not make any federal or state tax withholdings on behalf of Contractor or its agents, employees or subcontractors. City will not be required to pay any workers' compensation insurance or unemployment contributions on behalf of Contractor or its employees or subcontractors. Contractor agrees to indemnify City within thirty (30) days for any tax, retirement contribution, social security, overtime payment, unemployment payment or workers' compensation payment which City may be required to make on behalf of Contractor or any agent,employee,or subcontractor of Contractor for work done under this Agreement. At the City's election, City may deduct the indemnification amount from any balance owing to Contractor. 7.SUBCONTRACTING Contractor will not subcontract any portion of the Services without prior written approval of City. If Contractor subcontracts any of the Services, Contractor will be fully responsible to City for the acts and omissions of Contractors subcontractor and of the persons either directly or indirectly employed by the subcontractor, as Contractor is for the acts and omissions of persons directly employed by Contractor.Nothing contained in this Agreement will create any contractual relationship between any subcontractor of Contractor and City. Contractor will be responsible for payment of subcontractors. Contractor will bind every subcontractor and every subcontractor of a subcontractor by the terms of this Agreement applicable to Contractor's work unless specifically noted to the contrary in the subcontract and approved in writing by City. 8.OTHER CONTRACTORS The City reserves the right to employ other Contractors in connection with the Services. 9.INDEMNIFICATION Contractor agrees to indemnify and hold harmless the City and its officers, officials, employees and volunteers from and against all claims, damages, losses and expenses including attorneys fees arising out of the performance of the work described herein caused by any negligence, recklessness,or willful misconduct of the Contractor,any subcontractor,anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. The parties expressly agree that any payment,attorney's fee, costs or expense City incurs or makes to or on behalf of an injured employee under the City's self-administered workers' compensation is included as a loss, expense or cost for the purposes of this section, and that this section will survive the expiration or early termination of this Agreement. 10.INSURANCE Contractor will obtain and maintain for the duration of the Agreement and any and all amendments, insurance against claims for injuries to persons or damage to property which may arise out of or in connection with performance of the services by Contractor or Contractors agents,representatives, employees or subcontractors. The insurance will be obtained from an insurance carrier admitted and authorized to do business in the State of California. The insurance carrier is required to have a current Best's Key Rating of not less than "A-:VII"; OR with a surplus line insurer on the State of California's List of Approved Surplus Line Insurers (LASLI) with a rating in the latest Best's Key Rating Guide of at least "A:X"; OR an alien non-admitted insurer listed by the National Association of Insurance Commissioners (NAIC) latest quarterly listings report. City Attorney Approved Version 4/1/15 2 10.1 Coverage and Limits. Contractor will maintain the types of coverage and minimum limits indicated below,unless the Risk Manager or City Manager approves a lower amount. These minimum amounts of coverage will not constitute any limitations or cap on Contractor's indemnification obligations under this Agreement. City, its officers, agents and employees make no representation that the limits of the insurance specified to be carried by Contractor pursuant to this Agreement are adequate to protect Contractor.If Contractor believes that any required insurance coverage is inadequate, Contractor will obtain such additional insurance coverage,as Contractor deems adequate,at Contractor's sole expense.The full limits available to the named insured shall also be available and applicable to the City as an additional insured. 10.1.1 Commercial General Liability Insurance.$2,000,000 combined single-limit per occurrence for bodily injury, personal injury and property damage. If the submitted policies contain aggregate limits, general aggregate limits will apply separately to the work under this Agreement or the general aggregate will be twice the required per occurrence limit. 10.1.2 Automobile Liability. (if the use of an automobile is involved for Contractor's work for City). $1,000,000 combined single-limit per accident for bodily injury and property damage. 10.1.3 Workers' Compensation and Employer's Liability. Workers' Compensation limits as required by the California Labor Code. Workers' Compensation will not be required if Contractor has no employees and provides, to City's satisfaction,a declaration stating this. 10.1.4 Professional Liability.Errors and omissions liability appropriate to Contractor's profession with limits of not less than $1,000,000 per claim. Coverage must be maintained for a period of five years following the date of completion of the work. 10.2 Additional Provisions. Contractor will ensure that the policies of insurance required under this Agreement contain, or are endorsed to contain, the following provisions: 10.2.1 The City will be named as an additional insured on Commercial General Liability which shall provide primary coverage to the City. 10.2.2 Contractor will obtain occurrence coverage, excluding Professional Liability, which will be written as claims-made coverage. 10.2.3 This insurance will be in force during the life of the Agreement and any extensions of it and will not be canceled without thirty (30) days prior written notice to City sent by certified mail pursuant to the Notice provisions of this Agreement. 10.3 Providing Certificates of Insurance and Endorsements. Prior to City's execution of this Agreement, Contractor will furnish certificates of insurance and endorsements to City. 10.4 Failure to Maintain Coverage.If Contractor fails to maintain any of these insurance coverages,then City will have the option to declare Contractor in breach,or may purchase replacement insurance or pay the premiums that are due on existing policies in order to maintain the required coverages.Contractor is responsible for any payments made by City to obtain or maintain insurance and City may collect these payments from Contractor or deduct the amount paid from any sums due Contractor under this Agreement. 10.5 Submission of Insurance Policies. City reserves the right to require, at any time, complete and certified copies of any or all required insurance policies and endorsements. City Attorney Approved Version 4/1/15 3 11.BUSINESS LICENSE Contractor will obtain and maintain a City of Carlsbad Business License for the term of the Agreement, as may be amended from time-to-time. 12.ACCOUNTING RECORDS Contractor will maintain complete and accurate records with respect to costs incurred under this Agreement. All records will be clearly identifiable.Contractor will allow a representative of City during normal business hours to examine, audit, and make transcripts or copies of records and any other documents created pursuant to this Agreement. Contractor will allow inspection of all work, data, documents, proceedings, and activities related to the Agreement for a period of three (3) years from the date of final payment under this Agreement. 13.OWNERSHIP OF DOCUMENTS All work product produced by Contractor or its agents, employees, and subcontractors pursuant to this Agreement is the property of City.In the event this Agreement is terminated,all work product produced by Contractor or its agents, employees and subcontractors pursuant to this Agreement will be delivered at once to City. Contractor will have the right to make one (1) copy of the work product for Contractor's records. 14.COPYRIGHTS Contractor agrees that all copyrights that arise from the services will be vested in City and Contractor relinquishes all claims to the copyrights in favor of City. 15.NOTICES The name of the persons who are authorized to give written notice or to receive written notice on behalf of City and on behalf of Contractor under this Agreement. City Attorney Approved Version 4/1/15 4 17.GENERAL COMPLIANCE WITH LAWS Contractor will keep fully informed of federal, state and local laws and ordinances and regulations which in any manner affect those employed by Contractor, or in any way affect the performance of the Services by Contractor.Contractor will at all times observe and comply with these laws, ordinances, and regulations and will be responsible for the compliance of Contractor's services with all applicable laws, ordinances and regulations. Contractor will be aware of the requirements of the Immigration Reform and Control Act of 1986 and will comply with those requirements,including,but not limited to, verifying the eligibility for employment of all agents,employees,subcontractors and consultants whose services are required by this Agreement. 18.DISCRIMINATION AND HARASSMENT PROHIBITED Contractor will comply with all applicable local, state and federal laws and regulations prohibiting discrimination and harassment. 19.DISPUTE RESOLUTION If a dispute should arise regarding the performance of the Services the following procedure will be used to resolve any questions of fact or interpretation not otherwise settled by agreement between the parties. Representatives of Contractor or City will reduce such questions, and their respective views, to writing. A copy of such documented dispute will be forwarded to both parties involved along with recommended methods of resolution,which would be of benefit to both parties. The representative receiving the letter will reply to the letter along with a recommended method of resolution within ten (10) business days. If the resolution thus obtained is unsatisfactory to the aggrieved party,a letter outlining the disputes will be forwarded to the City Manager. The City Manager will consider the facts and solutions recommended by each party and may then opt to direct a solution to the problem.In such cases, the action of the City Manager will be binding upon the parties involved, although nothing in this procedure will prohibit the parties from seeking remedies available to them at law. 20.TERMINATION In the event of the Contractor's failure to prosecute, deliver, or perform the Services,City may terminate this Agreement for nonperformance by notifying Contractor by certified mail of the termination.If City decides to abandon or indefinitely postpone the work or services contemplated by this Agreement,City may terminate this Agreement upon written notice to Contractor.Upon notification of termination, Contractor has five (5) business days to deliver any documents owned by City and all work in progress to City address contained in this Agreement. City will make a determination of fact based upon the work product delivered to City and of the percentage of work that Contractor has performed which is usable and of worth to City in having the Agreement completed. Based upon that finding City will determine the final payment of the Agreement. Either party upon tendering thirty (30) days written notice to the other party may terminate this Agreement.In this event and upon request of City, Contractor will assemble the work product and put it in order for proper filing and closing and deliver it to City.Contractor will be paid for work performed to the termination date; however, the total will not exceed the lump sum fee payable under this Agreement. City will make the final determination as to the portions of tasks completed and the compensation to be made. 21.COVENANTS AGAINST CONTINGENT FEES Contractor warrants that Contractor has not employed or retained any company or person, other than a bona fide employee working for Contractor, to solicit or secure this Agreement, and that Contractor has not paid or agreed to pay any company or person,other than a bona fide City Attorney Approved Version 4/1/15 5 employee,any fee,commission,percentage,brokerage fee,gift,or any other consideration contingent upon, or resulting from, the award or making of this Agreement. For breach or violation of this warranty, City will have the right to annul this Agreement without liability, or,in its discretion, to deduct from the Agreement price or consideration, or otherwise recover, the full amount of the fee, commission, percentage, brokerage fees, gift, or contingent fee. 22.CLAIMS AND LAWSUITS By signing this Agreement, Contractor agrees that any Agreement claim submitted to City must be asserted as part of the Agreement process as set forth in this Agreement and not in anticipation of litigation or in conjunction with litigation.Contractor acknowledges that if a false claim is submitted to City,it may be considered fraud and Contractor may be subject to criminal prosecution. Contractor acknowledges that California Government Code sections 12650 et seq., the False Claims Act applies to this Agreement and, provides for civil penalties where a person knowingly submits a false claim to a public entity. These provisions include false claims made with deliberate ignorance of the false information or in reckless disregard of the truth or falsity of information.If City seeks to recover penalties pursuant to the False Claims Act,it is entitled to recover its litigation costs, including attorney's fees. Contractor acknowledges that the filing of a false claim may subject Contractor to an administrative debarment proceeding as the result of which Contractor may be prevented to act as a Contractor on any public work or improvement for a period of up to five (5) years.Contractor acknowledges debarment by another jurisdiction is grounds for City to terminate this Agreement. 23.JURISDICTION AND VENUE Any action at law or in equity brought by either of the parties for the purpose of enforcing a right or rights provided for by this Agreement will be tried in a court of competent jurisdiction in the County of San Diego, State of California, and the parties waive all provisions of law providing for a change of venue in these proceedings to any other county. 24.SUCCESSORS AND ASSIGNS It is mutually understood and agreed that this Agreement will be binding upon City and Contractor and their respective successors. Neither this Agreement nor any part of it nor any monies due or to become due under it may be assigned by Contractor without the prior consent of City, which shall not be unreasonably withheld. 25.ENTIRE AGREEMENT This Agreement, together with any other written document referred to or contemplated by it,along with the purchase order for this Agreement and its provisions, embody the entire Agreement and understanding between the parties relating to the subject matter of it.In case of conflict, the terms of the Agreement supersede the purchase order. Neither this Agreement nor any of its provisions may be amended, modified, waived or discharged except in a writing signed by both parties. 26.AUTHORITY The individuals executing this Agreement and the instruments referenced in it on behalf of Contractor each represent and warrant that they have the legal power, right and actual authority to bind Contractor to the terms and conditions of this Agreement. As such, we recognize that a community's village and surrounding neighborhood character directly impact the sense of place and daily experiences its residents and visitors will have. In this task, RRM's multi-discipline team of LEED© accredited architects, planners, urban designers, and landscape architects will utilize our extensive experience in helping communities reshape their downtowns with successful design guidelines and development standards to review and critique the existing document. We are dedicated to delivering realistic implementation strategies and solutions, rather than plans that just sit on a shelf, and the services we provide to the private sector, coupled with seeing projects through construction,is vital to creating a realistic Master Plan that fosters private investment. In a "walk before you run approach,"RRM will provide one (I)redlined document to the City with recommended modifications to the existing document,a brief summary of defining elements that will illustrate an understanding of the overall objectives identified below, along with a sampling of photographs and graphics to ensure staff and the RRM team are on the same page with the direction of the future document. A meeting with staff (conference call) will be scheduled to review the materials and define next steps. Objectives: General •Support the Carlsbad Community Vision, particularly the core values of "small town feel, beach community character,and connectedness,""open space," "sustainability," and "neighborhood revitalization, community design, and livability." Make Master Plan examples,text,and graphics more Carlsbad-specific and responsive to the desired character of the Village and Barrio,as expressed by the community. •Emphasize and encourage walkability and pedestrian-scale throughout the Village and Barrio. Design Guidelines/Standards •Prepare guidelines with "teeth,"so they effectively guide project design and assist the public, staff, and decision makers in project evaluation and recommendation. •Write and illustrate guidelines in plain English. •Avoid dictating any particular architectural style or theme but promote community- supported design. Conversely, consider developing appropriate guidelines to "tone down" modern or contemporary architecture or discourage its use. Carlsbad Village and Barrio Master PlanrrmScope of Services January 24, 2017 design Page 3 of 8 group •Establish guidelines and standards to enable a successful transition and "fit" from (I) new development to often smaller scale existing development, and (2) the higher density perimeter of the Barrio to the lower density Barrio core. •Recommend ways to incentivize public open spaces (e.g., plazas,corridors, corner treatments)in the Village and Barrio. •Develop design guidelines for mixed-use buildings. •Encourage quality and Carlsbad-appropriate architecture and materials throughout the Barrio and Village considering the close proximity and visibility of buildings to each other, streets and alleys, and pedestrians. •Provide design guidelines for parking structures, based on the assumption that structures will be hidden by liner buildings. •Develop guidelines and standards for buildings along alleys; ensure standards incentivize the use of alleys,such as for parking access. •Identify ways to preserve the smaller scale,lower intensity nature of the Barrio core, while still allowing permitted densities (up to 15 units per acre) to be achieved. •Ensure guidelines and standards enable achievement of the different Village and Barrio densities. Standards •Evaluate Master Plan building heights and the number of stories permitted throughout the plan in light of project objectives and community concerns. (Note: The currently proposed maximum building height of 55 feet in the Master Plan will be reduced to 45 feet.) •Consider the appropriateness of allowing architectural projections,such as towers, to exceed the maximum building height; further,consider provisions for roof deck amenities and whether they should be permitted to exceed maximum heights. •In addition to matters related to building height, evaluate existing standards or evaluate or advise on the need for new standards (e.g.,setbacks,lot coverage,lot size,and dimensions)in light of project objectives. •Consider changes to standards in light of results from the Village, Barrio and beach area parking study. Deliverables: •A memorandum summarizing RRM's approach to updating the plan,a redline markup ofthe existing document to identify where changes should be made, items should be eliminated, and graphics should be updated, and sample graphics and photos. Carlsbad Village and Barrio Master PlanrrmScope of Services January 24, 2017 design Page 4 of 8 group Task B:Master Plan Document Production Administrative Draft Design Guidelines RRM will significantly revise or replace entirely the April 2016 Master Plan design guidelines and produce illustrated guidelines that reflect the project objectives as outlined in the RFP.The draft Design Guidelines will be provided to City staff for review and comment. The focus will be to create Design Guidelines that are user-friendly, technically proficient, easily navigated, streamlined, and understandable. The text will be supplemented with graphics and photographs to ensure design concepts, and their intended physical results are clearly understood. Revised Development Standards RRM will review the existing development standards provided within the Master Plan and recommend any changes needed to ensure consistency with the design guidelines and the project objectives. The draft revisions will be provided to City staff for review and comment. A meeting with City staff will be held to discuss staff comments and recommended revisions. Assist with the Master Plan Layout, Graphics, Formatting, and Preparation RRM knows what it takes to get projects built,and our Master Plans are user-friendly documents, full of graphic examples and images that illustrate a community's vision. We encourage you to contact our references and hear firsthand about our outstanding service and products. In this task, RRM's designers will prepare up to three (3) sample layouts for City selection. Prior to initiating page design,the City will provide direction regarding page size,page orientation, number of text columns, preferred colors, preferred font styles, and other design preferences. RRM will provide three draft layouts,and the City will select a preferred design and identify any necessary revisions. Overall, RRM will produce all drafts and the final Master Plan document (and the Coastal Commission approved document, if necessary) in Word with fonts and formatting acceptable to the City. Electronic documents will be suitable for conversion to Adobe PDF for ease of use and printing. In addition, RRM's graphics team will develop diagrams, sketches and select photography for inclusion in the document. A list of proposed graphics will be submitted to the City prior to the development of new exhibits and graphics. RRM assumes two (2) hours to complete each sketch and up to 80 hours is assumed for this task. Sketches will be provided in digital format for inclusion into the document. RRM will utilize photographs from our extensive image library. Additional photographs may need to be taken to visually explain unique circumstances and Carlsbad character.In this case,RRM will work with staff to identify projects of desired quality and character. This draft is for in-house administrative review only and will be refined for the Public Screencheck Draft. We ask that the City provide one (I)consolidated marked-up,redline version with all City comments for each set of revisions. RRM understands the City may not provide all revisions and comments by the first set of revisions. Deliverables: •Three (3) page layout designs. •RRM will consolidate the new material created by RRM and provided by the City into the Administrative Draft Master Plan document The design guidelines chapter and development standard revisions will be incorporated and submitted to the City as part ofthe Administrative Draft Master Plan.RRM will provide one (I)electronic copy and up to ten (10) color copies for each of the two drafts. Following receipt ofone (I)redlined draft from City staff ofrequested revisions, RRM will meet in person with staff to discuss desired revisions.This meeting will occur following the first or second set ofthe requested revisions as RRM and City staffdetermine. Screencheck Draft Following the receipt of a single set of redlined comments from City staff,RRM will produce the Screencheck Draft.At this point,all the City's comments will have been integrated, and this draft will provide an opportunity for a final review to ensure previous concerns have been addressed prior to the distribution of the draft for public review and hearings. Deliverables: •RRM will produce one (I)electronic and five (5) hard copies ofthe Master Plan.We ask that the City provide one (I)consolidated marked-up, redline version or a summary ofall requested document revisions. Public Review Draft Following the receipt of a single set of redlined comments from City staff, RRM will revise any necessary clean up items and produce the Public Review Draft. A contract amendment will be required should public input be significant enough to warrant the development of a Public Hearing Draft document. However, if revisions are minor in nature, RRM will work with staff to produce an errata sheet to describe intended modifications as part of this task. It is assumed that one (I)set of revisions will be made to the document, incorporating both the Planning Commission's recommendations and City Council action. Errata sheets will be used to discuss preferred changes between hearings. The City will be responsible for printing the adopted document once RRM has made the final edits and modifications and has provided the final electronic copy. Deliverables: •One electronic copy and up to five (5) hard copies ofthe final Master Plan document Coastal Commission Approved Document (Optional) Depending on the significance of changes required by the California Coastal Commission,RRM's assistance with revisions to the City Council-adopted document may be needed. As determined necessary by the City, RRM will make additional final edits and modifications to the document. It is assumed that one (I)set of revisions will be made to the document. The City will be responsible for printing the adopted document once RRM has made the final edits and modifications and has provided the final electronic copy. Deliverables: •One electronic copy and up to five (5) hard copies ofthe final Master Plan document Task C: Meetings and Coordination Kickoff Meeting RRM will prepare for and attend a kickoff meeting and field reconnaissance with City staff. Deliverables: •Prepare for and attend in-person kickoff meeting with staff Community Meeting (Optional) RRM is available to attend and present at a community meeting, if determined necessary by the City. RRM's role would be limited to observing and/or helping staff explain aspects of the Master Plan,such as the design guidelines. RRM's Project Manager or Principal-in-Charge will attend the meeting. Deliverables: •RRM will attend the community meeting,ifneeded.City staff will be responsible for meeting facilitation, notification, facility, logistics, and refreshments. Planning Commission/City Council Hearings (Optional) After the preparation of the Master Plan,RRM is available to attend and present to the Planning Commission and/or City Council,as needed. Deliverables: •RRM will prepare for and attend up to three (3) meetings/hearings. City staff will be responsible for meeting logistics and notification. Project Management and Billing At the beginning of a project, RRM focuses on capturing a clear direction on final deliverables and end products, establishing a shared understanding of the project with the City. Providing an essential project "road map," RRM develops a critical path schedule, monitoring and updating it regularly, throughout the process.RRM makes it a practice to provide monthly status reports of project progress and closely coordinate with the City's project manager.In addition,all product deliverables are reviewed internally for quality control purposes prior to City submittal. This task is intended to allow for necessary coordination between the project team members and City staff,including correspondence, record keeping, electronic file management, and additional necessary coordination through regular teleconferences and limited in-person meetings. This assumes an average of six (6) hours per month for nine (9) months and includes RRM's participation in staff-level meetings two times per month. As the City determines, two (2)ofthe staff-level meetings will be in-person at the City's Faraday Center so that any key issues may be discussed; other meetings may be conference calls. The frequency and number ofthese staff-level meetings may be reduced if any are determined unnecessary.The two (2) in-person meetings are recommended to occur as part ofpreviously described tasks and are_not included as part of this task Reimbursable Expenses Reimbursable expenses include, but are not limited to, reproduction, postage and handling of drawings and documents, long distance communications, fees paid to authorities having jurisdiction over the project,and travel expenses. Reimbursable automobile travel mileage will be billed at the current IRS business standard mileage rate. Fees for employee rates, reimbursable expenses, and RRM Design Group reproductions shall be billed to the Client on a percentage of completion or on an as-performed basis as agreed by the parties. Clients shall reimburse RRM Design Group for incidental expenses incurred by RRM Design Group at actual cost plus 10%to cover our overhead and administrative expenses. Contingency Should additional drafts be necessary or in the event that other unforeseen issues arise during the planning process, we recommend that the City establish a budget contingency of approximately 10%of the total estimated budget that may be drawn upon to cover unknown consulting expenses. The benefit of a contingency is to allow City staff to request additional services from their consultant team in an expedited manner. All additional services will be processed on an as needed basis based on a formal written request from City staff to the consultant. No additional services beyond the quoted fees may be charged to the City without prior written authorization. A.Overall 1.Tone, content, and formatting —As an overall effort, staff will evaluate the plan's contents for redundancy,readability, ease of use,and tone. Ways the document can be streamlined and perhaps shortened overall (e.g.,deleting sections on the charrette,economics and tactical urbanism and/or relocating them to the appendix) will be examined.Existing, adopted master or specific plans will be consulted to determine if a different format and wording style and means to present information should be considered. 2.Graphics —The April 2016 Master Plan draft has many renderings,pictures and maps. Consideration will be given to eliminate unnecessary graphics, partly to aid in the streamlining effort; for those proposed to remain, modified or be added, staff will seek to make them more appropriate to Carlsbad. 3.Vision and objectives —Staff will review the Master Plan's vision and objectives (Master Plan Part One and Section 4) in light of community comments and the Carlsbad Community Vision and make revisions as appropriate.Staff will also conduct an evaluation to ensure Master Plan components that flow from the vision and objectives, such as development standards (e.g., building height, setbacks) and design guidelines, are consistent with them. B.Development Standards, Design and Character 1.Development and use standards (Master Plan Part Two —the "Code")—In particular, this section of the plan will be targeted for streamlining and improved usability.Graphics will be revised and standards will be reviewed for appropriateness. 2.Transect Districts —The adopted Village Master Plan and Design Manual divides the Village into nine land use districts.The draft Village and Barrio Master Plan uses seven Transect Districts instead (see Section 6.2)as a means to provide standards for both neighborhoods.The Transect Districts can be confusing and their intent statements are not clear.Staff will examine the Transect Districts' effectiveness and may recommend modifications or replacement by a different method of providing standards across the proposed Master Plan area.As part of this evaluation, staff will also study refinements to the boundaries of the Master Plan. 3.Building height —Staff recommends eliminating the proposed height increase to 55-feet.Staff also will evaluate height limits and the maximum number of stories for each district.Further, consider the appropriateness of allowing architectural projections, such as towers, to exceed the maximum building height. 4.Community character —Most seem to agree that certain elements in the Village and Barrio bear maintaining:the less dense Barrio core,the Twin Inns at the northeast corner of Carlsbad Boulevard and Carlsbad Village Drive (location of Sun Diego and the Land and Water Company), State Street between Carlsbad Village Drive and Grand Avenue, and the very large trees along Grand Avenue.The overall walkability of the entire Master Plan area and small town feel are other desirable attributes. Many of these qualities are captured in the core values of the Carlsbad Community Vision (e.g., small town feel, community character and connectedness).As noted, staff will review the Master Plan's vision and objectives for consistency with the Community Vision and seek to develop guidelines and standards that follow suit. Exhibit A to Planning Commission Resolution 7207 October 19, 2016 Page 2 5.Design Guidelines/Architecture —Staff will revisit Master Plan Part Three, Design Guidelines,as to structure,contents,and effectiveness.Examples,text,and graphics will be more Carlsbad- appropriate and responsive to the desired character of the Village and Barrio.An effort will be made to provide guidelines written and illustrated in "plain English."Staff will also study how the guidelines can have more "teeth"so they can effectively guide project design and assist the public, staff, and decision-makers in project evaluation and recommendation. Staff does not recommend establishing any particular style or theme (such as a Spanish theme in the Barrio)but does believe providing examples of community-supported architecture in the Village and Barrio would be worthwhile.It seems appropriate for the design guidelines to provide some regulation of exterior materials.Guidelines for building mass should be considered, such as setback requirements for upper building floors.Further, because buildings are in close proximity to the street,pedestrians,and other buildings,quality of design is important to ensure the planning area remains interesting and inviting. C.Streets, Parking and Circulation 1.Parking —Parking provisions are found throughout the Master Plan and particularly in the Vision and Code sections (Parts One and Two).Parking standards will be revised pending the completion of the Village,Barrio and Beach Area Parking Study.It is expected the parking study recommendations could impact many Master Plan provisions,particularly the strategies of the Mobility Plan (Section 2.7) and the parking ratios and parking in lieu fee standards (Section 6.4). 2.Parking structure —Evaluate a parking structure in the Village even if the parking study does not recommend one. 3.Street vacations A policy on street vacations for the Village and Barrio areas will be considered. 4.Alleys —Improved development and design standards are recommended for alleys so that they too present a pleasant appearance in both the Barrio and Village. 5.Alternative Design Streets —The appropriateness of maintaining this designation, which affects some Village streets, will be considered. 6.Bike Plan —Many people commented on the desire for safer bicycling in the Village and Barrio, particularly in the form of bike paths separated from vehicle travel lanes.Staff will review the proposed master plan's contents and recommend changes and may seek the advice of a bicycle interest group. 7.Street lighting —Review the lighting plan,Master Plan Section 2.5.1.4,for adequacy and in consideration of capital improvement projects to improve pedestrian lighting along Carlsbad Boulevard and in the Barrio and street lighting throughout the Village and Barrio. 8.Traffic calming and pedestrian improvements —Continue to evaluate roundabouts, traffic circles, bulb-outs,crosswalks,and sidewalk and accessibility improvements as a way to improve circulation for all forms of mobility in the Village and Barrio; accordingly, staff will review Master Plan Sections 2.5 and 2.6 (and Section 2.6.4, Barrio Streets, in particular) for appropriateness. 9.Entry monuments —Consider improvements to entry features that welcome people to the Village. 10.Chestnut Avenue —A crossing of the railroad at Chestnut Avenue should move forward regardless of trenching. Exhibit A to Planning Commission Resolution 7207 October 19,2016 Page 3 D.Land Use 1.Areas north of Grand Avenue —Staff will examine the appropriateness and adequacy of Master Plan standards and objectives for the areas generally north of Grand Avenue, particularly in the vicinity of the Army and Navy Academy and along Roosevelt Street eastward to Jefferson Street. 2.State Street —Between Carlsbad Village Drive and Grand Avenue, State Street is often cited as a wonderful example of downtown Carlsbad.North of Grand Avenue, State Street is benefitting from private investment but lacks the character that exists in the one block south of Grand Avenue.Focused planning to guide street design, public space and land uses along this street is recommended. 3.City hall —The Master Plan suggests a new city hall as a potential future use of city-owned property at Carlsbad Village Drive and Roosevelt Street (Section 2.4.2).A current City Council strategic policy goal is to plan for a new city hall.One objective of the goal is to evaluate potential city hall locations.Completion of this evaluation is expected in summer 2017.The Master Plan should be consistent with study results. 4.Curb cafes —Curb cafes were approved as part of a three year pilot program according to City Council Policy 78.The pilot program has expired and no new curb cafes can be permitted unless the program is renewed.The April 2016 Master Plan draft contains broad policy language that encourages the ongoing permitting of curb cafes and recommends expansion of the area in which the policy allowed them.Now that the Village, Barrio and Beach Area parking study is underway, study results should influence any Master Plan provision in this matter. 5.Railroad trenching —With release of a comprehensive study on railroad trenching this fall and subsequent review,the Master Plan may need amendment as appropriate.In addition,the Master Plan should emphasize covering as much of the trench as possible. 6.North County Transit District property—While trenching of the railroad tracks is an obvious factor, staff will look to better develop Master Plan standards for NCTD-owned properties in cooperation with the agency.It is expected that the Village, Barrio and Beach Area Parking study will also provide information on the status and future use of parking lots the city presently leases from NCTD. 7.Implementation Plan —Staff will draft an implementation plan for public improvements that identifies, in general terms, time frames, feasibility and constraints, potential costs,and funding sources. 8.Open space —The Master Plan recommends several open space opportunities, such as the Lincoln Street Plaza and the Grand Avenue Promenade.The Village and Barrio also benefit from three existing public parks and proximity to the beach.Staff will evaluate measures to incentivize developers to incorporate visible and attractive public spaces,particularly along a key corridor such as Carlsbad Village Drive. 9.Undergrounding utilities —A proposal to underground utilities can be constrained by available funding and other, already planned undergrounding projects.Also, undergrounding is commonly done in conjunction with a street improvement project.The feasibility and possible timeframes for undergrounding in the Village and Barrio are not known,but staff can conduct some basic research in this regard; potentially, undergrounding could be a component of the recommended implementation plan. 10.Preservation of a commercial "core"—Residences are permitted in all proposed Transect Districts (except the Civic District,which is applied to the railroad corridor and city parks), though the Master Plan cautions their use in areas where they could break up retail continuity.Furthermore, the current Village Master Plan and Design Manual requires the primary permitted land uses for Exhibit A to Planning Commission Resolution 7207 October 19, 2016 Page 4 all ground floor space in the Coastal Zone to be visitor serving commercial uses.Staff will study whether in some areas it may be appropriate to restrict residential uses to upper floors only (in a mixed use format) where a strong commercial street scene or retail continuity is desirable and will confirm with the Coastal Commission the extent of requirements for visitor serving commercial. 11.Mixed use projects —Buildings with a mix of uses would be permitted by the Master Plan.This may include a combination of different commercial uses, such as retail on the first floor and offices above, or a mix of residential and commercial uses.Staff will study what mix of uses is acceptable, including whether time-shares should be allowed in a mixed use project. 12.Grand Avenue Promenade —The master plan recommendation to convert a portion of this street into a public plaza should remain.
