Recommended Action
Adopt a resolution to enter into a contract with Mallory Safety & Supply for fixed and mobile
license plate recognition systems in an amount not to exceed $807,025.20 and approving the use
of city innovation funds to implement the program.
Executive Summary
Fifty-one fixed License Plate Recognition (LPR) cameras will be acquired and six marked police
vehicles will be outfitted with mobile LPR cameras to expand the existing LPR system currently in
place. The acquisition will include the commissioning of all equipment, programming, aiming,
software installation, and training and will include a warranty and service for period of five years.
The LPR cameras are part of an overall crime reduction plan to assist the police department in
reducing crime and making for a safer community.
The vendor for the LPR system, Vigilant Solutions, is part of a US Communities cooperative
purchase program, leveraging more than 55,000 member agencies. Carlsbad Municipal Code
section 3.28.100 authorizes the Purchasing Officer to use Cooperative Purchasing Agreements
when those agreements are deemed to be in the best interest of the city and have been awarded
in a competitive manner. The Purchase Contract has been reviewed by the city's Purchasing
Officer who has found the contract to be in compliance with the city code. This US Communities
contract is held by Mallory Safety & Supply Company. Mallory Safety is Vigilant's business
partner, where Vigilant has successfully utilized their expertise with the US Communities contract
which provides competitive pricing.
Discussion
BACKGROUND
The police department has utilized mobile vehicle mounted LPRs on patrol vehicles since 2011.
The department initially invested in outfitting four patrol vehicles with these readers. The LPR
equipment in current patrol vehicles has reached the end of its useful life and due to equipment
failure, there are only two fully functional LPR vehicles. Furthermore, the current equipment is
outdated and in need of updating. The department currently has no fixed LPR cameras.

LPR SYSTEM
License Plate Recognition (LPR) technology uses high speed cameras to capture license plate
images of vehicle license plates in public places. LPR software reads the characters on the plate
and also appends date, time, and location for the photograph. LPR essentially does what officers
have been doing with their eyes for many years, only much more efficiently and without any
human bias.
The LPR system compares these plate "detections" against law enforcement databases
containing vehicles of interest stolen vehicles, Amber alerts, missing persons, felon vehicles,
and more. Any matches against a vehicle of interest notifies the officer using the system as well
as the dispatch center (for fixed LPRs) providing an element of officer safety by making them
better aware of their surroundings, and also enabling the officer to take appropriate action per
department policy. All of the captured license plate data goes into a searchable database that
may be used by investigative staff to develop leads. Comparing multiple crime scenes for a
common vehicle, looking for a particular make and model vehicle as reported by eyewitnesses,
or looking at prior locations of a known vehicle of interest are all useful investigative applications
of LPR. LPR has been endorsed by the lntern~tional Association of Chiefs of Police and has been
useful in solving thousands of crimes including residential burglary, homicide, rape, narcotics
trafficking, kidnapping, identity theft, and terrorism.
LPR data is anonymous, and does NOT contain any personal information. The registered owner
of the vehicle is not known by the LPR system, nor can it be obtained through the LPR system.
The federal Driver's Privacy Protection Act (DPPA) requires that law enforcement have a
permissible purpose for connecting an anonymous license plate number to a registered owner
through the Department of Motor Vehicles. Recently enacted California law states that LPR data
is not personal information and ensures responsible use by requiring an agency usage and privacy
policy.
There are many great success stories throughout Southern California and nationwide involving
the use of LPRs to solve crime cases and apprehend criminal suspects.
The selected vendor, Vigilant Solutions, is currently utilized throughout the nation and is the
largest law enforcement collaborative effort among other vendors for LPR systems. Current
existing law enforcement clients include the San Diego Sheriffs' Office, California Highway Patrol
(CHP), Orange County Sheriffs' Department and all Orange County law enforcement agencies,
San Bernardino County Sheriffs' Department, and the Riverside Police Department. This program
will allow the Carlsbad Police Department to share and exchange data with existing users in
surrounding cities and counties.
ISSUES
From 2014-2016, the City of Carlsbad experienced an increase in property crime. These crimes
were primarily residential burglaries, auto thefts, and thefts from vehicles. The LPR system
captures license plate information from vehicles, and alerts are sent to the police department if

the vehicle associated with the license plate has been reported stolen. Thus, if a stolen vehicle is
entering the city and is captured on LPR, the police department will be notified immediately,
increasing the likelihood of recovering the vehicle and capturing the suspect. Vehicles that are
stolen from within the city will also have a stronger likelihood of being recovered and returned
to its rightful owner. Additionally, the license plate information is stored in a database that can
be mined for geocoded photographs of the vehicles captured on the camera, improving the
chances of investigators solving crimes that have been committed. Arrest records provide
evidence that the majority of the property crimes are committed by offenders who come from
outside our city, commit a crime, and then flee the city. These offenders most frequently travel
by car. Through November 2016, nearly three quarters of the offenders arrested for property
crimes (excluding shoplifting) live outside of the City of Carlsbad. The LPR system will assist
authorities in identifying these suspects who are entering the city to commit crimes.
STRATEGIES
The police department has a multi-layered plan to reduce property crime through the use of
technology, specifically the strategic deployment of cameras.
1. Mobile-License Plate Recognition (LPR)
The police department has utilized vehicle mounted license plate recognition cameras on
patrol vehicles since 2011. The department initially invested in outfitting four patrol
vehicles with these cameras. However, over time the operational number of cameras is
now only two.
This proposal is to outfit a total of six patrol vehicles with new license plate readers.
2. Fixed location-License Plate Recognition (LPR)
Fixed LPRs will be posted along main thoroughfares to document vehicles travelling into
the city. The LPRs will also photograph vehicle license plates, uploading the photographs
into a database available to law enforcement. Furthermore, these readers will alert police
dispatch when a stolen or wanted vehicle passes a camera. Dispatch will then alert
officers of the make, model, color, license plate number, and direction of travel of the
wanted vehicle. The location of these readers will be dictated by traffic flow and volume
information obtained from the city traffic engineer's office along with crime data.
This proposal is to place 51 fixed cameras at 14 strategically identified locations.

Fiscal Analysis
The police department is requesting funding in the amount of $807,025.20 from the city's
Innovation Fund in order to implement the Fixed and Mobile LPR camera systems. Included with
the purchase will be the cost of programming, aiming, software installation, and training.
Additionally, five years of commercial data and five years of basic and standard services packages
to include software warranty, hosting fees, and all required features, as well as five years of
hardware warranty and three years of cellular Verizon air-card service as required for inter-
connectivity are included in the contract.

Next Steps
If the Council approves the purchase ofthe LPR systems, a purchase order will be opened to begin
the purchasing process with the vendor. The police department will then begin an informal
bidding process for the installation of the fixed LPR cameras throughout the city. The Police
Community Relations Manager will reach out to community groups to share the plans and gather
community feedback.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code section 21065, this action does not constitute a "project'1
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
Public Notification
An essential element ofthis strategy is community outreach prior to the implementation of LPR1s
and the fixed cameras within neighborhoods. The police department will spread awareness via
several social media outlets and by holding neighborhood meetings. At these neighborhood
meetings the Police Department will inform the community regarding ongoing crime trends,
learn the purpose behind these cameras, and the protections taken by the police department to
respect individual privacy concerns. Furthermore, the community will be encouraged to partner
with the police department by making reports of suspicious persons and vehicles, reporting
crimes, and installing alarms and personal surveillance camera systems. In the future the
department may enact a voluntary registry of personal surveillance camera systems and
businesses so that when crime occurs the police department is aware of potential sources of
evidence.
