Recommended Action Adopt a Resolution to set a Public Hearing date for proposed increases to recycling and trash service rates. Executive Summary Coast Waste Management, Inc.is the exclusive provider of residential and commercial recycling and trash solid waste services in the City of Carlsbad. The current contract establishes the recycling and trash service rates, effective July 1,2012, and allowed for annual adjustments to be made through fiscal year (FY)2016-17 as part of the Master Fee schedule during the city's budget adoption process.A Public Hearing is required for FY 2017-18 for future rate increases under Article XIIID of the California Constitution, Proposition 218. Staff recommends setting the Public Hearing date for June 13, 2017. Discussion The City of Carlsbad provides recycling and trash solid waste services to its residents and businesses as outlined in Section 6.08 of the Carlsbad Municipal Code. These services are provided through an exclusive contract with Coast Waste Management,Inc. The current contract was approved by the City Council in February 2012, per Resolution No. 2012-033. The contract established residential, commercial and multi-family rates for various recycling and trash services, effective July 1,2012. Per the terms of the contract, the rates may be adjusted annually through FY 2016-17 as part of the city's budget adoption process. Rates may be increased in accordance with two items:1)the annual change in the Consumer Price Index (CPI), All Urban Customers,San Diego All Items, and 2) increases based on the disposal rates at the Palomar Transfer Station in Carlsbad,CA. A Public Hearing is required for FY 2017-18 for future rate increases. Rate increases are being proposed, effective July 1,2017. Staff is recommending residential, commercial and multi- family recycling and trash rates may be adjusted and adopted annually through the FY 2021-22 as part of the city's budget process, consistent with prior practice. This date coincides with expiration of the Coast Waste Management, Inc. contract, set for June 30, 2022. The term of the current contract is 10 years with an optional three-year extension. Exhibit 2 provides the rates that, if approved, will go into effect on July 1, 2017. Item #2 April 25, 2017 Page 1 of 14 Fiscal Analysis The franchise fee paid to the city by Coast Waste Management,Inc. is 7.5 percent of revenues collected, and is deposited into the city's General Fund to help fund general governmental services. Assembly Bill 939 (AB 939) allows the city to collect revenue to fund the recycling and trash program.The City of Carlsbad collects an AB939 fee of 2.0 percent which is allocated to the Solid Waste Fund. This fee helps fund the recycling and trash program. While the percentages will remain the same, increased recycling and trash fees will result in increased revenues collected to both the General Fund and the Solid Waste Fund. If the new rates are approved, the anticipated annual increase in revenue will be approximately $20,000 to the General Fund from franchise fees, and approximately $5,000 to the Solid Waste Fund from the AB 939 fee. Environmental Evaluation {CEQAj The project is exempt from the California Environmental Quality Act (CEQA)per State CEQA Guidelines Section 15273 —CEQA does not apply to the establishment, modification, structuring, restructuring or approval of rates, tolls, fare or other charges by public agencies. Public Notification California Constitution, Article XIIID, Section 6,states that local governments must hold a Public Hearing, and notify property owners and customers by mail at least 45 days in advance of Public Hearings related to property-related new or increased fees and charges, such as recycling and trash services. At the Public Hearing,if it is determined that a majority of property owners have submitted a formal protest, the proposed fee change must be rejected. This is a requirement of Proposition 218, which was passed by California voters in 1996 to limit methods Item #2 April 25, 2017 Page 2 of 14 by which local governments can create or increase taxes, fees and charges without taxpayer consent. Any person interested in objecting to the increases may file a signed written protest with the city clerk. The written protest must contain the address of service, the rate change being protested and be received prior to the close of the Public Hearing. While protestors may appear at the hearing and be heard on the matter, only written protests are counted for the purpose of determining whether there has been a majority protest. Staff will take the following actions at least 45 days prior to the June 13, 2017, Public Hearing: •Notify affected customers and property owners by mail of the Public Hearing. •The notice will provide information relating to the Public Hearing. •The notice will provide information regarding the proposed rates. •In addition, information about the Public Hearing and proposed rates will be posted on the city's website at www.carlsbadca.gov. Information regarding public notifications of this item such as mailings, Public Hearing notices posted in the newspaper and on the city website will be available in the office of the city clerk. The residential solid waste services include the weekly collection of trash, recyclables and green waste. The commercial solid waste services include collection of trash, recyclables and green waste as frequently as scheduled by the customer, but not less than once per week. Coast Waste Management provides and maintains the recyding and trash carts and bins. The contract provides a mechanism for increasing rates utilizing the annual increase in the following items: 1.The annual change in the Consumer Price Index, or "CPI,"All Urban Customers, San Diego All Items; 2.Change in the monthly amount paid by the contractor for the facility use; and 3.Increases on the disposal rates at the Palomar Transfer Station in Carlsbad, CA. Coast Waste Management guarantees that throughout the term of the contract that the contractor's net rate for Single-Family residential Cart Collection Service (for a 64 or 96 gallon cart) and Contractor's net rate for Multi-Family and Commercial Bin Collection Service (for a three-yard bin picked up once per week) will be in the lowest third of net rates being charged for similar services in all cities in San Diego County using a franchised collection system. Rate increases are being proposed, effective July 1,2017. How are Recycling and Trash rates calculated? Under the terms of the contract, rate adjustments during the next five years, through fiscal year 2021-22,will be made as follows: A. Franchise Fee/AB 939 Fee Component-The Franchise Fee (7.5 percent)/AB 939 fee (2 percent) portion of each rate is set at 9.5 percent of the total of the Service Rate plus the Occupancy Rate plus the Disposal Component plus the Franchise Fee. E.Storm Water Component -The Storm Water Component of each rate is not increasing. About trash rates and the proposed increases The current monthly trash rate for all single-family customers is $21.04. The proposed rate will vary depending on the size of the trash container selected by the customer. Residents may either select a 64 or 96 gallon trash container at a proposed rate of $21.04 per month, or a 35 gallon trash container at the proposed rate of $19.07 per month. The rate is onlyaffected by the size of the trash container. The rates for multi-family and commercial customers will depend on the size of the bin, the type of material collected and the frequency of collection. The rates will increase between 1.2 percent and 1.7 percent from the current rates.
