Army & Navy Academy Student Enrichment Center RP 16-12/CDP 16-28 (DEV 16-034) Recommended Action That the City Council hold a public hearing and adopt a resolution approving Major Review Permit No. RP 16-12 and Coastal Development Permit No. CDP 16-28 for the construction of a two-story 4,714 square foot building for student meeting and exhibition space at 2800 Carlsbad Boulevard. Executive Summary The Army and Navy Academy is seeking approval of a Major Review Permit and Coastal Development Permit to construct a Student Enrichment Center consisting of a two-story 4,714 square foot building for student meeting and exhibition space at the south end of the athletic complex which is located on the on the east side of Carlsbad Boulevard and north of Beech Avenue. The north end of the 4. 71 acre site is currently developed with a parking lot and Duffield Complex which consists of a gymnasium, a weight room, a training room, locker rooms, a wrestling room, meeting space and offices. The athletic field occupies a majority of the site with the bleachers and press box on the westerly side of the property. On March 15, 2017, the Planning Commission conducted a public hearing and unanimously recommended approval (7-0) without any discussion. There were no members from the public who spoke regarding this proposal. Discussion The proposed Student Enrichment Center will be used for student meeting rooms, exhibition space, and can also be used for an alumni gathering place during events on the athletic field. The entrance to the building is located on the west side, where the lobby leads to an exhibit space. The second floor has meeting rooms, offices and a covered balcony facing the athletic field. The Army and Navy Academy Master Site Plan calls for use of the Spanish Colonial Revival architecture style unified by the use of arches, courtyards, form as mass, plain wall surfaces and tile roofs. The proposed Student Enrichment Center uses white stucco as the building material, .. , r Item #7 April 25, 2017 Page 1 of 61 a tile roof, an arched element over the entrance, and recessed windows. The proposed building meets all development standards outlined in the Village Master Plan for District 9. Staff recommended design improvements to the building as originally submitted, including adding additional windows and enhancing the architectural treatment, which have been incorporated into the current design of the building. Staff received no comments or inquiries from any interested parties during the review process. The proposed Student Enrichment Center was found to comply with the General Plan and all applicable ordinances, standards, and policies. Staff's analysis is discussed in more detail in the attached Planning Commission Staff Report dated March 15, 2017. Fiscal Analysis All required improvements needed to serve this project would be funded and/or constructed by the developer. Next Steps City Council's action on this item is final. Environmental Evaluation (CEQA) The project is exempt from the requirements of the California Environmental Quality Act (CEQA) per section 15332 (In-fill Development Projects). The development of a 4,714 square foot building for use by a school is below the screening threshold of 900 MTC02e, and is therefore not subject to the Climate Action Plan. The Planning Commission finds that the project, as conditioned herein, is in conformance with the Elements of the City's General Plan, based on the facts set forth in the staff report dated February 15, 2017 including, but not limited to the following: A. B. Goal 2-G.29: Maintain and enhance the Village as a center for residents and visitors with commercial, residential, dining, civic, cultural, and entertainment activities. Policy 2-P.72: Enhance the walkability and pedestrian orientation of the Village, including along Carlsbad Village Drive, to enhance the small, beach town atmosphere and improve access to and utilization of transit. The proposed project is consistent with the goals/policies for the Village because it enhances an existing educational institution in an accepted location within the Village. The project reinforces the pedestrian orientation desired for the downtown area because the Student Enrichment Center's and school's proximity to the Village provides the students and its employees an opportunity to walk to shopping, recreation, and mass transit functions. The Army and Navy Academy assists in encouraging complementary uses in the Village and adding diversity to the Village population that helps create and/or enhance a more lively and interesting social environment. Policy 7-P.28: Support efforts by the Carlsbad Unified School District, other school districts that serve Carlsbad residents, and childcare service providers to establish, maintain, and improve educational facilities. The proposed building will provide the Army and Navy Academy students an additional place to meet in groups and have exhibition space for special projects and the academy's achievements. It will also provide a gathering space for alumni during special events held on the athletic field. That the project is consistent with the Village Review Zone and the Village Master Plan and Design Manual in that the project as designed is consistent with the development standards for Land Use District 9, the Village Design Guidelines, Army and Navy Academy Master Site Plan and other applicable regulations set forth in the Village Master Plan and Design Manual as discussed in the staff report dated February 15, 2017. 21 Coastal Development Permit CDP 16-28 22 23 24 25 26 27 28 3.That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that the development consists of a new student enrichment center, and the development is consistent with the Carlsbad Village Master Plan, which serves as the Certified Local Coastal Program for the City of Carlsbad Village Segment of the California Coastal Zone. The proposed building is compatible with the existing athletic facility and the surrounding development of single-family residences and a mixed-use development. The proposed development will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The project site is not located in an area of known geologic instability or flood hazard. The site is located in close proximity to the coast, but no public opportunities for coastal shoreline access are available from the subject site. The site is not suited for water-oriented recreation activities. The proposal is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act in that the site is not located adjacent to the shore. Therefore, the development will not interfere with the public's right to physical access to the ocean and the site is not suited for water-oriented activities. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, BMP Design Manual and Jurisdictional Runoff Management Program (JRMP} to avoid increased urban runoff, pollutants, and soil erosion. No steep slopes or native vegetation is located on the subject property and the site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods, or liquefaction. California Environmental Quality Act 6. General 7. 8. 9. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for preparation of environmental documents pursuant to Section 15332 of the State CEQA Guidelines as an infill development project. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the State CEQA Guidelines do not apply to this project. The project is consistent with the City-Wide Facilities and Improvements Plan, the Local Facilities Management Plan for Zone 1 and all City public policies and ordinances. The project includes elements or has been conditioned to construct or provide funding to ensure that all facilities and improvements regarding: sewer collection and treatment; water; drainage; circulation; fire; schools; parks and other recreational facilities; libraries; government administrative facilities; and open space, related to the project will be installed to serve new development prior to or concurrent with need. Specifically, A. B. C. The project has been conditioned to provide proof from the Carlsbad Unified School District that the project has satisfied its obligation for school facilities. The Public Facility fee is required to be paid by Council Policy No. 17 and will be collected prior to the issuance of building permit. The Local Facilities Management fee for Zone 1 is required by Carlsbad Municipal Code Section 21.90.050 and will be collected prior to issuance of building permit. That the project is consistent with the City's Landscape Manual and Water Efficient Landscape Ordinance (Carlsbad Municipal Code Chapter 18.50). The Planning Commission has reviewed each of the exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree of the exaction is in rough proportionality to the impact caused by the project. PC RESO NO. 7231 -3-Item #7 April 25, 2017 Page 8 of 61 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Conditions: General NOTE: Unless otherwise specified herein, all conditions below shall be satisfied prior to grading permit, or building permit, whichever comes first; or pursuant to an approved construction schedule at the discretion of the appropriate division manager or official. 1.Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Major Review Permit/Coastal Development Permit, (b)City's approval or issuance of any permit or action, whether discretionary or nondiscretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. This obligation survives until all legal proceedings have been concluded and continues even if the City's approval is not validated. 2.If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Major Review Permit/Coastal Development Permit. 3. 4. 5. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Major Review Permit/Coastal Development Permit documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development, different from this approval, shall require an amendment to this approval. Developer shall comply with all applicable provisions of federal, state, and local laws and regulations in effect at the time of building permit issuance. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged, this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid, this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 6.Prior to submittal of the building plans, improvement plans, or grading plans, whichever occurs 26 first, developer shall submit to the City Planner, a 24" x 36" copy of the Site Plan, conceptual grading plan and preliminary utility plan reflecting the conditions approved by the final decision 27 making body. The copy shall be submitted to the city planner, reviewed and, if found acceptable, signed by the city's project planner and project engineer. If no changes were required, the28 approved exhibits shall fulfill this condition. Prior to the issuance of a building permit, the Developer shall provide proof to the Building Division from the Carlsbad Unified School District that this project has satisfied its obligation to provide school facilities. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 1 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. This approval shall become null and void if building permits are not issued for this project within 24 months from the date of approval by the City Council. Prior to the issuance of the building permit, Developer shall submit to the City a Notice of Restriction executed by the owner of the real property to be developed. Said notice is to be filed in the office of the County Recorder, subject to the satisfaction of the City Planner, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Major Review Permit/Coastal Development Permit by Resolution No. 7231 on the property. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The City Planner has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. Building permits will not be issued for this project unless the local agency providing water and sewer services to the project provides written certification to the City that adequate water service and sewer facilities, respectively, are available to the project at the time of the application for the building permit, and that water and sewer capacity and facilities will continue to be available until the time of occupancy. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD #1 special tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. If the taxes/fees are not paid, this approval will not be consistent with the General Plan and shall become void. Developer shall submit and obtain City Planner approval of a Final Landscape and Irrigation Plan showing conformance with the approved Preliminary Landscape Plan and the City's Landscape Manual. Developer shall construct and install all landscaping as shown on the approved Final Plans, and maintain all landscaping in a healthy and thriving condition, free from weeds, trash, and debris. The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the landscape plan check process on file in the Planning Division and accompanied by the project's building, improvement, and grading plans. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Director of the Community and Economic Department. When so required, the Developer shall submit and obtain approval of the Fire Chief and the City Planner of an Outdoor Storage Plan, and thereafter comply with the approved plan. Engineering: NOTE: Unless otherwise specified herein, all conditions below shall be satisfied prior to grading permit, or building permit, whichever comes first; or pursuant to an approved construction schedule at the discretion of the appropriate division manager or official. 7 General 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 17. 18. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, developer shall apply for and obtain approval from, the city engineer for the proposed haul route. This project is approved upon the express condition that building permits will not be issued for the development of the subject property, unless the district engineer has determined that adequate water and sewer facilities are available at the time of permit issuance and will continue to be available until time of occupancy. Fees/ Agreements 19.Developer shall cause property owner to execute and submit to the city engineer for recordation the city's standard form Drainage Hold Harmless Agreement. Grading 20. 21. Prior to the issuance of a precise grading permit or a building permit, developer shall cause the property owner to complete all work shown on DWG 476-5 and 476-SA. Construction revisions to the approved drawings, if needed, shall be submitted for review and approval by the city engineer. As-built drawings shall be submitted to and approved by Construction Management and Inspection. Supplemental grading plans are required for precise grading associated with this project. Developer shall prepare, and submit for approval, grading plans for the precise grading as shown on the site plan all subject to city engineer approval. Storm Water Quality 22.Developer shall comply with the city's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution control practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable. Developer shall notify prospective owners and tenants of the above requirements. 23.Developer shall complete and submit to the city engineer a Determination of Project's SWPPP Tier28 Level and Construction Threat Level Form pursuant to,City Engineering Standards. Utilities 27. 28. 29. 30. also submit the appropriate Tier level Storm Water Compliance form and appropriate Tier level Storm Water Pollution Prevention Plan (SWPPP) to the satisfaction of the city engineer. Developer shall pay all applicable SWPPP plan review and inspection fees per the city's latest fee schedule. Should this project meet 'Priority Development Project' criteria, Developer shall prepare and process a Storm Water Quality Management Plan (SWQMP), subject to city engineer approval, to comply with the Carlsbad BMP Design Manual latest version. The final SWQMP required by this condition shall be reviewed and approved by the city engineer with final grading plans. Developer shall pay all applicable SWQMP plan review and inspection fees per the city's latest fee schedule. Developer is responsible to ensure that all final design plans (grading plans, improvement plans, landscape plans, building plans, etc.) incorporate all source control, site design, pollutant control BMP and applicable hydromodification measures. Developer shall complete the City of Carlsbad Standard Stormwater Requirement Checklist Form. Developer is responsible to ensure that all final design plans, grading plans, and building plans incorporate applicable best management practices (BMPs). These BMPs include site design, source control and Low Impact Design (LID) measures including, but not limited to, minimizing the use of impervious area (paving), routing run-off from impervious area to pervious/landscape areas, preventing illicit discharges into the storm drain and adding storm drain stenciling or signage all to the satisfaction of the city engineer. Developer shall meet with the fire marshal to determine fire protection measures (fire flows, fire hydrant locations, building sprinklers) required to serve the project. Fire hydrants, if proposed, shall be considered public improvements and shall be served by public water mains to the satisfaction of the district engineer. The developer shall agree to design landscape and irrigation plans utilizing recycled water as a source and prepare and submit a colored recycled water use map to the Planning Department for processing and approval by the district engineer. Developer shall install potable water and/or recycled water services and meters at locations approved by the district engineer. The locations of said services shall be reflected on public improvement plans. The developer shall agree to install sewer laterals and clean-outs at locations approved by the city engineer. The locations of sewer laterals shall be reflected on public improvement plans. Code Reminders The project is subject to all applicable provisions of local ordinances, including but not limited to the 25 following: 26 27 28 31.Approval of this request shall not excuse compliance with all applicable sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance, except as otherwise specifically provided herein. II.PROJECT DESCRIPTION AND BACKGROUND In 2008, the Housing and Redevelopment Commission approved a Master Site Plan for the Army and Navy Academy that is to be used as a guide for future development. The Master Site Plan is not a Master Plan per the municipal code, and does not contain its own development standards. It is conceptual in nature and indicates the general location, amount and type of development, potential access points, circulation and the proposed development scheme for the Army and Navy Academy. The detailed design of individual buildings is to be reviewed at the time of submittal to ensure conformance with development standards and the design criteria of the Master Site Plan. The applicant is proposing to construct a Student Enrichment Center on a portion of the existing athletic complex site. The building is situated at the south end of a 4.71 acre lot located on the east side of Carlsbad Boulevard, north of Beech Avenue and west of the railroad tracks. The site is developed with the athletic complex for the Army and Navy Academy. The north end of the site includes a parking lot and the Duffield Complex which consists of a gymnasium, a weight room, a training room, locker rooms, a wrestling room, meeting space and offices. The athletic field occupies a majority of the site and is located in the center with the bleachers and press box on the westerly side of the property. The proposed student enrichment center is at the southerly side of the property, just north of two existing parking lots. The applicant is proposing to construct a two-story, 4,714 square foot building to be used for student meeting rooms and exhibition space. The space can also be used for an alumni gathering place during events on the athletic field. The entrance to the building is located on the west side, where the lobby leads to an exhibit space. The Army and Navy Academy Master Site Plan calls for use of the Spanish Colonial Revival architecture style unified by the use of arches, courtyards, form as mass, plain wall surfaces and tile roofs. The proposed Student Enrichment Center uses white stucco as the building material, a tile roof, an arched element over the entrance, and recessed windows. Table 1 below includes the General Plan designations, zoning and current land uses of the project site and surrounding properties. B.Village Review Zone (CMC Chapter 21.35), District 9 (Village Master Plan and Design Manual) The proposed project meets the goals that have been identified in the Village Master Plan and Design Manual by enhancing an existing educational use with the new construction of a school facility. A private secondary school (and accessory uses) is considered a provisional use in District 9. Provisional uses are those which are permitted subject to discretionary approval. They are approved based upon findings that the use is consistent with the Village vision and goals under specific conditions imposed by the permit. Uses in this category require special scrutiny concerning location, size, and anticipated impact on adjacent uses. For the purposes of land use policy within the Village, the term "provisional use" replaces the term "conditional use" which is used within the Carlsbad Municipal Code. In 1995, with approval of the Village Master Plan and Design Manual, a long range master plan for the Army and Navy Academy was required to be approved prior to the issuance of any permits for improvements and additions to existing facilities. As mentioned previously, a Master Site Plan was approved in 2008. The Student Enrichment Center will not result in the enrollment of additional students. It will serve existing students and alumni who would already be attending events held at the athletic complex. The Student Enrichment Center is consistent with the Master Site Plan, therefore, the proposed project is consistent with zoning requirements of District 9 of the Village Review Zone. The specific development standards for new development within Land Use District 9 are shown in Table 3 below. A modification to the parking requirement was approved as part of the Master Site Plan due to the specialized nature of the site. The parking requirement for the site at complete build out is 171 parking spaces and is based on a maximum school enrollment of 440 students and 116 employees. The site of the proposed Student Enrichment Center is located in Planning Area E of the Master Site Plan, which provides 63 parking spaces between the north and south lots. Additional parking is required when a new building will generate new students or the need for additional staff members. As noted previously, the proposed building will not do either of the aforementioned, therefore no additional parking is required. C.Coastal Development Regulations for the Village Segment of the Local Coastal Program (C.M.C. Chapter 21.81 and Village Master Plan and Design Manual) The site for the proposed project is located within the Village Segment of the Coastal Zone. Consistency with the Village Local Coastal Program is required for this project. The Village Master Plan and Design Manual function as the Local Coastal Program for the Village area. Staff finds the proposed project to be consistent with the Village segment of the Local Coastal Program in that views of the coastline, as seen from public lands or the public right-of-way, will not be obstructed by the proposed project, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The project site is not located in an area of known geologic instability or flood hazard. Although the site is located in close proximity to the coast, no public opportunities for coastal shoreline access are available from the public site. Furthermore, the site is also not suited for water-oriented recreation activities. D.Army and Navy Academy Master Site Plan The purpose of the Army and Navy Academy Master Site Plan is to provide a guide for future development of the private boarding school campus. The Master Site Plan is conceptual and indicates the general location, amount and type of development, potential access points, circulation and the development scheme for the school. The Academy has developed the following goals to guide the development of the campus over time: 1.Provide facilities to help realize the Academy's mission. 2.All planning should build and sustain upon the Academy's reputation for excellence in the civilian/military community. 3.The Academy campus should be designed so that administration, educational, residential, support facilities, and other activities are within easy walking distance of each other. 4.The character of the Academy should be consistent with the surrounding community. 5.All planning should include design characteristics that will attract people to the Academy. 6.The Academy should help conserve resources and minimize waste. The proposed Student Enrichment Center is located within close walking distance to other facilities of the campus, supporting goal number three. The Spanish Colonial Revival architectural style continues the existing theme and respects the existing buildings on campus and in the surrounding community. Furthermore, the exhibition space provided on the ground floor will assist in attracting new students and give the students and alumni a space to display the academy's achievements. The Student Enrichment Center is located in Planning Area E of the Master Site Plan, which calls for three separate phases (out of 20) of development. Phase 1 included the removal of storage buildings and construction of a south parking lot, Phase 6 consisted of the demolition of the existing athletic building and construction of a new athletic building and north parking lot, and Phase 14 involved the construction of a maintenance building and second south parking lot. It has been acknowledged that development of the campus may not occur in the exact order of the phases, but rather when funding becomes available. However, for safety and logistical reasons of maintenance carts/vehicles continuously needing to cross Carlsbad Boulevard, it works best for the academy to keep maintenance facilities closer to the main campus. The proposed project is consistent with the vision and phasing for Planning Area E of the Army and Navy Academy Master Site Plan. E.Growth Management Regulations The proposed project is located within Local Facilities Management Zone 1 in the northwest quadrant of the city. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in Table 4 below. He stated that shared private public parking structures should be thought of as well and suggests that parking spaces be allowed to be purchased for residential developments. Robert Wilkinson, Suite I, 2911 State Street, commented that Imagine Carlsbad is looking to the Planning Commission for leadership in planning for the village and stated that mixed use projects in the core area of the village are encouraged and should propose a balanced mix of uses. Mr. Wilkinson concluded stating that commercial spaces should have commercial grade ceiling height and that automobile lifts are appropriate for transit oriented developments.
