Staff recommends that residential, commercial and multi-family recycling and trash collection
rates may be adjusted and adopted annually through FY 2021-22 as part of the city's budget
process, consistent with prior practice. This date coincides with expiration of the Coast Waste
Management, Inc. contract, set for June 30, 2022. The term of the current contract is 10 years
with an optional three-year extension. Exhibit 2 provides the rates that, if approved, will go into
effect on July 1, 2017.
Fiscal Analysis
The franchise fee paid to the city by Coast Waste Management, Inc. is 7.5 percent of revenues
collected, and is deposited into the city's General Fund to help fund general governmental
services. Assembly Bill 939 (AB 939) allows the city to collect revenue to fund the recycling and
trash program. The City of Carlsbad collects an AB 939 fee of 2 percent which is allocated to the
Solid Waste Fund. This fee helps fund the recycling and trash program. Though the percentages
will remain the same, increased recycling and trash fees will result in Increased revenues
collected to both the General Fund and the Solid Waste Fund.
The new rates are anticipated to have an annual increase in revenue of approximately $20,000
to the General Fund from franchise fees, and approximately $5,000 to the Solid Waste Fund from
the AB 939 fee.
The table below represents a comparison to the rates for the most common usage within each
of the primary service types:

If approved, the proposed rates would be effective July 1, 2017.
Environmental Evaluation (CEQA)
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15273-CEQA does not apply to the establishment, modification, structuring,
restructuring or approval of rates, tolls, fare or other charges by public agencies.
Public Notification
California Constitution, Article XIIID, Section 6, states that local governments must hold a Public
Hearing and notify property owners and customers by mail at least 45 days in advance of Public

Hearings related to property-related new or increased fees and charges, such as recycling and
trash services. At the Public Hearing, if it is determined that a majority of property owners have
submitted a formal protest, the proposed fee change must be rejected. This is a requirement of
Proposition 218, which was passed by California voters in 1~96 to limit methods by which local
governments can create or increase taxes, fees and charges without taxpayer consent. Any
person interested in objecting to the increases may file a signed written protest with the city
clerk. The written protest must contain the address of service, the rate change being protested
and be received prior to the close of the Public Hearing. While protestors may appear at the
Public Hearing and be heard on the matter, only written protests are counted for the purpose of
determining whether there has been a majority protest.
Staff took the following actions at least 45 days prior to the June 13, 2017, Public Hearing:
• Notified affected customers and property owners by mail of the Public Hearing.
• The notice (Exhibit 3) provided information relating to the Public Hearing.
• The notice provided information regarding the proposed rates.
• In addition, information about the Public Hea ring and proposed rates was posted on the
city's website at www.carlsbadca.gov.
Information regarding public notifications of this item such as mailings, Public Hearing notices
posted in the newspaper and on the city website will be available in the office of the city clerk.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING INCREASES TO RECYCLING AND TRASH SERVICE
RATES EFFECTIVE JULY 1, 2017.
EXHIBIT 1
WHEREAS, the City of Carlsbad is proposing an increase in recycling and trash collection rates,
to be effective July 1, 2017; and
WHEREAS, the California Constitution Article XIIID, Section 6(a)(2) states that local governments
must hold a Majority Protest Public Hearing and notify customers not less than 45 days in advance of
that public hearing regarding increases in recycling and trash collection rates; and
WHEREAS, the California Constitution Article XIIID, Section 6(a)(2) states that if a majority of
customers submit a written protest prior to the close of the public hearing, then the rate increase shall
not be imposed; and
WHEREAS, the written protests received represented less than a majority of affected
customers; and
WHEREAS, Coast Waste Management, Inc. is the exclusive provider of residential and
commercial recycling and trash collection services in the City of Carlsbad under a contract approved by
City Council in 2012 by adopting Resolution No. 2012-033; and
WHEREAS, the contract with Coast Waste Management, Inc. provides for adjustments to
recycling and trash collection rates to be made as part of the city's budget adoption process for five
years, through fiscal year 2016-17, as long as the rate increases met certain requirements; and
WHEREAS, on April 26, 2017, Carlsbad residents, businesses and property owners were notified
by mail of the proposed increase in recycling and trash collection rates, thereby complying with the
advance notice requirement of 45 days.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the City Council of the City of Carlsbad finds that this action is statutorily exempt
from the California Environmental Quality Act under Public Resources Code section
21080(b)(8) because the proposed rate increases are for the purpose of meeting
operating expenses for residential and commercial solid waste services under the
contract with Coast Waste Management, Inc.
3. That the City Council ofthe City of Carlsbad, California, approves the proposed increases
to recycling and trash collection rates, effective July 1, 2017.
4. That recycling and trash collection rates may be adjusted and adopted annually through
fiscal year 2021-22 as part of the master fee schedule during the city's budget adoption
process.

About Recycling and Trash services and rates
The City of Carlsbad provides recycling and trash solid waste services to its residents and businesses as outlined in Section 6.08
of the Carlsbad Municipal Code. These services are provided through a contract with Coast Waste Management. The contract
was approved by the City Council in February 2012. This contract established residential, commercial and multi-family rates for
various recycling and trash services, effective July 1, 2012. The residential solid waste services include the weekly collection of
trash, recyclables and green waste. The commercial solid waste services include collection of trash, recyclables and green waste
as frequently as scheduled by the customer, but not less than once per week. Coast Waste Management provides and maintains
the recycling and trash carts and bins.
The contract provides a mechanism for increasing rates utilizing the annual increase in the following items:
1. The annual change in the Consumer Price Index, or •cp1; All Urban Customers, San Diego All Items;
2. Change in the monthly amount paid by the contractor for the facility use; and
3. Increases on the disposal rates at the Palomar Transfer Station in Carlsbad, CA.
Coast Waste Management guarantees that throughout the term of the contract that the contractor's net rate for Single-Family
residential Cart Collection Service (for a 64 or 96 gallon cart) and Contractor's net rate for Multi-Family and Commercial Bin
Collection Service (for a three-yard bin picked up once per week) will be in the lowest third of net rates being charged for similar
services in all cities in San Diego County using a franchised collection system.
Rate increases are being proposed, effective July 1, 2017.
How are Recycling and Trash rates calculated?
Under the terms of the contract, rate adjustments during the next five years, through fiscal year 2021-22, will be made as follows:
A. Service Component · The service component of each rate is adjusted annually based on the annual change in the Consumer
Price Index · All Urban Consumers, San Diego All Items for the prior year, weighted at 90 percent.
B. Occupancy Component-The Occupancy Component of each rate is adjusted based on the change in the monthly amount
paid by the Contractor for facility use associated with this Contract.
C. Disposal Component-The Disposal Component of each rate shall be adjusted to reflect the change in the applicable tip fee at
the Palomar Transfer Station, as approved by the city.

About trash rates and the proposed increases
The current monthly trash rate for all single-family customers is $ 21.04. The proposed rate will vary depending on the size of
the trash container selected by the customer. Residents may either select a 64 or 96 gallon trash container at a proposed rate of
$21.04 per month, or a 35 gallon trash container at the proposed rate of $19.07 per month. The rate is only affected by the size of
the trash container.
The rates for multi-family and commercial customers will depend on the size of the bin, the type of material collected and the
frequency of collection. The rates will increase between 1.2 percent and 1.7 percent from the current rates.

Moreover, once again the Office of the City Attorney of Carlsbad is significantly misrepresenting our specific detailed
requests for basic divisional financial statement information that should be produced readily without undue delays.
These continuing delays will result in significant and inappropriate undue hardship to the public's interests considering the
circumstances of our request for these public records, and the related proposed public contract circumstances
involved. Coast Waste Management's apparent representation that basic divisional financial statement information does
not exist is absurd and insulting to the intelligence of every public person. Furthermore, we have never asked Coast
Waste Management to create any documents to satisfy our public records request. We have only suggested the
requested documents could be easily reproduced to satisfy our continuing unfulfilled public request without further
delay. Additionally, City personnel have unnecessarily hindered the fulfillment of our public records request from the very
beginning, without due cause, as summarized and substantiated below.
As the City's management should know, all reports and remittances related to the City's contract with Coast Waste
Management must be regularly reconciled to the final basic Coast Waste Management general ledger and
related financial statement information to ensure contract compliance, especially considering the amount of the related
franchise fees involved.
We do have an additional question related to the recycling and trash contract, as well. Regarding Ms. Stroud's statement
noting the existence of "quarterly reports from Coast Waste Management that list their total cash receipts.", does
the City audit or otherwise verify this information at least annually in connection with its contract with Coast Waste
Management to substantiate and verify that its franchise fee remittances from Coast Waste Management are accurate
and proper?
If so. we hereby request Ms. McMinn to please add to our continuing public records request copies of any and all audit or
other verification documentation relating to the City's contract with Coast Waste Management for the past eight(8)
quarterly reporting periods.

It is not possible to believe Coast Waste Management represented to the City Attorney's Office that "Coast Waste
Management has informed me that the records you have requested do not exist.", or that anyone in the Office of
the City Attorney believes this statement. Do you believe this statement. We hope not. If this statement is true, the
public is probably being significantly overcharged in Carlsbad for its trash and recycling services.
The City of Carlsbad should be protecting its public ratepayers, demanding the requested basic financial information from
Coast Waste Management, and not protecting the best interests of Coast Waste Management (at the expense of
Carlsbad ratepayers paying the City's personnel elected and hired to protect and serve their best interests).
As previously communicated, we are simply requesting basic financial information detailing all revenues and expenses for
Coast Waste Management's separate recycling and trash divisions. The City knows this. Coast Waste Management
knows this. Simple. Moreover, the City of Carlsbad has been intentionally misrepresenting (and overly complicating) our
specific detailed r~quests for information that should be produced readily without undue delay. The record speaks for
itself.
Coast Waste Management has detailed internal and external financial reporting requirements, tax reporting requirements
and responsibilities, and modern computer management information systems capable of producing the requested
information. However, Coast Waste Management represents to the Carlsbad Office of the City Attorney that "Coast Waste
Management has informed me that the records you have requested do not exist."? Print the standard divisional financial
reports, then they will automatically appear and exist. This situation is now extremely concerning. What is the City and
Coast Waste Management trying to hide so hard?
Coast Waste Management is capable of generating a contract with hundreds of detailed cost centers purporting to support
its hundreds of proposed rate increases, and no actual basic underlying supporting financial information exists? What is
going on here?
Finally, while continuing to await the information in our unfulfilled public records request, we would appreciate the
following information being added to our request: "We have quarterly reports from Coast Waste Management that
list their total cash receipts. We also have a letter report confirming that the rate charged to our customers is
in the lower third in San Diego County per the terms of our contract, and some documentation from Coast
Waste Management to support the proposed rate increase.".
Regarding the preceding information, please note that everyone knows how obese all waste management and recycling
businesses with long-term city contracts have become. Therefore, an internally prepared letter confirming trash and
recycling rates charged to Carlsbad's residents are low compared to residents of other San Diego cities is like a 600 lb.
patient at an obesity clinic bragging that they are the lightest patient in treatment. It is meaningless and disheartening.
Full disclosure of public financial information, short-term contracts subject to re-bid every two years; and a program of
continuing internal cost cutting is part of the answer to prevent unnecessary and abusive public utility and governmental

Thank you for your preliminary response to our public records request of May 24. 2017. However, as you are aware, the
City's response to our request for timely public records was incomplete.
Moreover, we do not believe our request requires "consultation with another agency having substantial interest in the
request, or among two or more components of the local agency with substantial interest in the request", resulting
in "unusual circumstances."
Our information request is concise and basic, includes only standard financial reporting information that should be readily
available in the City's Public Works Department, or from other City departments, and as already communicated, is the
most important basic financial information necessary for anyone to properly consider the necessity for the proposed
recycling and trash fee increases (including City personnel).
The City's Public Works Department, and other City departments, must already have the requested information to properly
consider and propose any unsupported recycling and trash fee increases to the public. To believe otherwise is
inconceivable considering the City's fiduciary responsibilities to the public.
Furthermore, the specific reasons for the delay were not specified, our request does not meet the definition of "unusual
circumstance" as defined in the government codes. The unwarranted delays being imposed by the City's offices also
results in extreme hardship to the public considering the City's planned public hearing on June 13, 2017, to approve the
proposed unsupported recycling and trash fee increases.
Therefore, we formally protest the City's delays fulfilling our complete public records request, and demand the omitted
information in our request be provided as soon as possible, restated once again as follows:
1) Detailed Stand-Alone Carlsbad Recycling Program Financial Information (e.g. Income Statement,
Statement of Cash Flows, Supporting Notes, etc.) for the last complete fiscal year (clarification note: the
detailed financial information desired is stand-alone financial information for all of Carlsbad's Recycling
Program activities that is stated separately from (and not commingled with) the rmancial information of
the City's Trash Program), and
2) Detailed Stand-Alone Carlsbad Trash Program Financial Information (e.g. Income Statement,

Please confirm the receipt of our Request for Public Records submitted earlier online using the City's link you previously
emailed below (please confirm receipt by return email). We did not receive any kind of "Send Confirmation" after pressing
the "Submit By Email" button. We tried it several times before giving up. The information requested was as follows:
1) Detailed Stand-Alone Carlsbad Recycling Program Financial Information (e.g. Income Statement, Statement
of Cash Flows, Supporting Notes, etc.) for the last complete fiscal year (clarification note: the detailed financial
information desired is stand-alone financial information for all of Carlsbad's Recycling Program activities that
is stated separately from (and not commingled with) the financial information of the City's Trash Program), and
2) Detailed Stand-Alone Carlsbad Trash Program Financial Information (e.g. Income Statement, Statement of

To All Whom It May Concern:
I write in opposition to the proposed 1.1% hike in the trash collection fee that would raise
my monthly fee from $20.82 to $21.04 at the residential address listed above (and below my
name) in the letter heading. While the increase may seem minuscule, it appears the city
contract with Waste Management will cause such an increase to occur over the each of the
next five years.
My reasons are as follows:
1) I am on a fixed retirement income where annual COLA increases don't come close to
mitigating increases in any of my utilities.
2) The San Diego Water Authority wants to raise rates 3.7% by 2018.
This will adversely affect Carlsbad's water rates with a hike.
3) Governor Moonbeam rammed an outrageous fuel and vehicle registration tax through
the corrupt state legislature without a vote of the people-a cost which will hurt us
retired seniors the most.
4) SDG&E raised its monthly rate 2.5 cents per kWh or 10.6% on March 1, 2017.
5) Carlsbad Water District raised my monthly Usage and Delivery fees $2.23 or 3%.
6) AT&T raised my landline phone bill $1.53 or 3.66% on or about February 1, 2017.
7) DirecTV raised its monthly fees $6.36 or 6.88%. Have to have it. Can't use an antenna
because the height would not withstand winter storm winds. Would need high antenna
because of surrounding buildings.
