Recommended Action
That the City Council hold a public hearing, and adopt a Resolution accepting the cost
assessments for abatement and directing the City Clerk to file a certified copy of the Resolution
with the San Diego County Assessor on or before August 10, 2017.
Executive Summary
At the direction of the Fire Department, the city's weed abatement contractor abated hazards
on eleven (11) parcels, three (3) of which are undivided interest. Abatement was achieved
primarily by means of mowing and hand labor. The contractor's fees per abated parcel range
from $128 to $1,692 with an average of $728.51. Five (5) parcels incurred abatement charges in
excess of $500. Each parcel will be charged for the actual work performed by the city's
contractor, plus an administrative fee of $263. The total amount for private lot weed abatement
is $10,906.66. This amount, broken out by parcel, will be forwarded to the County Assessor for
inclusion on each property tax bill.
Discussion
At the March 28, 2017 City Council meeting, 217 parcels were declared public nuisances due to
the presence of hazardous combustible material upon them, or the likelihood of that condition
existing during the drier months. The Fire Department mailed notices to the property owners on
March 29, 2017 explaining the City Council's action, and informing them of the date of the public
hearing.
At the April 25, 2017 meeting, City Council adopted Resolution 2017-069 directing the Fire Chief
to abate the declared nuisances. Property owners were notified that the nuisances existing after
May 15, 2017 are subject to abatement by the City of Carlsbad crews and the cost of the
abatement will appear on their property tax bill. The total cost for private lot weed abatement,
broken down by APN and address, is $10,906.66, and can be found in Exhibit 2. This includes
$8,013.66 in contract charges and $2,893 in administrative fees. The contract charge includes
the labor (mowing and hand work) performed by the contractor, Habitat Restoration Sciences.
The administrative fee covers contract administration, public notices, and other administrative
tasks.

Fiscal Analysis
All costs associated with the nuisance abatement on !he privately owned parcels are recoverable,
through a special assessment on each property owner's property tax bill. The weed abatement
cost assessment (Exhibit 2) is broken out by parcel and made up of a contract charge and an
administrative fee. The total amount to be submitted to the County of San Diego for inclusion
on property tax bills is $10,906.66, Exhibit 4.
Next Steps
Adopt a Resolution accepting the cost assessments for abatement and directing the City Clerk to
file a certified copy of the Resolution with the San Diego County Assessor on or before August
10, 2017.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change in
the environment, or a reasonably foreseeable indirect physical change in the environment, and
therefore does not require further environmental review.

posted in the newspaper and on the City website are available in the Office of the City Clerk.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE COST ASSESSMENTS FOR ABATEMENT AND
DIRECTING THE CITY CLERK TO FILE A CERTIFIED COPY OF THE RESOLUTION
WITH THE SAN DIEGO COUNTY ASSESSOR.
EXHIBIT 1
WHEREAS, the City Council of the City of Carlsbad, California has determined that on March 28,
2017, Resolution No. 2017-048 pursuant to Government Code Section 39501 through Sections 39588
declaring weeds, rubbish, and refuse on the real property described therein to be a public nuisance;
and
WHEREAS, pursuant to Resolution No. 2017-048, a public hearing was held on April 25, 2017
by the City Council, and thereafter City Council adopted Resolution No. 2017-069, directing the Fire
Chief to abate the nuisance by removal of the weeds, rubbish, and refuse on the real property described
in said resolution; and
WHEREAS, California State Government Code Section 39560, et. Seq., requires that a report of
the cost of such abatement be submitted to the City Council for consideration and confirmation
following a public hearing, and the Fire Chief has provided and attached an accounting, and has
submitted the accounting to the City Council for confirmation; and
WHEREAS, said accounting is attached hereto as Attachment A and will be considered for
confirmation by the City Council, at which time all protests and objections will be heard in respect to
any matter relating to said abatement work; and
WHEREAS, all persons desiring to be heard have been heard by the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the abatement work, the report submitted to the City Council, and the postings of
the Notice of Time and Hearing on said report were duly and regularly performed in the
manner and time required by law.
3. That all protests and objections, other than those heretofore allowed and deleted from
said report, if any, were and are hereby overruled and denied.
4. That said report, Attachment Bis attached hereto, and is hereby confirmed, and each of
the amounts set forth herein are hereby assessed against the parcel of real property

shown with said sum and shall constitute a special assessment and a lien against such
parcel of land.
5. The City Clerk is hereby directed to forward a certified copy of this Resolution, together
with a copy of said report to the Office of the San Diego Assessor on or before August
10, 2017.

HAZARD REDUCTION INFORMATION
I. WEED ABATEMENT STANDARDS
Items A through F are the basic standards employed by the City Of Carlsbad Fire Department
when abating hazardous conditions. Properties cleaned by owners or private contractors will be
evaluated by means of the following standards:
A. Grass, weeds, trash, and other rubbish shall be removed from vacant lots, yards,
courtyards, parkways and other locations as specified by the Fire Department.
B. Native brush and chaparral that have been cleared or thinned previously in the past five
years shall be modified in the same manner for a minimum distance of 60 feet measured
from the closest combustible structure, discounting fences. Fuel modification shall
conform to the standard requirements. Further information may be obtained from the
Carlsbad Fire Department Fire Prevention Division at (760) 602-4665.
C. Native brush and chaparral that have not been previously cleared or modified in the past
five years must be assessed on a case-by-case basis to determine whether the removal
will conflict with the Federal Endangered Species Act of 1993. Questions should be
forwarded to Fire Prevention Division and to the Fish and Wildlife Service (760) 431-9440.
D. Fuel breaks of 60 feet or more that have been previously required in the past five years
shall be maintained by mowing. New fuel breaks may be required on a case-by-case
basis and owners of affected properties will be notified by mail before abatement.
E. Abatement shall be accomplished by power mowing to three inches in height. In some
areas, such as fuel breaks or problem areas involving hazards to mowing equipment,
discing may be approved. Regardless of method used, standing weeds remaining around
perimeters of lots after mowing or discing shall be cut to three inches in height. Cut
vegetation shall be reduced on site or disposed of in an approved method.
F. Open burning is prohibited.
II. SPECIAL CONDITIONS
A. Eucalyptus trees (within 60 feet of structures): Remove all heavy accumulation of leaves
to a maximum depth of four inches. Remove fallen limbs, litter, debris and loose bark
from the ground. Trim low hanging limbs and foliage to a height of six feet. Existing
native vegetation must be thinned by 50 percent. Grasses must be mowed or trimmed to
3 inches.

B. Inactive groves (citrus, avocado, etc.): Remove all dead growth, disc the property and
maintain free of hazard.
C. Palm trees on vacant lots (within 60 feet of structures) shall have dead fronds removed
as necessary. Should the property be abated Palm trees will be removed.
D. Trimmings from trees and other vegetation may be reduced by chipping to mulch and
may be evenly dispersed on the site to a level of four inches.
Ill. STRUCTURES IN BRUSH COVERED AREAS
A. All chimneys, stovepipe or flue outlets are required to be equipped with an approved spark
arrester.
B. Remove that portion of any tree which extends within ten feet of the outlet of any chimney,
stovepipe or roof line.
C. Maintain any tree adjacent to any building, free of dead or dying wood.
D. Trim low hanging foliage of trees located within 60 feet of structures to a height of six
feet above ground level.
IV. HOMEOWNER ASSOCIATIONS
A. Homeowners Associations that have Fuel Modification Zones, must maintain these
areas in compliance with these standards.
B. Necessary maintenance should occur on both a regular schedule and as needed.
C. Should a Drought Alert occur, that limits water to Fuel Modification Zones, it will be critical
that these areas are monitored. Accumulations of dead material will require removal.
V. COST OF CLEANING BY THE CITY OF CARLSBAD
A. The cost of cleaning parcels by the City is based upon a square foot unit price for discing,
mowing, and handwork, and by the cubic yard for mulching or chipping.
B. The cost of rubbish removal is based upon a flat rate per ton, including loading, hauling
and disposal.
C. The charge for cleaning by the City will also reflect an administration charge of $263.00
per parcel.
