Recommended Action

amount not to exceed $275,400 for construction of the Corrugated Metal Pipe Replacement
Project -Carlsbad Boulevard North of Island Way, Project No. 6607.
Executive Summary
On May 23, 2017, City Council approved Resolution No. 2017-090 approving the plans and
specifications and authorizing advertisement of the Corrugated Metal Pipe Replacement Project
-Carlsbad Boulevard North of Island Way, Project No. 6607 (Project) for construction bids. The
documents were posted on the city's website for 35 days. Eight sealed bids were received on
July 10, 2017, and the lowest responsive and responsible bidder was Bali Construction Inc., with
a bid in the amount of $275,400. Staff recommends award of the construction contract to Bali
Construction Inc.
Discussion
The Corrugated Metal Pipe Replacement Program (Program) was established to replace, repair,
or remediate deteriorated corrugated metal pipe storm drain systems throughout the city. The
pipelines included in the Program were identified after city staff inspected and assessed the
condition of the corrugated metal pipe storm drain pipelines. The storm drain system crossing
northbound Carlsbad Boulevard, just north of Island Way, was inspected in March 2016 using
closed circuit television technology. The inspection revealed that the pipe structure is
compromised at several locations. City staff then prioritized this system for removal,
replacement and repair.
A total of 690 feet of storm drain pipeline is included in this Project. The Project will remove
300 feet of corrugated metal pipe and replace it with reinforced concrete pipe. The remaining
390 feet of corrugated metal pipe is structurally intact, but has deteriorated, and will be lined
with a cured-in-place pipe lining. In addition, a curb inlet and 240 feet of asphalt berm along the
roadway shoulder will be installed to improve street drainage conditions.

On July 10, 2017, eight sealed bids were received for the construction ofthis Project as shown
on the following table:

Staff has completed the review of the contract documents and determined that Bali
Construction Inc. is the lowest responsive and responsible bidder. Bali Construction lnc.'s bid is
responsive as it meets the requirements of the bidding documents. The bidder is also deemed
responsible as they submitted a list of similar projects to show their capability and qualification
to perform the specified work. The construction contract contains general performance
standards and references technical specifications, which if not met, allow the city to withhold
payment, and includes a one year warranty period.
Fiscal Analysis
There are sufficient funds available in the Corrugated Metal Pipe Replacement Program, CIP No.
6607 fund to complete the replacement on Carlsbad Boulevard north of Island Way. The
Corrugated Metal Pipe Replacement Program is funded by Infrastructure Replacement Funds.
The available funds and estimated construction costs for this project are shown in the following
table:

Next Steps
Once contract documents are fully executed and a purchase order is issued, staff will schedule a
pre-construction meeting with the contractor, and issue a notice to proceed with the
construction of the Project.
Environmental Evaluation (CEQA}
The Project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15301{c) -minor alteration of existing facilities including streets, sidewalks,
gutters, and similar facilities involving negligible or no expansion.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date. The public will be
notified in advance of the construction activities using multiple media methods such as sign age,
email, website, and other city communication channels.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO BALI
CONSTRUCTION INC. FOR AN AMOUNT NOT TO EXCEED $275,400 FOR
CONSTRUCTION OF THE CORRUGATED METAL PIPE REPLACEMENT PROJECT
-CARLSBAD BOULEVARD NORTH OF ISLAND WAY, PROJECT NO. 6607.
Exhibit I
WHEREAS, the City Council of the City of Carlsbad, California has determined that it is necessary,
desirable, and in the public's best interest to construct the Corrugated Metal Pipe Replacement Project
-Carlsbad Boulevard North of Island Way, Project No. 6607; and
WHEREAS, on May 23, 2017, the City Council of the City of Carlsbad adopted Resolution No.
2017-090 approving plans and specifications for the construction of the Corrugated Metal Pipe
Replacement Project -Carlsbad Boulevard North of Island Way, Project No. 6607; and
WHEREAS, the City of Carlsbad received eight sealed bids on July 10, 2017 for the construction
of the Corrugated Metal Pipe Replacement Project -Carlsbad Boulevard North of Island Way, Project
No. 6607 (Project); and
WHEREAS, Bali Construction Inc. submitted the lowest responsive and responsible bid to
construct the Project in the amount of $275,400; and
WHEREAS, there are sufficient funds available in the Corrugated Metal Pipe Replacement
Program to complete the Project; and
WHEREAS, subsections 3.28.040(C)(S) and 3.28.090(8) of the Carlsbad Municipal Code
authorize the city manager or designee to approve change orders in the amount equal to the
contingency set at the time of project award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the bid of $275,400 submitted by Bali Construction Inc. for the construction of the
Corrugated Metal Pipe Replacement Project -Carlsbad Boulevard North of Island Way,
Project No. 6607 is accepted and the mayor is hereby authorized to execute a contract
for this project.
3. That the city manager or designee is hereby authorized to approve construction change
orders up to $28,000.
4. That the award of this contract is contingent upon Bali Construction Inc. executing the
required contract and submitting the required bonds and insurance policies within 20
days of adoption of this Resolution. The city manager may grant reasonable extensions
of time.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 15th day of August, 2017, by the following vote, to wit:
