Recommended Action
Adopt a Resolution accepting bids and awarding a contract to Palm Engineering Construction
Company, Inc. for an amount not to exceed $990,472 for the construction of the Carlsbad
Boulevard Bridge Improvements Over the Encina Power Station Discharge Channel, Project Nos.
6014 and 6053.
Executive Summary
On May 23, 2017, City Council adopted Resolution No. 2017-089 approving the plans and
specifications and authorizing the advertisement for bids to construct the Carlsbad Boulevard
Bridge Improvements Over the Encina Power Station Discharge Channel, Project Nos. 6014 and
6053 (Project). The documents were posted on the city's website for at least 30 days. Three
bids were received on July 12, 2017, and the lowest responsive and responsible bidder was
Palm Engineering Construction Company, Inc. with a bid in the amount of $990,472. Staff
recommends award of the construction contract to Palm Engineering Construction Company,
Inc.
Discussion
The Carlsbad Boulevard Bridge (Bridge) was constructed in 1954 and is a 2-span reinforced
concrete culvert. The Bridge consists of sidewalks, bike lanes, and two vehicle travel lanes in
each direction with a raised concrete median. Currently, chain-link fences located behind the
sidewalk on both the west and east sides of the Bridge are the barriers at the edge of the
structure. The construction of Bridge railings will increase the safety across the Bridge for
vehicles, bicyclists, and pedestrians. The railings will complement the aesthetic characteristics
of the existing sea wall along the west side of Carlsbad Boulevard to the north and south of the
Bridge. In addition to the Bridge railing construction, the Project will replace the water pipeline
attached to the east side of the Bridge. The construction documents prepared for the Project
include performance standards and specifications which govern construction as well as a one
year warranty period.

In May 2017, CalTrans issued the "Authorization to Proceed with Construction and Construction
Engineering," which authorizes the City of Carlsbad to proceed with the construction phase of
the Project beginning with the advertising for construction bids. On July 11, 2017, three sealed
bids were received for construction of the Carlsbad Boulevard Bridge Improvements over the
Encina Power Station Discharge Channel, Project Nos. 6014 and 6053, as shown in the following
table:

Staff has completed its review of the contract documents and determined that Wright
Construction Engineering, Corp. submitted a non-responsive bid because its Disadvantage
Business Enterprises participation did not meet the goal of 11.25 percent as described in the
bid documents. The next lowest responsive and responsible bidder was determined to be Palm
Engineering Construction Corporation, Inc. with a bid of $990,472. The construction contract
contains general performance standards and references technical specifications, which if not
met, allow the city to withhold payment, and includes a one year warranty period from notice
of completion.
Fiscal Analysis
Sufficient funds are available to complete the Project. Funding for the Project consists of
Federal Highway Bridge Program (HBP) funds, TransNet-Local funds and a payment from Kiewitt
Shea Desalination (KSD) to satisfy Project conditions related to their desalination project. The
available funds and the estimated construction costs for the Project are shown in the following
table:

Next Steps
Once contract documents are fully executed with Palm Engineering Construction Company, Inc.
and a purchase order is issued, staff will schedule a pre-construction meeting with the
contractor and issue a notice to proceed with the construction of the Project.
Environmental Evaluation (CEQA/NEPA)
This Project is exempt from California Environmental Quality Act (CEQA) review pursuant to
CEQA Guidelines Section 15301(d) -Existing Facilities -restoration or rehabilitation of existing
facilities that are deteriorated or damaged and are required to meet current standards of public
health and safety involving negligible or no expansion of use.
This Project is also exempt from the National Environmental Policy Act (NEPA) review pursuant
to NEPA Regulations 23 CFR 771.117(c): activity (c){28)-Bridge rehabilitation, reconstruction,
or replacement or the construction of grade separation to replace existing at grade railing
crossing, if the actions meet the constraints in paragraph (e) of this section. CalTrans made a
NEPA determination on Jan. 6, 2015, which indicates the Project is exempt and has no
significant impacts or unusual circumstances.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date. The public will be
notified in advance of the construction activities using multiple media methods such as sign age,
email, website, and other city communication channels. The construction contractor will also
be required to notify the public of construction activities via changeable message signs, door
hangers, letters to residents, and/or "NO PARKING" signs, as applicable.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO PALM
CONSTRUCTION ENGINEERING COMPANY, INC. FOR AN AMOUNT NOT TO
EXCEED $990,472 FOR THE CONSTRUCTION OF THE CARLSBAD BOULEVARD
BRIDGE IMPROVEMENTS OVER THE ENCINA POWER STATION DISCHARGE
CHANNEL, PROJECT NOS. 6014 AND 6053.
EXHIBIT 1
WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary,
desirable, and in the public interest to improve the Carlsbad Boulevard Bridge Over the Encina Power
Station Discharge Channel; and
WHEREAS, on May 23, 2017, the City Council adopted Resolution No. 2017-089 approving plans
and specifications and authorizing the advertisement for bids for the construction of the Carlsbad
Boulevard Bridge Improvements over the Encina Power Station Discharge Channel, Project Nos. 6014
and 6053 (Project); and
WHEREAS, on July 12, 2017, three sealed bids were received for the Project; and
WHEREAS, the lowest responsive and responsible bid for the Project was submitted by Palm
Engineering Construction Company, Inc. in the amount of $990,472; and
WHEREAS, Federal Highway Bridge Program funds, TransNet-Local funds and a payment from
Kiewit Shea Desalination for Project Nos. 6014 and 6053 have been appropriated and are sufficient to
complete the Project; and
WHEREAS, subsections 3.28.040(C)(5) and 3.28.090(8) of the Carlsbad Municipal Code
authorize the city manager or designee to approve change orders in the amount equal to the
contingency set at the time of project award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the bid of $990,472 submitted by Palm Engineering Construction Company, Inc. for
the construction of the Carlsbad Boulevard Bridge Improvements Over the Encina Power
Station Discharge Channel, Project Nos. 6014 and 6053, is hereby accepted and the
mayor is hereby authorized to execute the contract for this Project.
3. That the city manager or his designee is hereby authorized to approve construction
change orders up to $198,094.
4. The award of this contract is contingent upon Palm Engineering Construction Company,
Inc. executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 calendar days of adoption of this
Resolution. The city manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 22nd day of August, 2017, by the following vote, to wit:
