Approve a Resolution granting an easement to San Diego Gas and Electric (SDG&E) over a portion of Lot 9 of Map 8956, generally described as the parking lot for the Shoppes at Carlsbad shopping center. Shoppes at Carlsbad SDP 09-04 (DEV09029) Recommended Action Adopt a Resolution authorizing the granting of an easement to San Diego Gas and Electric (SDG&E) for public utility purposes over property generally described as the parking lot for the Shoppes at Carlsbad shopping center. Executive Summary The Developer (Rouse Properties) is constructing tenant improvements to the Shoppes at Carlsbad that require additional electrical services be brought to the buildings. Since the parking lot surrounding the buildings are on property owned by the City of Carlsbad, new electrical transformers and equipment require an easement granted by the City. The proposed easement will allow infrastructure to be constructed on city property near the south side of the mall entrance off Marron Road within the parking lot area. Discussion Rouse Properties is currently working on substantial improvements to the Shoppes at Carlsbad through tenant improvements consisting of both interior and exterior remodels. The proposed work is consistent with the approved Westfield Carlsbad Specific Plan SP 09-01 approved by City Council on July 23, 2013 and modified on September 23, 2014. The improvements are also in conformance with the Westfield Carlsbad Site Development Plan SDP 09-04, approved by City Council on July 9, 2013. The utility easement is required to complete the approved tenant improvements on schedule for several tenant openings for the 2017 holiday shopping season. A copy of the utility easement to SDG&E is attached as Exhibit 3. The required easement is located on the south side of the mall, west of the entrance off of Marron Road nearest to Regal Cinemas. The easement is located within the raised medians of the parking lot area and will not interfere with planned or future improvements. Fiscal Analysis There are no direct costs to the city from this action. Page 106 Next Steps City Council's action on this item is final. If approved, the Mayor is authorized to sign the original easement on file with the City Clerk. The City Clerk will then send the easement for recordation by the County Recorder. Environmental Evaluation (CEQA) The proposed action is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301 -Existing Facilities. Section 15301 exempts granting an easement for public utility purposes which involves negligible or no expansion of use beyond that existing at the time of lead agency's determination. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1.
