Recommended Action Adopt a Resolution authorizing way-finding signs in the city's right-of-way for the Carlsbad Premium Outlets. Executive Summary In 2013, City Council approved an ordinance to establish guidelines for permitting way-finding signs in the public right-of-way. Per Section 11.44.100 -City-Wide Way-Finding Signs -of the Carlsbad Municipal Code (CMC) (see Exhibit 2), the purpose of the ordinance is to allow "the city to post way-finding (directional) signs on city property to guide residents and visitors to public buildings or facilities, quasi-public buildings, city neighborhoods, philanthropic organizations, cultural/historical destinations, and tourist destinations and points of public interest throughout Carlsbad." Per the ordinance, way-finding signs for certain uses are expressly permitted while way-finding signs for other uses may be allowed if approved by resolution of the City Council. The CMC states that tourist destinations, or locations or destinations where way-finding signs would be of public benefit may be allowed by resolution of the City Council. The Carlsbad Premium Outlets, located at 5620 Paseo Del Norte, has requested that the City Council determine that the Carlsbad Premium Outlets is a tourist destination, and a location or destination where way-finding signs would be of public benefit to direct traffic to the center. Discussion The Carlsbad Premium Outlets is unique and differs from a typical regional, general or local commercial center. According to the Institute of Transportation Engineers' Trip Generation Report (8th Edition, Volume 3 of 3), "a factory outlet center is a shopping center that primarily houses factory outlet stores, attracting customers from a wide geographic area, very often from a larger area than a regional shopping center. Organized bus trips serve many factory outlets center." The City of Carlsbad welcomes 3.5 million visitors annually. Between 2,000-10,000 cars visit the Carlsbad Premium Outlets each day, with visitors split between locals and tourists. The center is also somewhat uniquely situated and can be difficult to locate. As such, way-finding signs would be beneficial since they would enable tourists unfamiliar with local street patterns to easily locate the Carlsbad Premium Outlets. Given the mix and volume of visitors, the center is a destination where staff concludes that installing way-finding signage would benefit the public. Page 99 Per Chapter 11.44.100((), the specific design and location of requested way-finding signs shall be processed and approved by the City Planner, City Engineer, City Traffic Engineer, and Communications Manager. If City Council determines that the Carlsbad Premium Outlets is authorized to apply for way-finding sign age, then city staff will process the request. Attached as Exhibit 4 is an example way-finding sign design. Fiscal Analysis All costs incurred for sign design, sign fabrication and installation by public works are funded by the applicant. Next Steps City Council's action on this item is final. City staff will review the suggested locations and number of signs, and recommend those necessary to achieve the intended way-finding objective. Total design, fabrication and installation costs will be funded by the applicant, and must be paid before the signs will be fabricated. Per CMC, Section 11.44.lOO(D), the city installs the approved way-finding signs. All way-finding signs remain the property of the city and are subject to removal at any time at the discretion of the City of Carlsbad Public Works Department. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1. Way-Finding Sign Example Design Page 100 RESOLUTION NO. 2017-163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING WAY-FINDING SIGNS IN THE CITY'S RIGHT-OF- WAY FOR THE CARLSBAD PREMIUM OUTLETS CASE NAME: CASE NO.: CARLSBAD PREMIUM OUTLETS PS 16-50 (DEV 2017-0081) EXHIBIT 1 WHEREAS, the City Council of the City of Carlsbad, California has considered a request to determine that the Carlsbad Premium Outlets is eligible to apply for way-finding signs in the City's right- of-way; and WHEREAS, Carlsbad Municipal Code Section 11.44.100 provides that way-finding signs may be allowed for tourist destinations, or locations or destinations where way-finding signs would be of public benefit. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. The City Council determines that the Carlsbad Premium Outlets is a tourist destination and a location or destination where way-finding sign age would be of public benefit. 3. That the City Council authorizes way-finding signs in the city's right-of-way for the Carlsbad Premium Outlets and that the city is responsible for designing, approving, fabricating, and installing the signs in the right-of-way at the applicant's expense. The city's intent as to this section is to designate a strictly limited forum, which allows the city to post way-finding (directional) signs on city property to guide residents and visitors to public buildings or facilities, quasi-public buildings, city neighborhoods, philanthropic organizations, cultural/historical destinations, tourist destinations and points of public interest throughout Carlsbad. Other uses, locations or destinations may be allowed to post way- finding signage if approved by resolution of the city council. Way-finding signs are expressly permitted for the following buildings/facilities/uses: 1. Public buildings and facilities: City of Carlsbad, county, state and federal buildings; 2. City facilities: city buildings, uses, parking lots, golf course, parks and trails, etc.; 3. Quasi-public buildings: chamber of commerce, Carlsbad visitors center, train stations; 4. Cultural/historical destinations: museums; 5. Points of public interest: city lagoons, ocean beaches, nature/interpretive centers, the flower fields, the strawberry fields, Legoland, the village area; 6. City entries and neighborhood entries; and 7. Philanthropic organizations: Lions Club, Rotary Club, Kiwanis Club, etc. B. The following way-finding signs may be allowed if approved by resolution of the city council: 1. Tourist destinations; 2. Locations or destinations where way-finding signage would be of public benefit; and 3. Way-finding signs designed as archway signs located over major roads within the city. C. The design and location of the city's way-finding signs shall be as approved by the city planner, city engineer, city traffic engineer, and communications manager.
