Recommended Action Adopt a Resolution accepting bids and awarding a contract to Burtech Pipeline Inc. for an amount not to exceed $193,280 for the construction of the La Costa Avenue Storm Drain Replacement (La Coruna Place), Project No. 6602. Executive Summary On June 13, 2017, City Council approved Resolution No. 2017-121 approving the plans and specifications and authorizing advertisement of the La Costa Avenue Storm Drain Replacement (La Coruna Place), Project No. 6602 (Project) for construction bids. The documents were posted on PlanetBids for at least 30 days. Bids were received on Aug. 17, 2017, and the lowest bidder was Miramar General Engineering. On Aug. 21, 2017, Miramar withdrew their bid and the Project was then awarded to the next lowest and responsive bidder, Burtech Pipeline Inc. with a bid in the amount of $193,280. Staff recommends award of the construction contract to Burtech Pipeline Inc. Discussion The Project was established to improve the drainage conditions along the La Costa Avenue corridor. La Coruna Place is a residential street along this corridor that has experienced surface ponding of water due to the absence of adequate drainage infrastructure. The proposed improvements within the Project will capture and convey storm water and groundwater runoff from La Coruna Place via an underground pipe system to an existing storm drain system in La Costa Avenue. In addition, La Coruna Place will receive a 2-inch overlay consistent with and funded by the city's Pavement Management Program. Burtech Pipeline Inc. is responsive as it meets the requirements of the bidding documents. The bidder is also deemed responsible as they submitted a list of similar projects to show their capability and qualification to perform the specified work. Some of the listed similar projects were for the City of Carlsbad in recent years, and the projects were performed to the city's satisfaction. The construction contract contains general performance standards and references technical specifications, which if not met, allow the city to withhold payment, and includes a 1 year warranty period. Fiscal Analysis There are sufficient funds available in the La Costa Avenue Storm Drain Replacement Program, CIP Project No. 6602, and the Pavement Management Program, CIP Project No. 6001, to complete the improvements at La Coruna Place. Funding for the La Costa Avenue Storm Drain Replacement Program (Program) consists of Infrastructure Replacement Funds. Remaining funds in the Program will be used to replace or rehabilitate other drainage system assets along the La Costa Avenue corridor. Environmental Evaluation (CEQA} The Project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) -minor alteration of existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion. September 26, 2017 Item #8 Page 3 of 7 Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. The public will be notified in advance of the construction activities using multiple media methods such as sign age, email, website, and other city communication channels. The construction contractor will also be required to notify the public of construction activities. Exhibits 1. FOR AN AMOUNT NOT TO EXCEED $193,280 FOR THE CONSTRUCTION OF THE LA COSTA AVENUE STORM DRAIN REPLACEMENT (LA CORUNA PLACE), PROJECT NO. 6602. EXHIBIT I WHEREAS, the City Council ofthe City of Carlsbad, California has determined that it is necessary, desirable, and in the public's best interest to construct the La Costa Avenue Storm Drain Replacement (La Coruna Place), Project No. 6602; and WHEREAS, on June 13, 2017, the City Council of the City of Carlsbad adopted Resolution No. 2017-121 approving plans and specifications for the construction of the La Costa Avenue Storm Drain Replacement (La Coruna Place), Project No. 6602; and WHEREAS, the City of Carlsbad received 13 sealed bids on Aug. 17, 2017 for the construction of the La Costa Avenue Storm Drain Replacement (La Coruna Place), Project No. 6602 (Project); and WHEREAS, Miramar General Engineering was the lowest bidder but withdrew their bid in compliance with Public Contracting Code sections 5101(a) and 5103; and WHEREAS, Burtech Pipeline Inc. submitted the next lowest responsive and responsible bid to construct the Project in the amount of $193,280; and WHEREAS, there are sufficient funds available in the La Costa Avenue Storm Drain Replacement Program and Pavement Management Program to complete the Project; and WHEREAS, subsections 3.28.040(C)(5) and 3.28.090(8) of the Carlsbad Municipal Code authorize the city manager or designee to approve change orders in the amount equal to the contingency set at the time of the Project award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid of $193,280 submitted by Burtech Pipeline Inc. for the construction of the La Costa Avenue Storm Drain Replacement (La Coruna Place), Project No. 6602 is accepted and the mayor is hereby authorized to execute a contract for this Project. 3. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies within 20 days of adoption of this Resolution.
