HomeMy WebLinkAbout2018-01-09; City Council; ; Adopt a Resolution accepting bids and awarding a contract to Leonida Builders, Inc. for an amount not to exceed $434,420 for the construction of the Bridge Preventive MaiCONTRACTOR TOTAL BID Leonida Builders, Inc. $434,420 AToM Engineering Construction, Inc. $456,398 Beador Construction Company, Inc. $531,300 Staff has completed its review of the contract documents and found a mathematical error in the bid from Leon ida Builders, Inc. The mathematical error results in a reduction in the total bid amount by $5,000 which does not change the ranking of the bidders. Staff has informed the contractor of the mathematical error, and the contractor recognized the error and agreed to honor the unit price submitted. Staff recommends that City Council waive this minor irregularity under Carlsbad Municipal Code section 3.28.080(G)(3). Staff has determined that Leonida Builders, In c. is the lowest responsive and responsible bidder. The contractor's bid is responsive as it meets the requirements of the bidding documents. The bidder is also deemed responsible as they submitted a list of similar projects to show their capability and qualification to perform the specified work. The contract for construction contains general performance standards and references technical specifications, which if not met, allow the city to withhold payment, and includes a one-year warranty period. Fiscal Analysis There are sufficient funds available in the Bridge Preventive Maintenance Program, CIP No. 6066 Fund to complete the Project. Funding for the Project is available from the Infrastructure Replacement Fund. Remaining funds will be used on future projects. January 9, 2018 Item #4 Page 2 of 6 Environmental Evaluation (CEQA) The Project is exempt from the California Environmental Quality Act {CEQA) per State CEQA Guidelines Section 15301{d)-Existing Facilities -restoration or rehabilitation of existing facilities that are deteriorated or damaged and are required to meet current standards of public health and safety involving negligible or no expansion. Public Notification This item was noticed in accordance w ith the Ralph M . Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Prior to the start of construction the public will be notified of the construction activities using media methods such as signage, email, website, and other city communication channels. Exhibits 1. January 9, 2018 Item #4 Page 3 of 6 RESOLUTION NO. 2018-003 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO LEONIDA BUILDERS, INC. FOR AN AMOUNT NOT TO EXCEED $434,420 FOR THE CONSTRUCTION OF THE BRIDGE PREVENTIVE MAINTENANCE PROGRAM (2017), PROJECT NO. 6066-17. Exhibit 1 WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable, and in the public interest to perform maintenance activities on various bridges in accordance with the city's Bridge Preventive Maintenance Program; and WHEREAS, on Sept. 12, 2017, the City Council adopted Resolution No. 2017-179 approving plans and specifications and authorizing the advertisement for bids for the construction of the Bridge Preventive Maintenance Program (2017), Project No. 6066-17 (Project); and WHEREAS, three sealed bids were received on Oct. 24, 2017 for the construction of the Project; and WHEREAS, the lowest responsive and responsible bid was submitted by Leonida Builders, Inc. in the amount of $434,420; and WHEREAS, staff recommends that pursuant to Carlsbad Municipal Code section 3.28.080(G)(3), City Council waive the minor irregularity in the bid from Leonida Builders, Inc., which included a mathematical error resulting in a reduction of the total bid by $5,000 but which did not change the identity of the low bidder; and WHEREAS, there are sufficient Bridge Preventive Maintenance Program funds available to complete the Project; and WHEREAS, subsection 3.28.040(C)(5) and 3.28.090(8) of the Carlsbad Municipal Code authorizes the city manager to approve change orders in the amount equal to the contingency set at the time of Project award; and WHEREAS, the Project is exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15301(c). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. January 9, 2018 Item #4 Page 4 of 6 2. That the minor irregularity in the bid submitted by Leonida Builders, Inc., in a mathematical error, is hereby waived under Carlsbad Municipal Code section 3.28.080(G}(3). 3. That the low bid of $434,420 submitted by Leoniqa Builders, Inc. for the construction of the Bridge Preventive Maintenance Program (2017), Project No. 6066-17 is accepted and the mayor is hereby authorized to execute a contract for the Project. 4. That the city manager or designee is hereby authorized to approve construction change orders up to $43,000. 5. That the award of this contract is contingent upon Leonida Builders, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this Resolution. The city manager may grant reasonable extensions of time.
