Recommended Action
Adopt a Resolution appointing one member to the Traffic Safety Commission.
Executive Summary
Commissioner Fred Muir resigned his position on November 28, 2017, leaving an unexpired
term to be filled through July 2021. Commissioner Muir was initially appointed in August 2012
to fill the expired term of Commissioner Gallagher. He was reappointed in July 2013 and July
2017. The City Clerk's office received applications from the following residents wishing to serve
on the Traffic Safety Commission (Exhibit 2):

Discussion
Government Code Section §54970-54974, known as the Maddy Act, requires that on or before
December 31 of each year the legislative body shall prepare a Local Appointments List which
contains the appointive terms of Board and Commission members which will expire in the next
calendar year. The name of the incumbent appointee and the date of appointment and the
term expiration date is also included on the·list. Based on the prepared list, the City Clerk's
office accepts applications (available on the City's website and in the City Clerk's office) for any
upcoming vacancies.
City of Carlsbad Municipal Code 2.28 states that the Traffic Safety Commission shall consist of
five members, appointed by the Mayor with the approval of the City Council.
Other members of the Traffic Safety Commission are: Monica Gocan, Chuck Hunter, Jonnie
Johnson and Peter Penseyres. Members of the Traffic Safety Commission are subject to the
provisions of the Political Reform Act, and must file a Statement of Economic Interests. January 9, 2018 Item #11 Page 1 of 25

Next Steps
Following the appointment of one member to the Traffic Safety Commission, the City Clerk's
office will update the Commission roster and coordinate the oath of office and filing of the
appointees Statement of Economic Interest.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.

WHEREAS, Commissioner Fred Muir was initially appointed in August 2012; and
