Recommended Action
Adopt a Resolution approving a side letter with the Carlsbad Police Management Association
(CPMA).
Executive Summary
On June 28, 2016, the City Council adopted Resolution No. 2016-127 approving a Memorandum
of Understanding (MOU) with the CPMA with a term of three years that expires on December 31,
2018. In December 2017, the parties agreed to open discussions regarding certain terms and
provisions covered by the current MOU. Representatives of the city and the CPMA have reached
agreement on an amendment to the current MOU and this amendment must be approved by the
City Council.
Discussion
As part of an ongoing employee engagement initiative currently underway within the city, staff
facilitated a series of employee feedback meetings in May 2017. More than 300 city employees,
including members of the CPMA, participated in facilitated discussion around topics identified
through an employee engagement survey. Although input received by staff covered many issues,
dissatisfaction with the current system of evaluating employee performance was a key concern.
The current MOU between the city and CPMA contemplates that the current performance
evaluation system known as "pay for performance" will remain in place through the remainder
of the contract. The parties have met and conferred and agreed to modify the existing language.
The proposed side letter modifies Article 28 of the MOU to provide that the previously negotiated
budget for variable salary increases tied to performance be converted to an across the board
salary increase for all members of CPMA. It is necessary to make a slight change to the CPMA
salary range maximums on December 1, 2018 to allow for employees to receive the full
negotiated increase on December 31, 2018. The revised CPMA Salary Schedule is attached as
Exhibit 2.

Fiscal Analysis
There is no fiscal impact associated with this action.
Next Steps
Staff recommends approval of the Side Letter between the city and the Carlsbad Police
Management Association (CPMA) as shown in Attachment A to the Resolution.
Environmental Evaluation {CEQA)
The proposed action does not qualify as a "project" under the California Environmental Quality
Act (CEQA) per State CEQA Guidelines Section 15378 as it does not result in a direct or reasonably
foreseeable indirect physical change in the environment.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for viewing
at least 72 hours prior to the meeting date.

RESOLUTION NO. 2018-017
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A SIDE LETTER WITH THE CARLSBAD POLICE
MANAGEMENT ASSOCIATION (CPMA) THAT AMENDS ARTICLE 28, TITLED
"PERFORMANCE MANAGEMENT AND COMPENSATION SYSTEM", OF
THE MEMORANDUM OF UNDERSTANDING
WHEREAS, on June 28, 2016 the City Council adopted Resolution No. 2016-127
approving a Memorandum of Understand (MOU) with the CPMA with a term of three
years that expires on December 31, 2018; and
WHEREAS, representatives of management and the Carlsbad Police
Management Association have met and conferred in good faith pursuant to the
Meyers-Millias-Brown Act regarding wages and other terms and conditions of
employment; and
WHEREAS, said representatives have reached agreement which they desire to
submit to the City Council for consideration and approval; and
WHEREAS, the City Council has determined it to be in the public interest to
accept such an agreement in the form of a side letter dated January 26, 2018, marked
Attachment A and incorporated by reference herein.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the side letter dated January 26, 2018, set forth in Attachment A,
hereto and made a part hereof, is adopted.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of
the City of Carlsbad on the 13th day of February, 2018, by the following vote, to wit:

It is the understanding of the City and CPMA that this side letter is of no force or effect
whatsoever, unless and until adopted by resolution of the City Council of the City.
