Recommended Action Adopt a Resolution accepting bids and awarding a contract to Creative Home OBA: CHI Construction for an amount not to exceed $413,075 for the construction of the Simsbury Sewer Pipeline Extension, Project No. 5533 and authorizing an additional appropriation of $50,000 from the Sewer Replacement Fund. Executive Summary On Oct. 24, 2017, the City Council adopted Resolution No. 2017-203 approving the plans and specifications and authorizing the advertisement of the Simsbury Sewer Pipeline Extension, Project No. 5533 (Project) for construction bids. All of the documents were posted on the city's website. Bids were received on Feb. 8, 2018, and the lowest responsive and responsible bidder was Creative Home OBA: CHI Construction, with a bid in the amount of $413,075. Staff recommends award of the construction contract to Creative Home OBA: CHI Construction and authorization of an additional appropriation in the amount of $50,000 from the Sewer Replacement Fund for the construction of the Project. City Council approval is required to award public works contracts in excess of $175,000. Discussion Sewer pipeline systems are ideally constructed to flow by gravity from higher elevations to lower elevations, relying when possible on the topography of the basin. Lift stations become necessary when there is no available gravitational alignment. The City of Carlsbad's sewer system includes 15 sewer lift stations. Lift stations are significantly more complex and generally less desirable than gravity systems, as they consume significant electrical power and require lifelong maintenance for their multiple components. The completion of the Quarry Creek development's sewer system provides the opportunity to eliminate the Simsbury Lift Station by extending a gravity pipeline from the Simsbury sewer basin into the new adjacent gravity flow sewer system. This Project would install approximately 700 linear feet of polyvinyl chloride (PVC) pipe by standard open cut methods. There will be no March 27, 2018 Item #4 Page 1 of 7 interruption to sewer services during construction. The development's sewer network was constructed and sized in anticipation of the additional flow. Also, the Project is included in the city's Sewer Master Plan. The Project includes the demolition and removal of the existing Simsbury Sewer Lift Station along with the decommissioning ofthe Simsbury Sewer Lift Station's force main. Removal of this station will save the city, or allow the repurposing of, approximately $40,000 in annual operational and maintenance costs. Staff averages 460 hours annually on planned and unplanned maintenance of the station. This staff time would be reallocated to other tasks. Additionally, future repairs or station replacement costs will be avoided once the station is decommissioned. On Feb. 8, 2018, five sealed bids were received for the construction of this Project as shown in the following table: SIMSBURY SEWER PIPELINE ~><TENSION, PROJECT NO. 5533 CONTRACTOR TOTAL BID 1. Blue Pacific Engineering and Construction $786,700 Staff has completed reviewing the contract documents and determined that Creative Home OBA: CHI Construction is the lowest responsive and responsible bidder as they meet the requirements of the bidding documents. The bidder is also deemed responsible because they submitted a list of similar projects to show their capability and qualification to perform the specified work. Creative Home OBA: CHI Construction did not include notarization for their surety's signature which is a minor irregularity that staff recommends waiving under Carlsbad Municipal Code section 3.28.080(G)(3). The construction contract contains general performance standards, and references technical specifications, which if not met, allow the city to withhold payment, and includes a one-year warranty period. Additional funds are being requested because bids received were higher than the engineers estimate. Research into conditions at the site showed geological formations that will require more resources to manage. Fiscal Analysis Sufficient funds are not available in the Simsbury Sewer Extension, CIP No. 5533. Sufficient funds are available for this request. Next Steps Once contract documents are fully executed and a purchase order is issued, staff will schedule a pre-construction meeting with Creative Home DBA: CHI Construction and issue a notice-to- proceed with the construction of the Project. The duration of the construction contract is 70 working days, exclusive of weather related events and change orders that may extend the contract duration. Upon the successful completion of the Project, staff will request that the city manager accept the construction of the Simsbury Sewer Pipeline Extension, Project No. 5533, and direct the secretary to the city clerk to record a Notice of Completion and to release bonds. Environmental Evaluation (CEQA) The Project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15302(c)-replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity, and Section 15304(f) -minor trenching and backfilling where the surface is restored. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Prior to the start of construction, the public will be notified of the construction activities using media methods such as signage, email, website, and other city communication channels. EXHIBIT 1 WHEREAS, the City Council of the City of Carlsbad, California has determined that it is necessary, desirable, and in the public interest to connect a new gravity flow sewer pipeline to reroute sewer flows; and WHEREAS, on Oct. 24, 2017, City Council adopted Resolution No. 2017-203 approving plans and specifications authorizing the advertisement for bids for the Simsbury Sewer Pipeline Extension, Project No. 5533 (Project); and WHEREAS, five sealed bids were received on Feb. 8, 2017 for the construction of the Project; and WHEREAS, the lowest responsive and responsible bid was submitted by Creative Home OBA: CHI Construction in the amount of $413,075; and WHEREAS, an additional appropriation of $50,000 is requested to fund the Simsbury Sewer Extension, CIP No. 5533; and WHEREAS, the Project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15302(c) -replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity, and Section 15304(f) -minor trenching and backfilling where the surface is restored. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the minor irregularity in the bid submitted by Creative Home OBA: CHI Construction, in failing to include notarized signatures, is hereby waived under Carlsbad Municipal Code section 3.28.080(G)(3). That the administrative services director is hereby authorized to appropriate an additional $50,000 from the Sewer Replacement Fund. 5. That the award of this contract is contingent upon Creative Homes DBA: CHI Construction, executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this Resolution. The city manager may grant reasonable extensions of time.
