Executive Summary The Fire Department has completed its annual hazard survey and identified 191 parcels that now have, or are likely to have, potential fire hazards upon them during the drier months. At the March 27, 2018 City Council meeting these parcels were declared to be public nuisances. The City Council set April 24, 2018 as the date of the public hearing for property owners to voice objections to the parcels declared as nuisances. The City Council's adoption of the Resolution attached to this report will direct the fire chief to abate the nuisances. Discussion At the March 27, 2018 City Council meeting, 191 parcels were declared throughout the city to be public nuisances due to the presence of hazardous combustible material upon them, or the likelihood of that condition existing during the drier months. The Fire Department mailed notices to the affected property owners on March 27, 2018 explaining the City Council's action, and informing them of the date ofthe public hearing. The City Council set April 24, 2018 as the date of the public hearing for affected property owners to voice objections to the prior Council action. Adoption of this Resolution will direct the fire chief to abate the declared nuisances. Affected property owners have been notified that any nuisances existing after May 15, 2018 are subject to abatement by the City of Carlsbad, and the cost of the abatement will appear on their property tax bills. Fiscal Analysis Contractor charges and city administrative costs associated with the abatement of each parcel are recoverable from the property owners. Labor costs will vary depending upon the work performed on the affected properties. An administrative fee of $263.00 is assessed on each property where the abatement has been completed. Next Steps The City of Carlsbad has contracted with crews that will abate nuisances on properties after May 15, 2018. The cost of the abatement will appear on owners' property tax bills. Exhibit 1 WHEREAS, weeds, rubbish and refuse exist or are likely to exist on vacant parcels throughout the city; and WHEREAS, said weeds, rubbish and refuse, because of their combustibility, constitute a fire hazard to the safety of the public and to private property during the drier months of the year. Words used in this Resolution and all action taken in connection herewith shall be defined as outlined in said code sections. 4. That weeds, rubbish and refuse upon those certain parcels of private property in the City of Carlsbad, as described on Attachment A, are hereby declared as public nuisances. 5. That said weeds, rubbish and refuse shall be removed from these parcels, as described in Attachment A. 6. The fire chief of the City of Carlsbad is hereby designated to perform the duties imposed by the California Government Code sections 39560, et seq. 7.
