State of California. Executive Summary This item presents a Resolution expressing the city's policy position concerning California's "sanctuary state" laws, and authorizes the filing or joining of an amicus brief, pursuant to City Council direction provided at the May 21, 2018, City Council meeting. Discussion On May 21, 2018, Council directed staff to prepare the subject resolution following a discussion of the laws enacted last year by the California Legislature, AB 450, AB 103, and SB 54, referred to herein as California's "sanctuary state" laws. On March 6, 2018, the United States of America filed a civil Complaint against the State of California, Governor Brown, and Xavier Becerra, the State Attorney General, in United States v. State of California, U.S. District Court Case No. 2:18-cv-00490-JAM-KJN ("Lawsuit"), in the United States District Court, Eastern District of California. The Complaint seeks declaratory judgments that these state laws violate the Supremacy Clause of the United States Constitution and are therefore invalid and unenforceable. The Complaint further seeks t hat the Court issue preliminary and permanent injunctions prohibiting enforcement of these laws. The City of Carlsbad has a direct interest in the outcome of the United States litigation, in that, the city's power with respect to municipal affairs is subject only to the limitations and restrictions provided in its Charter, in the Constitution of the State of California, and in t he laws of the United Stat es. The City Council opposes California's "sanctuary st ate" laws because t hey negatively impact public safety by limit ing cooperation between local law enforcement personnel and federal immigration officials. June 12, 2018 Item #5 Page 2 of 5 Next Steps The City Attorney's Office will file or join an amicus curiae brief on behalf ofthe City of Carlsbad in support of the United States upon appeal of the lawsuit, United States of America v. State of California. Fiscal Analysis No city funding is being requested at this time. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of the California Environmental Quality Act (CEQA) in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act (California Government Code Section 54950 et seq.), published and distributed at least 72 hours prior to the meeting date and time. Exhibits 1. CALIFORNIA Exhibit 1 WHEREAS, in 2017, the State of California passed three laws that provide protections for persons residing in California without the permission of the United States; and WHEREAS, AB 450 prohibits California employers from voluntarily allowing federal immigration enforcement agents into non-public worksite areas without a judicial warrant; prohibits employers from providing immigration enforcement agents access to employee records without a subpoena or judicial warrant; and allows for penalties upto $10,000 per violation; and WHEREAS, AB 103 prohibits cities and counties from entering into contracts with the federal government or any federal agency to house or detain adult and minor noncitizens in a locked detention facility for purposes of civil immigration custody; requires the California Attorney General to engage in reviews of county, local, or private locked detention facilities in which noncitizens are being housed or detained for purposes of civil immigration proceedings; and requires the Department of Justice to provide the State Legislature and the Governor with an annual written summary of findings concerning the conditions of confinement, the standard of care and due process provided to detainees, and the circumstances of their apprehension and transfer to the facility; and WHEREAS, SB 54, also known as the "California Values Act," prohibits state, county and local law enforcement agencies from using agency moneys or personnel to investigate, interrogate, detain, detect, or arrest persons for immigration enforcement purposes; prohibits placing peace officers under the supervision of federal agencies for purposes of immigration enforcement; and June 12, 2018 Item #5 Page 4 of 5 prohibits the transfer of individuals to federal immigration authorities unless authorized by a judicial warrant or probable cause determination; and WHEREAS, on March 6, 2018, the United States of America filed a civil Complaint against the State of California, Governor Brown, and Xavier Becerra, the State Attorney General, in United States v. Everyone I know is on emotional overload from the bizarre and mean spirited antics of the current administration in Washington. I have lived in Carlsbad for several years and it is my respite. But I feel my sweet city slipping away. Why in God's name do you want to remove the Sanctuary status? What harm is it doing? Can't we do this one thing to show some humanity? The people you are hurting are some of the finest people I've ever met. They are our gardeners, our housekeepers, our craftsmen, their children go .to school with our children and they are always there to lend a helping hand to us. Can we not do the same for them for them?? I can't bear to hear another story about children being separated from their parents ..... about refugees being refused because they are victims of a "private" crime ..... domestic abuse ... or about the holding areas being so full that they are being housed in prisons. I implore you to please leave things the way they are. Use your hearts on this' vote and allow us some relief from the upheaval we face every day. There is no need to do this. I looked over the 'sanctuary state' law and it , protects the public from undocumented immigrants that have done crimes that could endanger the public if they were released. · \ However City Council members feel about the sanctuary state issue or undocumented immigrants, this proposed resolution does nothing to make our city or county 'safer' from crime. What it does do is increase the divisiveness and fear that is brewing in our community-and other communities-about immigrants. What it does do is increase the fear and dislike of immigrants-these will be the constituents that will suffer from misguided anti-immigrant policies. This reminds me of the anti-gay initiatives circulated in the 1990s in Colorado, Oregon, and Idaho; the groups promoting these initiatives said this was needed in order to protect communities and children from gay people who were perceived to be pedophiles. There was no evidence that gay people were more likely to be pedophiles, and also, there were laws in place to protect children against pedophiles. I lived in Idaho and Oregon at that time and I can say that the result of these initiatives was extreme divisiveness and fear in our communities. As well as boycotts and decreased tourism. Do we want our great city of Carlsbad to be associated with intolerance? Many of the people promoting anti-sanctuary city activities are associated with racist groups. Do we want to be associated with these groups? Our city is doing so well economically; people do choose what cities they wish to visit and spend their money. This would be a stain on Carlsbad. Do not support the anti-sanctuary state movements. However, if Carlsbad thinks its job is to take sides on·divisive, culture-war issues, thereby helping to normalize a President who is undermining our Democracy, we will stop spending money in the Village. J That would be sad. We have always felt that the Carlsbad City Council was generally pretty practical. For example, here in Oceanside, we had to elect Councilman Chuck Lowery (now Deputy Mayor) to get a 3-person majority (Chuck, Esther, and Mayor Wood) to have an ordinance to stop smoking at outside restaurants. Carlsbad had that for many years before Chuck was elected. You have always been helpful to your businesses. However, this new discussion is NOT helpful to your businesses. We can easily stop going to the Village. Please keep in mind that people that don't live in Carlsbad still matter to Carlsbad. The Village is a gem. But we can and will avoid it for the good of our country. To join the Department of Justice in opposing this legislation by filing an amicus brief while the case is already in the appellate courts, seems still to be a textbook case of mission creep on the part of a city government. I lived in Arizona to see the disastrous effects upon the tourism industry when the state passed the infamous SB 1070. Though this legislation was the polar opposite of SB 54, it did establish precedents that the Supreme Court will follow if SB 54 makes it on their docket. These decisions will be made regardless of the opinion of the Carlsbad City Council. To associate this community in a non effectual way with one of the most divisive issues imaginable, seems utterly insane in view of the potential adverse effect on our shared business interests. In addition this is not an action that is in response to any form of organic community demand for joining the DOJ action. The preponderant majority speaking at the May workshop in favor of this action were non residents who had no interest in the matter, but to add another domino in their quest to divide us against one another. My remarks at that meeting addressed the history of anti immigrant fervor in our country, and how this issue has antecedents going back to Biblical times. Looking back with that perspective, it seems insane to embroil the residents of Carlsbad in a matter our City Council's intervention will not solve. On occasion we hear the term "the Carlsbad Way'' invoked. I would submit that however one seeks to define the term, filing an amicus brief in a suit already being litigated by the DOJ, does not promote our shared best instincts or the common good. Our City needs to work together with all law enforcement agencies .. The Sanctuary State is NOT safer for our citizens, law enforcement agencies, our first responders or undocumented immigrants. Picking and choosing laws is dangerous we need to give our law enforcement agencies all the tools that are available to ensure safety. Had we had more cooperation within law enforcement agencies on 9/11 maybe we could have prevented this horrible tragedy. If San Francisco had worked with all law enforcement agencies, Kate Stinely would be here today. I was appalled at the nastiness and rudeness of the people that supported No on Resolution SB- 54 both in the Council Chamber, as well as in the waiting area and walking to our cars. I appreciate that their are others that I may not agree with, but I do not resort to name calling or verbal threats. This is not like Carlsbad to be so rude, vicious and vindictive. Many of the speakers on June 12 alluded to the fact that there were numerous people that supported the Resolution at the May meeting that were from out of town. I noted at the meeting on June 12 that there were many speakers that were in attendance that were not residents of Carlsbad. This was a hot button with the No on SB-54 group, but they certainly filled the room with speakers that were from outside Carlsbad. Many of the people that attended used the comments that they feared for their safety and the safety of their children. Our law enforcement protects our citizens and non-Citizens. If you commit a crime or break the law whether you are a citizen or not you get separated from your family. Our police force does not go looking for undocumented people just to separate families. They go looking for people that commit crimes. So if someone fears for their safety, they should not commit crimes. I was taken aback by the treats that were yelled at our council when the resolution was passed. Thank you Carlsbad for supporting SB-54. All three of these laws remain the law of the land and we expect all corresponding agencies in Carlsbad to fully comply with them. The actions taken by the City of Escondido and the San Diego Board of Supervisors in recent weeks to join the federal lawsuit against California are not representative of the values we hold dear as a county or a state. This lawsuit is a direct attack on immigrant communities and is completely baseless. Here in Carlsbad, we know that immigrants are a vital part of our families and communities.They are the ones working in the back kitchens, picking your fruits and vegetables. We need a local government that upholds state laws with fidelity and transparency, not one that undermines our laws and seeks publicity stunts. This is not what Carlsbad stands for. Stop the separation of families, stop feeding into the deportation machine and assisting ICE to fulfill the quota. The reason for the increased migration of children, other and families is due to the United States imperialistic foreign policies in Latin America. As a constituent of yours, I expect my local governing body to stand on the right side of history and not play into the Trump administration's political and divisive games that hurt the very constituents you are meant to serve. Stand with your constituents and migrant families. I live in Oceanside but I buy many goods and love the farmers market. Please make us proud by standing with families.
