Subject: The Mutual Threat Zone Cooperative Fire Protection Agreement
Recommended Action
Adopt a Resolution approving the Mutual Threat Zone Cooperative Fire Protection (MTZ)
Agreement between the Carlsbad Fire Department and the California Department of Forestry
and Fire Protection-San Diego Unit (CAL FIRE), and authorizing the Fire Chief, on behalf of the
City, to execute a Mutual Threat Zone Cooperative Fire Protection Agreement with CAL FIRE for
the area illustrated in Exhibit 2. '
Executive Summary
The pre-designation of Mutual Threat Zone lands between the Carlsbad Fire Department and CAL
FIRE will provide emergency responders and incident managers a more efficient and objective
determination regarding the jurisdictional threat assessment processes. In the best interest, and
to the benefit of all citizens of Carlsbad, public agencies with support capability and/or
emergency operation responsibilities should provide prompt inter-agency notifications and
coordinated communications. In addition, a unified command process is necessary to effectively
mitigate the effects of multi-agency emergencies to enhance public and first responder safety.
Adoption of this Resolution would allow for increased resource allocation immediately upon
notification of critical wildfire threat to the community.
Discussion
The MTZ Agreement is a cooperative fire protection agreement between the Carlsbad Fire
Department and CAL FIRE identifying Local Responsibility Area (LRA or Carlsbad) lands wherein
any wild land fires occurring would constitute a direct threat to State Responsibility Area (SRA or
CAL FIRE) lands. This pre-designation of Mutual Threat Zone lands provides emergency
responders and incident managers a more efficient and objective determination regarding
jurisdictional threat assessment processes so as not to detract from other incident action needs.
The agreement will assist both agencies with providing prompt notification of incidents that are
within, or a threat to any jurisdictional or functional responsibilities, assist with stronger
coordination of initial response communications, and establish a unified command and unified
resource ordering process. This will save time during the critical early moments of a wild land fire
and provide for more efficient and cohesive initial scene actions between all responders and
affected communication centers. As part of the Agreement there is a predesignated

Communication Plan (Exhibit 3) placing all responding personnel on common radio frequencies
from the point of initial notification.
Fiscal Analysis
The Carlsbad Fire Department and CAL FIRE agree that consideration of cost share shall be
determined during extended (an operation period greater than 12 hours) or major fire incidents.
Such costs will be determined through a separate agreement outside of the MTZ agreement.
These agreements may include a Fire Management Assistance Grant {FMAG) or the California
Fire Assistance Agreement (CFAA).
Next Steps
The Fire Chief, on behalf of the City, and the CAL FIRE Unit Chief execute the Mutual Threat Zone
Cooperative Fire Protection Agreement. Once the Agreement is executed, all critical fire
incidents in the Mutual Threat Zone will have increased response capabilities, common
communications, a unified command, and unified ordering process.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change in
the environment, or a reasonably foreseeable indirect physical change in the environment, and
therefore does not require further environmental review.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was ava ilable for public
viewing and review at least 72 hours prior to the scheduled meeting date.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE MUTUTAL THREAT ZONE COOPERATIVE FIRE
PROTECTION (MTZ) AGREEMENT BETWEEN THE CARLSBAD FIRE
DEPARTMENT AND CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE
PROTECTION -SAN DIEGO UNIT (CAL FIRE), AND AUTHORIZING THE FIRE
CHIEF, ON BEHALF OF THE CITY, TO EXECUTE THE MTZ WITH CAL FIRE
WHEREAS, the City Council of the City of Carlsbad, California has determined that the Carlsbad
Fire Department maintains and operates a fire protection organization in the area generally known as
Carlsbad; and
WHEREAS, CAL FIRE maintains and operates a fire protection organization for providing "basic"
protection to the State Responsibility Area Lands; and
WHEREAS, the Mutual Threat Zone Fire Protection Agreement is a cooperative fire protection
agreement between the Carlsbad Fire Department and CAL FIRE identifying Local Responsibility Area
lands wherein any wild land fires occurring would constitute a direct threat to State Responsibility Area
lands; and
WHEREAS, the pre-designation of Mutual Threat Zone lands provides emergency responders

Threat Zone Cooperative Fire Protection Agreement with CAL FIRE (Attachment A).

MUTUAL THREAT ZONE AGREEMENT
This is a COOPERATIVE FIRE PROTECTION AGREEMENT between CITY OF
CARLSBAD FIRE DEPARTMENT, hereinafter referred to as DEPARTMENT, and the
STATE OF CALIFORNIA DEPARTMENT OF FORESTY AND FIRE PROTECTION
(San Diego Unit), hereinafter referred to as CAL FIRE.
WHEREAS, DEPARTMENT maintains and operates a fire protection
organization in the area generally known as CARLSBAD; and
WHEREAS, CALFIRE maintains and operates a fire protection organization for
the purpose of providing 'basic" protection to the State Responsibility Area lands.
NOW THEREFORE, the parties hereto mutually agree as follows:
1. DEPARTMENT and CAL FIRE agree to the Mutual Threat Zone as
defined on map (Exhibit 3).
2. DEPARTMENT and CAL FIRE agree to provide timely notification of
fire emergency incidents/threats to the other agency through established
procedures in each agency Command/Communication Center.
3. DEPARTMENT and CAL FIRE agree to utilize the assigned VHF frequencies
as defined in the Mutual Threat Zone Communications Plan (Exhibit 4) for
incidents within the Mutual Threat Zone.
4. DEPARTMENT and CAL FIRE agree to a single Unified Ordering Point pre-
determined as the Monte Vista Emergency Command Center (MVICC).
5. DEPARTMENT and CAL FIRE agree to utilize Unified Command based on
Mutual Threat Zone jurisdictional authority or threat to Jurisdictional Authority.
6. DEPARTMENT and CAL FIRE agree that consideration of Cost Share shall be
determined during extended (operation period greater than 12 hours) or major
fire incidents. Such costs will be determined through a separate agreement
outside of this Mutual Threat Zone agreement.

Attachment A
7. Each party hereto shall indemnify, defend, save and hold harmless the
other parties, and each of them and their respective agents, servants and
employees, of and from any and all liabilities, claims, demands, debts,
suits, actions and causes of action arising out of, or in any manner
connected with, any act or omission of such indemnifying party
hereunder or its agents, servants, or employees, done or performed
pursuant to the terms and condition hereof or arising upon or within the
property of such indemnifying party as herein set forth after the date of
expiration of the Agreement.
8. Except as may be provided by separate written agreement between the
parties, neither party shall be obligated to reimburse hereunder, or for any
use of material, damage to equipment, or liability incurred which may
occur in the course of rendering the firefighting assistance herein provided.
9. Nothing contained herein shall be construed as a contract under law or
equity for the benefit of any third party, which may be affected by the
Agreement.
I 0. Nothing in this agreement shall preclude either party from exercising its right
to seek recovery of costs pursuant to Health and Safety Code sections 13009
and 13009.01.
11. Either party may terminate or modify this Agreement upon ninety (90)
days written notice to the other party that year.

Incident Radio Communications Plan
Purpose. The Incident Radio Communications Plan (ICS 205) provides information on all radio frequency or trunked
radio system talkgroup assignments for each operational period. The plan is a summary of information obtained about
available radio frequencies or talkgroups and the assignments of those resources by the Communications Unit Leader for
use by incident responders. Information from the Incident Radio Communications Plan on frequency or talkgroup
assignments is normally placed on the Assignment List (ICS 204).
Preparation. The ICS 205 is prepared by the Communications Unit Leader and given to the Planning Section Chief for
inclusion in the Incident Action Plan.
Distribution. The ICS 205 is duplicated and attached to the Incident Objectives (ICS 202) and given to all recipients as
part of the Incident Action Plan (IAP). All completed original forms must be given to the Documentation Unit. Information
from the ICS 205 is placed on Assignment Lists.
Notes:
• The ICS 205 is used to provide, in one location, information on all radio frequency assignments down to the
Division/Group level for each operational period.
• The ICS 205 serves as part of the IAP.

RX (Receive) Frequency Enter the Receive Frequency (RX Freq) as the mobile or portable subscriber
(N orW) . would be programmed using xxx.xxxx out to four decimal places, followed by
an "N" designating narrowband or a "W" designating wideband emissions.
The name of the specific trunked radio system with which the talkgroup is
associated may be entered across all fields on the ICS 205 normally used
for conventional channel programming information.
RX Tone/NAC Enter the Receive Continuous Tone Coded Squelch System (CTCSS)
subaudible tone (RX Tone) or Network Access Code (RX NAC) for the
receive frequency as the mobile or portable subscriber would be
