Recommended Action
Hold a public hearing and adopt a resolution approving the third amendment to Site
Development Plan SDP 96-01 and Coastal Development Permit CDP 96-02 to allow for the
construction of 29 additional hotel units within the existing Grand Pacific Palisades Resort
property located at 5803 and 5805 Armada Drive.
Executive Summary
The applicant, Timothy Stripe, Grand Pacific Palisades Hotel, L.P., is seeking approval of a three-
story 26,311 square feet (sq. ft.) addition to the existing hotel in place of the existing 4,379 sq.
ft. conference center, which will be demolished. The project will add 29 hotel units, which will
increase the number of resort units (hotel rooms and timeshares) on-site from 251 to the 280-
unit maximum (119 hotel rooms and 161 timeshare units) planned per the Carlsbad Ranch
Specific Plan.
Discussion
The project site is located on the west side of Armada Drive, north of Palomar Airport Road (see
E;xhibit 2), and comprises the 12.2-acre Planning Area 3 of the Carlsbad Ranch Specific Plan, in
the Mello II Segment ofthe Local Coastal Program and Local Facilities Management Zone 13.
Development ofthe site was allowed per the Grand Pacific Palisades Resort (SDP 96-0l(B)/CT
96-01/PUD96-11/CDP 96-02(8)) entitlement approvals. Site improvements include a 90-unit
hotel, 161 timeshare units, a 4,379-sqare foot conference center, a 7,618-square foot
restaurant (Karl Strauss Brewing Company), and 462 parking spaces (at grade and
subterranean). The Carlsbad Ranch Specific Plan permits the development of 280 resort units
(hotel and/or timeshare) for the site.
The project will add 29 hotel units, which will increase the number of resort units on-site from
251 to the 280-unit maximum planned. The hotel addition continues the Mediterranean
architecture existing on the site and required per the Carlsbad Ranch Specific Plan. Access to
the additional hotel units will be provided through the main hotel entry. The pad elevation will
be raised five feet for the addition to maintain the same finished floor elevation with the

existing hotel building. A grading plan will be required for the 25 cubic yards of cut and 2,137
cubic yards of fill required to raise the pad elevation. Additional parking is not required because
previous development of the site anticipated future hotel expansion. Construction of the hotel
addition will maintain a surplus of 13 parking spaces.
The project is consistent with zoning regulations and the General Plan. The project meets
building setback standards, is below maximum building coverage, and the majority of the
building is below the maximum height of 45 feet at 42'-6". An architectural tower at the center
of the addition on the north elevation is the only feature that exceeds the 45-foot height limit
and is 46 feet tall. This architectural feature meets the required findings for approval because it
does not exceed three percent of the total roof area, is not usable floor area, does not screen
equipment, will not impact adjacent properties, and is necessary for the hotel's design
excellence. Staff's full analysis of consistency with zoning regulations, Carlsbad Ranch Specific
Plan, and the General Plan is contained in the attached Planning Commission staff report dated
May 16, 2018.
On May 16, 2018, the Planning Commission approved Resolution No. 7295 by a vote of 6-0 (one
Commissioner seat vacant) recommending approval of the project to the City Council. No members of
the public spoke about the project.
Fiscal Analysis
All required improvements needed to serve this project would be funded and/or constructed by
the developer.
Next Steps
The City Council's action on this item is final. ,
Environmental Evaluation (CEQA)
The project is exempt from the requirements of the California Environmental Quality Act
(CEQA) pursuant to Section 15332 (In-fill Development Projects). Furthermore; any potential
environmental effects of the project were adequately analyzed by the previously Certified EIR
for the Carlsbad Ranch Specific Plan -SP 207 /EIR 94-01. A Notice of Exemption will be filed by
the City Planner upon project approval.
Climate Action Plan (CAP) Consistency
The project is not subject to Climate Action Plan measures because the project is below the
screening threshold of 900 MTC02e; therefore, the project is not subject to the Climate Action
Plan (Section 5.3).

WHEREAS, the City Council of the City of Carlsbad, California has determined that pursuant to
the provisions of the Municipal Code, the Planning Commission did, on May 16, 2018, hold a duly-
noticed public hearing as prescribed by law to consider the third amendment to Site Development Plan
SOP 96-01 and Coastal Development Permit CDP 96-02, as referenced in Planning Commission
Resolution No. 7295; and the Planning Commission adopted Planning Commission Resolution No. 7295
recommending to the City Council that it be approved; and
WHEREAS the City Council of the City of Carlsbad held a duly-noticed public hearing to consider
said third amendment to the Site Development Plan and Coastal Development Permit; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if
any, of all persons desiring to be heard, the City Council considered all factors relating to the third
amendment to the Site Development Plan and Coastal Development Permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the approval of the third
amendment to Site Development Plan SDP 96-01 and Coastal Development Permit CDP 96-02 is
approved, and that the findings and conditions of the Planning Commission contained in Planning
Commission Resolution No. 7295 on file with the City Clerk and incorporated herein by reference, are
the findings and conditions of the City Council.
3. This action is final the date this resolution is adopted by the City Council. The Provisions
of Chapter 1.16 ofthe Carlsbad Municipal Code, "Time Limits for Judicial Review" shall apply:

WHEREAS, on June 6, 2000, the City Council approved SDP 96-0l(A) / CDP 96-02(A) -
GRAND PACIFIC PALISADES RESORT, to allow for the addition of 24 hotel rooms for the existing Grand
Pacific Palisades Resort, as described and conditioned in City Council Resolution No. 2000-181; this
project was not constructed and the entitlements have expired; and
WHEREAS, on August 6, 2006, the City Council approved SDP 96-0l(B) / CDP 96-02(8) -
GRAND PACIFIC PALISADES RESORT, to extend the deadline for issuance of building permits and to allow
20 hotel units and 1,600 square feet of meeting space for the existing Grand Pacific Palisades Resort, as
described and conditioned in City Council Resolution No. 2002-238; this project was not constructed ;rnd
the entitlements have expired; and
WHEREAS, the Pl,anning Commission did, on May 16, 2018, hold a duly noticed public
hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to
the third site Development Plan Amendment and Coastal Development Permit Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of
Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B)
Findings:
That based on the evidence presented at the public hearing, the Planning Commission
RECOMMENDS APPROVAL of AMEND 2017-0020 / AMEND 2017-0021 -GRAND
PACIFIC PALISADES RESORT based on the following findings and subject to the following
conditions:
SITE DEVELOPMENT PLAN AMEND 2017-0020 (SDP 96-0l(B))
1. That the proposed development or use is consistent with the General Plan and any applicable
master plan or specific plan, complies with all applicable provisions of Chapter 21.06 of the
Carlsbad Municipal Code, and all other ap'plicable provisions of this code, in that the project is a
request for the construction of a hotel addition, which is an encouraged and allowed use within
the Visitor Commercial General Plan Land Use designation and the permitted land uses specified
for Planning Area 3 of the Carlsbad Ranch Specific Plan. As specified in the Carlsbad Ranch
Specific Plan, Planning Area 3, buildings that exceed 35 feet in height are not required to
increase their setbacks since the setback requirements for Planning Area 3 {30~foot front yard
setback and 25-foot side yard setbacks) are far greater than the requirement of the C-T Zone.

The proposed building at 42'-6", with an architectural tower feature that protrudes to 46 feet
in height, is allowed because it meets all of the criteria for approval as discussed in finding 4
below. All other aspects of the project are consistent with the requirements of the Carlsbad
Ranch Specific Plan and Carlsbad Municipal Code.
That the requested development or use is properly related to the site, surroundings and
environmental settings, will not be detrimental to existing development or uses or to
development or uses specifically permitted in the area in which the proposed development or use
is to be located, and will not adversely impact the site, surroundings or traffic circulation, in that
the proposed hotel expansion is compatible with, and an extension of, the existing hotel use.
Therefore, it will not adversely impact adjacent properties. The hotel has an articulated design
that is of a Mediterranean architectural style as required by the Carlsbad Ranch Specific Plan,
and will be constructed of durable, high-quality building materials. The project will not affect
the site's existing access, circulation and parking.
That the site for the intended development or use is adequate in size and shape to accommodate
the use, in that the subject site is adequate in size and shape to accommodate the proposed
hotel expansion and will comply with the required development and design standards of the
Carlsbad Ranch Specific Plan. No variances to standards are proposed. Increased roof heights
were previously approved for the project site and the additional height allows the addition to
continue the 4:12 pitched roof at the same height, which ensures the building's design
excellence. The proposed building at 42'-6" in height, with an architectural tower feature that
protrudes to 46 feet in height, meets the required approval criteria as discussed in finding 4
below. The hotel addition will increase the total building coverage to 48 percent, whereas 50
percent is allowed. The hotel site is conveniently located off Armada Drive and adjacent to the
Legoland California Resort Theme Park, Flower Fields, and convenient access and parking is
currently provided on-site.
That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the
requested development or use to existing or permitted future development or use in the
neighborhood will be provided and maintained, in that the site functions as a component of the
Carlsbad Ranch Specific Plan's allowed Commercial Tourist serving uses. The project has been
designed in accordance with all development and design standards of the Specific Plan;
therefore, the project is compatible with the existing Grand Pacific Palisades Resort.
Furthermore, the proposed hotel expansion will be set back from the easterly property line
(abutting Armada Drive) a minimum of 40 feet and landscaping will be provided and
maintained. Adequate circulation, access aisles, and parking spaces exist on-site and will not
be changed. The h.otel is three stories, but its 42'-6" height exceeds the maximum 35 foot height
limit. The Grand Pacific Palisades Resort has previously been approved to construct structures
over 35 feet in height because the setback requirements for Planning Area 3 (30-foot front yard
setback and 25-foot side yard setbacks) are far greater than the requirement of the C-T Zone.
The 40-foot front yard setback and 26-foot side yard setback are sufficient for the proposed 42'-
6" tall hotel expansion. Almost all architectural features meet the permitted 45-foot height
limit for these protrusions. However, the tower at the center of the addition is an architectural
feature that exceeds the height limit, and is 46 feet in height. This tower meets the required
findings for approval because:
a. The 96 square foot area is only one percent of the total roof area, which is well under
the maximum allowable three percent of the total roof area.
b. There is no usable floor area within the portion of the tower that exceeds 45 feet.

The increased height is not for the purpose of screening roof equipment, since no
equipment is proposed within the tower's parapets.
The tower will not impact adjacent properties because the tower feature is within the
Grand Pacific Palisades Resort site and, is not near any adjacent properties.
The tower is necessary for the hotel's design excellence because it is a key feature of
the Mediterranean architectural style of the hotel, it is proportional to and in scale with
the rest of the hotel, and adds visual interest to the architecture of the building.
That the street systems serving the proposed development or use is adequate to properly handle
all traffic generated by the proposed use, in that primary access to the site will continue to be
provided from Armada Drive via the main entrance to Grand Pacific Palisades Resort. Armada
Drive is adequate in size to handle the proposed 232 Average Daily Trips {ADT) in traffic that
will be generated by the 29 additional hotel units. The total ADT for the site with the 29
additional hotel units is 3,002 ADT. The maximum ADT planned for the resort per the Carlsbad
Ranch Specific Plan was 3,600 ADT. As such, the street system serving the proposed use will be
adequate to handle the increase in traffic generated by the proposed project.

That the proposed development is in conformance with the Certified Local Coastal Program and
all applicable policies in that no impacts to any physical features, such as scenic resources,
environmentally sensitive areas, or geologic features, will occur as none exist on the essentially
flat and previously developed site. The project will replace an existing building and no distant
or coastal views would be obstructed from public lands or roadways.
The proposal is in conformity with the public access and recreation policies of Chapter 3 of the
Coastal Act in that the property is not near the shore and there are no public access or public
recreation requirements for the property.
The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone
(Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master
Drainage Plan, Grading Ordinance, Storm Water Ordinance, BMP Design Manual and Jurisdictional
Runoff Management·-Program (JRMP) to avoid increased urban runoff, pollutants, and soil
erosion. No steep slopes or native vegetation is located on the subject property and the site is
not located in an area prone to landslides, or susceptible to accelerated erosion, floods, or
liquefaction.
The project is consistent with the adopted Airport Land Use Compatibility Plan for the McClellan-
Palomar Airport (ALUCP), dated December 1, 2011, in that.:
a. The proposed project is located within the 60-65 dB CNEL noise contour. The proposed
hotel addition is considered conditionally compatible with the 60-65 CNEL contour in
the ALUCP. The ALUCP identifies that the outdoor noise levels are acceptable for the
hotel land use and associated outdoor activities. However, interior noise levels shall be
attenuated to 45 CNEL for the hotel use. A condition of approval is included to require
interior noise level compliance prior to building permit issuance to ensure the noise
levels are attenuated.

The proposed project is in compliance with the ALUCP airspace protection surfaces
because the maximum height of the hotel ,including protrusions is well below the height
that requires notification of construction to the FAA.
The proposed project is located within Safety Zone 6. The ALUCP identifies lodging uses
located within Safety Zone 6 as compatible with airport uses.
The proposed project is located within the overflight notification area. The ALUCP
requires recordation of an overflight notification only for new residential uses.
However, previous project approvals required, and the developer recorded, a "Notice
Concerning Aircraft Environmental Impacts" for the resort.
That the project is consistent with the City-Wide Facilities and Improvements Plan, the Local
Facilities Management Plan for Zone 13 and all city public facility policies and ordinances. The
project includes elements or has been conditioned to construct or provide funding to ensure that
all facilities and improvements regarding: sewer collection and treatment; water; drainage;
circulation; fire; schools; parks and other recreational facilities; libraries; government
administrative facilities; and open space, related to the project will be installed to serve new
development prior to or concurrent with need.
That the project is consistent with the City's Landscape Manual and Water Efficient Landscape
Ordinance {Carlsbad Municipal Code Chapter 18.50).
That the city planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically· exempt from the requirement for the preparation of environmental
documents pursuant to Section 15332 -In-fill Development Projects of the state CEQA
Guidelines. In making this determination, the City Planner has found that the exceptions listed in
Section 15300.2 of the state CEQA Guidelines do not apply to this project. Furthermore, any
potential environmental effects of the project were adequately analyzed by the previously
Certified EIR for the Carlsbad Ranch Specific Plan -SP 207 /EIR 94-01.
The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed to
mitigate impacts caused by or reasonably related to the project, and the extent and the degree
of the exaction is in rough proportionality to the impact caused by the project.
Conditions:
Note: Unless otherwise specified herein, all conditions shall be satisfied prior to approval of a building
22 or grading permit, whichever occurs first.

1. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented
and maintained over time, if any of such conditions fail to be so implemented and maintained
according to their terms, the city shall have the right to revoke or modify all approvals herein
granted; deny or further condition issuance of all future building permits; deny, revoke, or further
condition all certificates of occupancy issued under the authority of approvals herein granted;
record a notice of violation on the property title; institute and prosecute litigation to compel their
compliance with said conditions or seek damages for their violation. No vested rights are gained
by Developer or a successor in interest by the city's approval of this third amendment to Site
Development Plan SDP 96-01 and Coastal Development Permit CDP 96-02.

Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the Site Development Plan Amendment and Coastal Development Permit
Amendment documents, as necessary to make them internally consistent and in conformity with
the final action on the project. Development shall occur substantially as shown on the approved
exhibits. Any proposed development, different from this approval, shall require an amendment
to this approval.
Developer shall comply with all applicable prov1s1ons of federal, state, and local laws and
regulations in effect at the time of building permit issuance.
If any condition for construction of any public improvements or facilities, or the payment of any
fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged,
this approval shall be suspended as provided in Government Code Section 66020. If any such
condition is determined to be invalid, this approval shall be invalid unless the City Council
determines that the project without the condition complies with all requirements of law.
Developer/Operator shall and does hereby agree to indemnify, pr9tect, defend, and hold
harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims and
costs, including court costs and attorney's fees incurred by the city arising, directly or indirectly,
from (a) city's approval and issuance of this Site Development Plan Amendment and Coastal
Development Permit Amendment, (b) city's approval or issuance of any permit or action,
whether discretionary or nondiscretionary, in connection with the use contemplated herein, and
(c) developer/operator's installation and operation of the facility permitted hereby, including
without limitation, any and all liabilities arising from the emission by the facility of
electromagnetic fields or other energy waves or emissions. This obligation survives until all legal
proceedings have been concluded and continues even if the city's approval is not validated.
Prior to submittal of the building plans, improvement plans, or grading plans, whichever occurs
first, Developer shall submit to the city planner, a 24" x 36" copy of the Site Plan sheets,
conceptual grading plan and preliminary utility plan reflecting the conditions approved by the final
decision-making body. The. copy shall be submitted to the city planner, reviewed and, if found
acceptable, signed by the city's project planner and project engineer. If no changes were required,
the approved exhibits shall fulfill this condition.
Prior to the issuance of a building permit, the Developer shall provide proof to the Building
Division from the Carlsbad Unified School District that this project has satisfied its obligation to
provide school facilities ..
This project shall comply with all conditions and mitigation measures which are required as part
of the Zone 13 Local Facilities Management Plan and any amendments made to that Plan prior to
the issuance of building permits.
This approval shall become null and void if building permits are not issued for this project within
24 months from the date of project approval.
10. Building permits will not be issued for this project unless the local agency providing water and
sewer services to the project provides written certification to the city that adequate water service
and sewer facilities, respectively, are available to the project at the time of the application for the
building permit, and that water and sewer capacity and facilities will continue to be available until
the time of occupancy.

Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the
License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFO
#1 special tax (if applicable}, subject to any credits authorized by Carlsbad Municipal Code Section
5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone
13, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. If
the taxes/fees are not paid, this approval will not be consistent with the General Plan and shall
become void.
Prior to the issuance of the grading permit, Developer shall submit to the city a Notice of
Restriction executed by the owner of the real property to be developed. Said notice is to be filed
in the office of the county recorder, subject to the satisfaction of the city planner, notifying all
interested parties and successors in interest that the City of Carlsbad has issued a(n) Site
Development Plan Amendment and Coastal Development Permit Amendment by Resolution
No. 7295 on the property. Said Notice of Restriction shall note the property description, location
of the file containing complete project details and all conditions of approval as well as any
conditions or restrictions specified for inclusion in the Notice of Restriction. The city planner has
the authority to execute and record an amendment to the notice which modifies or terminates
said notice upon a showing of good cause by the Developer or successor in interest.
Developer shall submit and obtain city planner approval of a Final Landscape and Irrigation Plan
showing conformance with the approved Preliminary Landscape Plan and the city's Landscape
Manual. Developer shall construct and install all landscaping and irrigation as shown on the
approved Final Plans. All landscaping shall be maintained in a healthy and thriving condition, free
from weeds, trash, and debris. All irrigation systems shall be maintained to provide the optimum
amount of water to the landscape for plant growth without causing soil erosion and runoff.
The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the landscape
plancheck process on file in the Planning Division and accompanied by the project's building,
improvement, and grading plans.
All roof appurtenances, with the exception of photo voltaic systems, including air conditioners,
shall be architecturally integrated and concealed from view and the sound buffered from adjacent
properties and streets, in substance as provided in Building Department Policy No. 80-6, to the
satisfaction of the Directors of Community and Economic Development Department and Planning.
No outdoor storage of materials shall occur onsite unless required by the fire chief. When so
required, the Developer shall submit and obtain approval of the fire chief and the city planner of
an Outdoor Storage Plan, and thereafter comply with the approved plan.
Developer shall submit and obtain city planner approval of an exterior lighting plan including
parking areas. All lighting shall be designed to reflect downward and avoid any impacts on
adjacent property.
Prior to issuance of a building permit, the developer shall submit a noise study to the
satisfaction of the city planner and building official demonstrating that the project's interior
no,ise levels will be attenuated to 45 CNEL for the proposed hotel addition.

Developer shall comply with the city's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include but are
not limited to pollution control practices or devices, erosion control to prevent silt runoff during
construction, general housekeeping practices, pollution prevention and educational practices,
maintenance procedures, and other management practices or devices to prevent or reduce the

additional hotel units within the existing Grand Pacific Palisades Resort property located
at 5803 and 5805 Armada Drive in Local Facilities Management Zone 13. The proj~ct site
is located within the Mello II Segment of the city's Coastal Zone, hut is not within the
appealable area of the California Coastal Commission. The City Planner has determined
that the project is exempt from the provisions of CEQA, pursuant to CEQA Categorical .-
Exemption for Infill Development Projects {Section 15332). Furthermore, any potential
environmental effects of the project were adequately analyzed by the previously Certified
EIR for the Carlsbad Ranch Specific Plan -SP207 /EIR 94-01. No additional environmental'
review is required.
I. RECOMMENDATION
That the Planning. Commission ADOPT Planning Commission Resolution No. 7295 RECOMMENDING
APPROVAL of Site Development Plan Amendment AMEND 2017-0020 and Coastal Development Permit
Amend!'llent AMEND 2017-0021 based upon the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The project site is located on the west side of Armada Drive, north of Palomar Airport Road (see attached
location map), and comprises the 12.2-acre Planning Area 3 of the Carlsbad Ranch Specific Plan, in the
Mello II Segment of the Local Coastal Program and Local Facilities Management Zone 13. Development
of the site was allowed per the Grand Pacific Palisades Resort {SDP 96-0l{B)/CT 96-01/PUD96-11/CDP 96-
02(8)) entitlement approvals. Site improvements include a 90-unit hotel,, 161 timeshare units, a 4,379
square foot (sq. ft.) conference center, a 7,618 sq. ft. restaurant (Karl Strauss Brewing Company), and 462
parking spaces (at grade and subterranean). The Carlsbad Ranch Specific Plan anticipated the
development of 280 resort units (hotel and/or timeshare) for th,e site.
The project proposes a three-story 26,311 sq. ft. addition to the existing hotel in place of the existing 4,379
sq. ft. conference center which will be demolished. The project will add 29 hotel units, which will increase
the number of resort units on-site from 251 to the 280-unit maximum planned. The pad elevation would
be raised five feet for the addition to maintain the same finished floor elevation with the existing hotel
building. A grading plan will be required for the 25 cubic yards of cut and 2,137 cubic yards of fill required
to raise the pad elevation. Additional parking is not required b.ecause previous development of the site
anticipated future hotel expansion. A detailed parking discussion is provide_d in the Analysis section
below. The hotel a_ddition continu,es the Mediterranean architecture present for the site and required per
the Carlsbad Ranch Specific Plan. Access to the additional hotel units will be provided through the main
hotel entry.

The Carlsbad Ranch Specific Plan requires that the City Council make the final decision to approve or
disapprove the amended Site Development Plan. The City Council is also the decision-maker on the
proposed roof and architectural feature heights that exceed the height limit subject to findings as
discussed in the Analysis section below. Per Carlsbad Municipal Code (CMC) Section 21.54.040(C)(3)(b),
because the SDP requires City Council action, the CDP amendment also requires a recommendation from
the Planning Commission to the City Council.
Ill. ANALYSIS
The proposed project is subject to the following regulations:
A. Visitor Commercial (VC) General Plan Land Use designation;
B. Commercial Tourist Zone (C-T), Qualified bevelopment Overlay Zone (Q) (Chapters 21.06 and
21.29 of the CMC);

The recommendation for approval of this project was developed by analyzing the 'project's consistency
with the applicable regulations and policies. The project's compliance with each of the above regulations
is discussed in detail in the sections below.
A. General Plan -Visitor Commercial (VC} ·
Planning Area 3 of the Carlsbad Ranch Specific Plan has a General Plan Land Use designation of Visitor
Commercial (VC). The VC land use designates areas for visitor attractions and commercial uses that serve
the travel and recreational needs of tourists and residents as well asemployees of business and industrial
centers. Table B below indicates how the development of the site under. a VC land use designation
complies with the elements of the General Plan.

B. Zoning-Commercial Tourist (C-T), Qualified Development Overlay Zone (Q)
All properties within Planning Area 3 of the Carlsbad Ranch Specific Plan are zoned Commercial Tourist
with the Qualified Development Overlay (C-T-Q). The Qzone requires approval of a SDP. While the project
is subject to the purpose, intent and procedures of the C-T and Q zones, it is subject to the permitted uses
and development standards of the Carlsbad Ranch Specific Plan rather than the zoning urdinance.
The Q zone requires the approval of a SDP for new development projects and an amended SDP for project
modifications. The intent of the overlay is to ensl'.lre that projects will be compatible with surrounding
development. The additional 29 hotel units is a permitted use for the site and will not introduce a new
land use that has not already existed on-site. No special considerations or condjtions are necessary to
ensure that the project will be compatible with the existing development on adjacent properties. The
additional hotel units are similar in character to the existing hotel on-site as well as the other timeshare
and hotel resorts in the immediate area.
The C-T zone establishes land uses that are appropriate for serving the tourist community and their needs
while visiting Carlsbad. The project is a continuation of the hotel use that currently exists on-site. The
hotel project implements the intent of the zone by augmenting the ability of the Grand Pacific Palisades
Resort to serve the needs of tourists visiting Carlsbad. The C-T zone and Specific Plan specify that building
roof heights above the maximum 35 feet may be approved provided the building height does not exceed
45 feet and the building contains no more than three stories. Furthermore, limited architectural features -
up to 55 feet in height may also be approved provided they meet certain findings. The findings are

1. That the proposed development or use is consistent with the General Plan and any applicable
master plan or specific plan, complies with all applicable provisions of Chapter 21.06 of the Carlsbad
Municipal Code, and all other applicable provisions of this code.
The project is a request for the construction of a hotel addition, which is an encouraged and allowed
use within the Visitor Commercial General Plan Land Use designation and the permitted land uses
specified for Planning Area 3 of the Carlsbad Ranch Specific Plan. Planning Area 3 allows buildings
above 35 feet provided the building height does not exceed 45 feet and the building contains no mar~
than three stories. Planning Area 3 does not require increased setbacks for buildings over 35 feet in
height, as required in the C-T Zone, because the setback requirements of Planning Area 3 (30-foot
front yard setback and 25-foot side yard setback) are far greater than the setback requirement of the
C-T Zone (setbacks equivalent to one horizontal foot for every one foot of vertical construction beyond
35 feet). The 40-foot front yard setback and 26-foot side yard setback_ are sufficient setbacks for the
proposed 42'-6" tall hotel expansion, and is below the 45-foot maximum height limit. Furthermore,
the proposed height is consistent with the existing Grand Pacific Palisades Resort hotel, which exceeds
35· feet in height. All architectural features meet the 45-foot height limit except the tower at the . I center of the addition that is_ 46 feet in height. This tower meets the required findings for approval
because it does not exceed three percent of the total roof area, is not .usable floor area, does not.
screen equlpment, will not impact adjacent properties, and is necessary for the hotel1s design
excellence. All other aspects of the project are consistent with the requirements of the Carlsbad
Ranch Specific Plan a'nd Carlsbad Municipal Code.
· 2. That the requested development or use is properly related to the site, surroundings and
environmental settings, will not be detrimental to existing development or uses or to development
or uses specifically permitted in the area in which the proposed development or use is to be located,
and will not adversely impact the site, surroundings or traffic circulation.\
The proposed hotel expansion is compatible with, and an extension of, the existing hotel use.
Therefore, it will not adversely impact adjacent properties. The hotel has an articulated design that
is of a Mediterranean architectural style as required by the Carlsbad Ranch Specific Plan, and will be
constructed of durable, high-quality building materials. The project will not affect the site1s existing
access, circulation and parking. .A
3. That the site for the intended development or use is adequate in size and shape to accommodate
the use.
The subject site is adequate in size and shape to accommodate the proposed hotel expansion and will
comply with the required development and design standards of the Carlsbad Ranch Specific Plan. No
variances to standards are proposed. Increased roof heights were previously approved for the project
site and the additional height allows the a~dition to con_tinue the 4:12 pitched roof at the same height,
which ensures the building's design excellence. The proposed building at 421-6" in height, with an
architectural tower feature that protrudes to 46 feet in height, meets the required approval criteria
· as discussed in finding 4 below. The hotel addition will increase the total building coverage to 48
percent, whereas 50 percent is allowed. The hotel site is conveniently located off Armada Drive and
adjacent to the Legoland California Resort Theme Park, Flower Fields, and convenient access and
parking is currently provided on-site.

4. That all yards, setbacks,~ walls, fences, landscaping, and ot her features necessary to adjust the
requested development or use to existing or permitted future development or use in the
neighborhood will be provided and maintained.
The site functions as a component of the Carlsbad Ranch Specific Plan's allowed Commercial Tourist
serving uses. The project has been designed in accordance with all development and design standards
of the Specific Plan; therefore, the project is compatible with the existing Grand Pacific Palisades
Resort. Furthermore, the proposed hotel expansion will be set back from the easterly property line
(abutting Armada Drive) a minimum of 40 feet and landscaping will be provided and maintained.
Adequate circulation, access aisles, and parking spaces exist on-site and will not be changed. The 40-
foot front yard setback and 26-foot side yard setback are sufficient for the proposed 42'-6" tall hotel
expansion as discussed in finding 1 above.
5. That the street systems serving the proposed development or use is adequate to properly handle
all traffic generated by the proposed use.
Primary access to the site will continue to be provided from Armada Drive via the main entrance to
Grand Pacific Palisades Resort. Armada Drive is adequate in size to handle the proposed 232 Average
Daily Trips (ADT) in traffic that will be generated by the 29 additional hotel units. The total ADT for
the site (including resort and restaurant) with ~he 29 additional hotel units is 3,002 ADT. The
maximum ADT planned for the site per the Carlsbad Ranch Specific Plan was 3,600 ADT. As such, the
street system serving the proposed use will be adequate to handle the increase in traffic generated
by the proposed project.
C. Carlsbad Ranch Specific Plan -SP 207(K)
The subject site is located within Planning Area 3 of the Carlsbad Ranch Specific Plan. As seen in Table C

Prior development of the site, per Grand Pacific Palisades Resort {SOP 96-01/CT 96-01/PUD96-11/CDP 96-
02), accommodated 462 parking spaces {345 subterranean garage parking spaces and 117 at-grade

Therefore, construction of the hotel addition will maintain a surplus of 13 parking spaces. Table D below
shows the breakdown of parking requirements and supply.

D. Mello II Segment of the Local Coastal Program and Coastal Resource Protection Overlay Zone
(Chapter 21.203}
The project site is located within the Mello II Segment of the Local Coastal Program, but is not within the
appealable jurisdiction of the California Coastal Commission. The site is also located within and suoject
to the Coastal Resources Protection Overlay Zone. The project is consistent with the relevant policies of
the Mello II Segment of the Local Coastal Program (LCP} and the Coastal Resource Protection Overlay Zone
as discussed below.
1. Mello II Segment of the Certified Local Coastal Program and all applicable policies
The Specific Plan implements the intent of the Visitor Commercial (VC} General Plan Land Use designation
and LCP Land Use designation. The Carlsbad Ranch Specific Plan is the implementing ordinance for, and
is consistent with, the LCP. The proposed hotel expansion will not result in any conflicts with the
provisions of the LCP. Specific Mello II Land Use Policies that are applicable to this site include Policy 1-1,
Allowable Land Uses; Policy 6-5, Hotel-Motel rooms; Policy 7-10, Parking; and the recently adopted Policy
6-10, Lower Cost Visitor-Serving Recreational Uses. The proposed project is consistent with Pblicy 1-1.
because the proposed hotel use is consistent with the specific list of allowed uses in the Specific Plan and
consistent with the General Plan and Specific Plan land use designations as discussed above. Policy 6-5
discusses the need for additional hotel-motel rooms and visitor-serving commercial uses, and Grand
Pacific Palisades Resort is near one of the suggested locations (1-5 and Palomar Airport Road intersection).
Policy 7-10 addresses parking standards in the CMC. With development of the proposed hotel expansion,
a surplus of 13 parking spaces remain for the site as demonstrated above. To address Policy 6-10, the
applicant prepared an affordable accommodations analysis for the proposed hotel expansion. The
analysis is based on methodologies and assumptions in analyses submitted for other projects and
acc~pted by the California Coastal Commission, with new data pertinent to the current request. The
analysis concludes that, with the combination of free amenities and reduced rates to nearby attractions,
the rates for the Grand Pacific Palisades Resort are within the low cost accommodations category as
compared to the Carlsbad area average during the summer peak months. Notable amenities include
shuttle service to popular visitor destinations as well as rapid transit stations, free wifi, reduced
LEGO LAND tickets and reduced Carlsbad public golf course rates.
The project will replace an existing building and will not obstruct views of the coastline as seen from public
lands or the public _right-of-way, nor otherwise damage the visual beauty of the coastal zone. No
agricultural uses currently exist on the previously developed site, nor are there any sensitive:resources
located on the site. The proposed project is not located in an area of known geologic instability or flood
hazard. Since the site does not have frontage along the coastline, no public opportunities for coastal
shoreline access are available from the subject site. Furthermore, the project site is not suited for water-
oriented recreation activities. Therefore, the project is consistent with the Mello II Segment of the LCP.
2. Coastal Resource Protection Overlay Zone
The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC
Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan,
Grading Ordinance, Storm Water Ordinance, BMP Design Manual and Jurisdictional Runoff Management July 10, 2018 Item #11 Page 24 of 51

Program (JRMP} to avoid increased urban run-off, pollutants and soil erosion. No development is
proposed in areas of natural steep slopes (greater than 25 percent gradient) and no native vegetation is
located on the subject property. In addition, the site is not located in an area prone to landslides, or
suscepfible to accelerated erosion, floods or liquefaction.
E. McClella11-Palomar Airport Land Use Compatibility Plan . '
The project site is located approximately one mile west of the airport. The site is within the Airport
Influence Area Review Area 1, and specifically the 60-65 CNEL noise contour for McClellan-Palomar
Airport. The hotel is considered conditionally compatible with the 60-65 CNEL contour in the Airport Land
Use Compatibility PJan, McClellan-Palomar Airport (ALUCP}. The ALUCP identifies that the outdoor noise
levels are acceptable for the hotel land use and associated outdoor activities. However, interior noise
levels must be attenuated to 45 CNEL for the hotel use. A condition of approval is included in the attached
resolution to require interior noise level compliance prior to building permit issuance to ensure the noise
levels are attenuated. The proposed project is located within the ALUCP Safety Zone 6, and the ALUCP
identifies hotels as compatible uses within this zone. The Grand Pacific Palisades Resort is also within the
Airport Overflight Notification Area, which requires recordation of an overflight notification only for new
residential uses. However, previous project approvals required, and the developer recorded, a "Notice
Concerning Aircraft Environmental Impacts" for the resort. Finally, the hotel's maximum height does not
exceed the threshold for any notification to the Federal Aviation Administration (FAA). Per the FAA's Part
77, Subpart C, height standards shown in Exhibit 111-3 of the ALUCP, the project's proposed height would
need to exceed 481 feet above mean sea level (MSL} before notification to the FAA would be required.
The project proposes a height of no more than 201 feet above MSL, so FAA notification is not required.
F. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code) and focal Facilities
Management Zone 13
The proposed project is located within Local Facilities Management Zone 13. The proposed-'29 unit hotel
addition does not impact public facilities. The project's compliance with the adopted performance
standards are summarized below in Table E.

conditionally-permitted in the HOSP, VC, VG, and FC districts.

support SANDAG's Regional Mobility Hub Strategy cont ained in the San Diego Forward: The
Regional Plan.

Answer: The traffic Safety Commission (TSC) received a presentation on the draft Village
and Barrio Master Plan process on September 8, 2014. The purpose of the presentation was to
inform the TSC about the update process, community outreach steps and overall timeline. Staff
also requested that\the TSC designate a Commissioner or two to participate in the interview
process conducted by the city's consultant team. Commissioners Muir and Hunter agreed to
participate in the interviews.
In addition, the Traffic Safety Commission received a report for discussion and comment on the
draft Village, Barrio and Beach Parking Study and Parking Management Plan on August 7, 2017.
No formal action was taken on the item.
Question 3: Has Caltrans released their guidelines for "cycle tracks"?
Answer: CalTrans issued its initial guidance for Class IV Bikeways (Separated
Bikeways/Cycle Tracks) in December 2015 (Design Information Bulletin No. 89). The
introduction to the guidance states that "The Federal Highway Administration (FHWA)
publication Separated Bike Lane Planning and Design Guide (FHWA Guide) should be used to
design separated bikeways ... The FHWA Guide used the Urban Bikeway Design Guide, a
National Association of City Transportation Officials (NACTO) publication, as part of its source
material. The NACTO publication also provides additional guidance not covered in this DIB
[Design Information Bulletin]. The use of that guidance, coupled with sound engineering
judgment, can be used in collaboration with the guidance in this DIB (p. 1}."
Staff utilized the FHWA guide referenced in the CalTrans DIB in developing the plan level
conceptual recommendations for Class IV Separated Bikeways (Cycle Tracks) in the Master Plan.
Note that Ca IT rans issued updated Class IV Bikeway guidance as DIB 89-01 on May 3, 2018. City
staff will utilize the most current Ca IT rans guidance available at the time project level design
plans are developed.
Question 4: Does the State Department of Alcohol Beverage Control (ABC) have any
standards regulating the concentration/density of alcohol-serving establishments (breweries,
distilleries, wineries, restaurants with alcohol, etc.) in a given geographical location?
Answer: Breweries, wineries, and distilleries are regulated as alcohol manufacturers
and, unlike retail (on-sale or off-sale) licensees, are not subject to license overconcentration
limits for a given area. In other words, there are no spacing requirements or a statutory limit on
the number of licensed beer/wine/distilled spirits manufacturers in a census tract. However,
the local ABC district supervisor advised staff that in their investigation of a manufacturers
license, the ABC will evaluate whether a proposed location is within 100 feet of a residence and
may impose conditions/restrictions on the licensee to mitigate potential impacts to nearby
residents.
Staff was also informed that, unlike for a retail license, the ABC cannot require the
applicant for a beer/ wine/ distilled spirits manufacturer type license to obtain zoning clearance
from the local jurisdiction prior to issuance of the license. It is however, ABC practice to advise
their applicants to check with the locality regarding land use permit requirements. ABC will also
provide notice to the local jurisdiction (typically the police department) when a license

application has been made, but zoning approval is not a pre-requisite to ABC issuance of a non-
retail, manufacturer license.

Additional Material/Information Regarding Staff Report Item #5 -Award of a contract
to Tri Group Construction and Development Inc. for an amount not to exceed $181,000
for the construction of the La Costa Avenue Storm Drain Replacement Program -Storm
Drain Improvements East of Piraeus Street.
The subject staff report includes the approval of a Right of Entry permit (Permit) from the California
Department of Fish and Wildlife (CDFW) to facilitate the construction of the storm drain system. The
Right of Entry permit includes a Restoration Plan, for area~ that may be disturbed during construction,
which was prepared by the City and provided to the CDFW for inclusion in the Permit. The published
version of staff report included an outdated version of the Restoration Plan. The updated/current
version of the Restoration Plan is dated March 2018 and it was prepared to reflect the updated/current
Integrated Pest Management (1PM) plan which was approved by the City Council on December 5, 2017.
The updated Restoration Plan replaces language that referenced the use of glyphosate herbicides and
replaces it with language that is consistent with the city's current 1PM plan.
In particular Sections 3 and 5 of the Restoration plan were revised as follows:
3.0 SITE PREPARATION
Once construction ofthe new storm drain system is complete, site preparation can commence.
3.1 Appropriate erosion control materials (e.g., straw wattles) shall be installed.
3.2 Prior to planting and seeding, all weeds, trash, and debris shall be removed from resto'ration
areas.
3.3 '.'Veeds (nonnative species) shall be killed/eradicated before they reach the seed stage of
grovlth or e:>Eceed e inches in length, whichever occurs first. 'Needs sha!f be eradicated through
hand remo'o<al, or herbicide for those weeds that require herbicide to kill them (e.g., arundo
[Arundo donax], fennel Foeniculum vulgare], etc.). Weeds (nonnative species) shall be
killed/eradicated before they reach the seed stage of growth or exceed 6 inches in length,
whichever occurs fir~t. Weeds shall be eradicated through hand-removal whenever possible.
Removal of difficult, perennial species will be removed using methods consistent with the City's
current Integrated Pest Management Plan (1PM).
3.4 Herbicide shall be a glyphosate approved for use by waters. Herbicide shall be overseen by a
licensed Pest Control Advisor and applied by a certified Pest Control Applicator. Herbicide
approved for use by waters may be used if consistent with the 1PM, with authorization from the
City biologist. Herbicide shall be overseen by a licensed Pest Control Advisor and applied by a
certified Pest Control Applicator.
3.5 Weeds that re-establish after the initial weed control and before seeding will also be killed
and removed in a manner consistent with the 1PM. The Contractor shall confirm that the site is
weed-free before seeding.
5.0 MAINTENANCE AND SUCCESS STANDARDS
5.1 After the City biologist confirms in writing that the restoration installation work is complete,
the 90-day plant establishment period will begin. The primary standards for the restored habitat
are establishment of native species, erosion control and eradicating problematic invasive
exotics.
5.2 The Contractor is responsible for plant care (watering if necessary); weed control, debris and
trash removal, and erosion control to meet the success standards.
5.3 The Contractor has the option of watering (e.g., hand watering o~ water truck) seeded areas
within restoration areas to promote the restoration process.
5.4 All 1Need species 1Nithin the restored area shall be controlled by hand pulling or herbicide
application, if chemical treatment is needed to kill particular weed species. 'Needs shall be
controlled before they set seed or become 6 inches in length. 1l'leed debris 1.vill be properly
disposed of offsite. All weed species within the restored area shall be controlled by hand pulling
or other methods consistent with the City's 1PM. Weeds shall be controlled before they set seed
or become 6 inches in length. Weed debris will be properly disposed of offsite.
5.5 The BiologicafMonitor will provide a list to 1the Contractor (monthly) of weed species that
need to be eradicated.
5.6 During the maintenance period, the Contractor shall remove all debris and trash from the

5.7 During the maintenance period, the Contractor shall maintain erosion control materials,
repair erosion, and install additional'erosion control materials as necessary and at the discretion
of the City biologist. Erosion control materials could include, but are not limited to: straw
wattles, gravel bags, and/or mulch.
The updated/current version of the Restoration Plan will be incorporated into the Permit for execution
by the City and the CDFW.

collaborations for corporate and community outreach events. As a local Carlsbad

We are renovating and expanding the Grand Pacific Palisades Resort located in Carlsbad and overlooking the
Flower fields and adding 29 hotel rooms. We are asking for your support at the upcoming City Council meeting
on July 10th, 2018.
We completed this project about 15 years ago in 2002. The project consists of 251 hotel and timeshare unJts,
the Karl Strauss restaurant and 3,500 square feet of meeting space located behind the Karl Strauss restaurant.
Over the last 15 years, as other meeting space options have entered the market, the meeting space has
become less desirable-and now has reduced usage. We recently completed the new Sheraton Cartsbad
Resort & Spa and it included a larger hotel room type that consists of a mini 2-bedroom accommodation. An
exhibit of this family style suite floor plan !s attached for your review. The overafl demand for this type of
accommodation has been remarkablle!
The expansion we are proposing to the City CouncH and seeking approval for is to tear down the current
meeting space and add 29 family suite JJg!fil guestrooms. This will bring the total hotel/timeshare room count to
280 (the 251 that currently exists today, plus the 29 additional hotel rooms).
The Carlsbad Planning Department supports this p!an and we received unanimous approval from the Carlsbad
Planning Commission on May 16t11, 2018.
This project is scheduled to be deHberated by the Carlsbad City Council on July 10, 2018. Ordinarily, I would
reach out and ask you to attend to speak in support of the project, but on July 10th, 2018, the Council will also
be deliberating on the Barrio Master Plan, which will be a very lengthy process and so in the best use of your
time, as weH as the Councils, I thought it would be better to simply ask for written support of the project that
can be added to the record. Of course, if you would like to attend the Council meeting we would certainly
appreciate the support.
I have attached a rendering of the project, as well as a floor plan of the units that we plan to build. Also
attached is a suggested letter that you can use if you choose to write m support of the project. Your response

Over the years, we have been grateful fur the overwhelming s.upport we have received from the Community,

Dear City Council,
The Agua Hedionda Lagoon Foundation remains neutral in regards to the
expansion of Grand Pacific Resorts discussion. We'd like to take this opportunity
to describe our past, present and future relations with Grand Pacific Resorts.
Our mission is to inspire people through education and outreach to preserve the
Agua Hedionda Lagoon as an accessible and healthy watershed. The Discovery
Center is open to the public, but we primarily serve families with school age
children who care about the environment and local community. We are a
teaching hub of the community and our visitors come to the Discovery Center for
active ways to involve their kids in fun, hands-on educational experiences that
give them a sense of accomplishment.
By providing direct access to nature, we uniquely offer fun, interactive
experiences with the diverse bodies that rely on the lagoon. We do this differently
from others by also offering educational experiences that focus on the hands-on
doing (and not just viewing) of how people and wildlife depend on active
watershed management.
We welcome Grand Pacific Resort as a committed partner toward this end. Their
direct participation in furthering our mission has been in guided trail hikes for
visitors from Marbrisa, Grand Pacific and Seapointe. We also have animal
interactions at Marbrisa and Seapointe. They have business memberships, and
have sponsored many fundraising efforts we conduct every year as well as
recently joined our Board of Directors.
They are stewards of the environment. They were instrumental in building our
expanded parking lot, providing expert management practices throughout the
completion and built our entire trash enclosure as a bonus. They have pledged to
return to beautify our parking lot as well as expand the teaching nodes for our
outdoor classrooms this summer.
In closing, the foundation values the relationship with Grand Pacific Resorts as a
good neighbor and corporate business sponsor. We look forward to our
continued relationship, and as a foundation remain committed to our established
stance on neutrality, as it relates to the expansion of Grand Pacific Resorts and
other political/development issues that arise from time to time in our amazing
community.
