AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING SECTION 2.44.020 OF THE CARLSBAD MUNICIPAL CODE TO GRANT THE CITY MANAGER THE AUTHORITY TO MAKE REVISIONS TO JOB CLASSIFICATIONS FOR POSITIONS NOT IN THE CLASSIFIED SERVICE Exhibit 1 WHEREAS, Carlsbad Municipal Code Section 2.44.020 establishes the city manager as the personnel officer; and WHEREAS, Cc1rlsbad Municipal Code Section 2.44.020 currently requires all revisions of the city classification plan be approved by city council; and WHEREAS, the city council and city manager saw the need to make changes to the Management Compensation and Benefits Plan, including exempting management classification revisions from council approval, and voted to make those changes at a public meeting on June 26, 2018; NOW, THEREFORE, the City Council of the City of Carlsbad, California, does ordain as follows: 1. The above recitations are true and correct. 2. Carlsbad Municipal Code Section 2.44.020 is amended as follows: 2.44.020 Personnel officer. The city manager will be the personnel officer. The city manager may delegate any of the powers and duties conferred upon him or her as personnel officer under this chapter to any other officer or employee of the city or may recommend that such powers and duties be performed under contract as provided in Section 2.44.140. The personnel officer will: A. Administer all provisions of this chapter and of the personnel rules not specifically reserved to the council; B. Prepare and recommend to the council revisions and amendments to the personnel rules. The city attorney will approve the legality of such revisions and amendments prior to their submission to the council; July 17, 2018 Item #5 Page 3 of 5 C. Prepare or cause to be prepared a position classification plan, including class specifications, and revisions of the plan. For classifications in the classified service, the plan, and any revisions thereof, will become effective upon approval by the council; D. Prepare or cause to be prepared, a plan of compensation, and any subsequent revisions to it, covering all classifications in the classified service. The plan, and any revisions thereof, will become effective upon approval by the council; E. Publish or post notices of examinations for positions in the classified service; receive applications; conduct and score examinations and certify to the appointing power a list of all persons eligible for appointment to the appropriate position in the classified service. {Ord. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. This memorandum is to provide supplemental information related to the July 17, 2018 staff report and ordinance amending Carlsbad Municipal Code Section 2.44.020 to grant the city manager the authority to make revisions to job classifications for positions not in the classified service. Section C of the ordinance has been updated to include language based on recommendations from the City Attorney's office. In order to clarify the authority of the personnel officer, the following language has been added to the end of section C: "for classifications not in the classified service, the plan, and any revisions thereof, will become effective upon approval by the personnel officer."
