Amend Carlsbad Municipal Code Section 10.44.420 to establish a speed
limit of 30 miles per hour (mph) on Estrella De Mar Road from Alga Road
to 675 feet north of Beryl Way.
Recommended Action
Introduce an Ordinance amending Carlsbad Municipal Code Section 10.44.420 to establish a
speed limit of 30 mph on Estrella De Mar Road from Alga Road to 675 feet north of Beryl Way.
Executive Summary
California Vehicle Code (CVC) Section 22358 gives the City Council authority to determine and
establish by ordinance a reasonable and safe speed limit that facilitates the orderly movement
of vehicular traffic. The speed limit becomes effective when appropriate signs are installed
along the roadway. Staff proposes a speed limit of 30 mph on Estrella De Mar Road from Alga
Road to 675 feet north of Beryl Way. The proposed speed limit is reasonable and defensible,
follows the procedures in the California Manual for Setting Speed Limits (CA MSSL), and
complies with the CVC and California Manual on Uniform Traffic Control Devices (CAMUTCD).
Discussion
City staff is proposing a new speed limit on Estrella De Mar Road from Alga Road to 675 feet
north of Beryl Way. According to the CA MSSL: "The setting of speed limits requires a rational
and defensible procedure to maintain the confidence of the public and legal system. By
following a uniform procedure, agencies can establish speed limits that are uniform throughout
the state and avoid influence from political pressure or emotional perceptions."
The CA MSSL establishes a uniform procedure for setting reasonable and defensible speed
limits based on the behavior of typical drivers. The 85th percentile speed (i.e., one standard
deviation above the average free flow speed) is used to establish the upper limit of a
reasonable and defensible speed limit. Per the CA MSSL: "Speed limits that are set near the 85th
percentile speed of free flowing traffic are safer and produce less variance in vehicle speeds ...
Speed limits below the 85th percentile do not ordinarily facilitate the orderly movement of
traffic and require constant enforcement to maintain compliance."
The attached Engineering and Traffic Survey (Exhibit 3) includes the data supporting the
recommended speed limit using standard traffic engineering practices in accordance with the
CA MUTCD. The recorded 85th percentile speed on this section of Estrella De Mar Road is 32

mph. The recommended speed limit of 30 mph is the nearest 5 mph increment of this g5th
percentile speed in compliance with eve Sections 21400, 22357 and 22358.
On March 6, 2017, the Traffic Safety Commission recommended approval of the proposed 30
mph speed limit on Estrella De Mar Road from Alga Road to 675 feet north of Beryl Way. The
proposed 30 mph speed limit is reasonable and based on the methodology and criteria defined
in the CA MSSL, CVC and CA MUTCD.
CVC Section 22357 requires the City Council to adopt an ordinance to establish the 30 mph
speed limit on this road segment. Once the speed limit is established, staff will post appropriate
regulatory speed limit signs in compliance with the CA MUTCD. Police will then be able to cite
violators that exceed the posted speed limit with confidence that citations will be upheld in
court.
Fiscal Analysis
The installation of two new 30 mph signs will cost approximately $400. Sufficient funds are
available in the Streets Maintenance Operating Budget.
Next Steps
After the Ordinance to adopt the 30 mph speed limit on Estrella De Mar Road from Alga Road
to 675 feet north of Beryl Way is introduced, staff will return to City Council at a future meeting
to adopt the Ordinance. Once the Ordinance has been adopted, a work order will be issued to
install two 30 mph signs on Estrella De Mar Road from Alga Road to 675 feet north of Beryl
Way.
Environmental Evaluation (CEQA)
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15301(c) -minor alteration of existing facilities, including streets, sidewalks,
gutters, and similar facilities involving negligible or no expansion.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date. The city clerk shall
certify the adoption of this Ordinance and publish it at least once in a newspaper of general
circulation in the City of Carlsbad within 15 days after its adoption.

TO A 30 MILES PER HOUR (MPH) SPEED LIMIT ON ESTRELLA DE MAR ROAD
FROM ALGA ROAD TO 675 FEET NORTH OF BERYL WAY

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California,
ordains as follows that:
1. Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by revision of Section
10.44.420 to read as follows:
"10.44.420 Estrella De Mar Road
A. Upon Estrella De Mar Road from Alga Road to its intersection with
Costa Del Mar Road, the prima facie speed limit shall be 25 miles per
hour.
B. Upon Estrella De Mar Road from Alga Road to 675 feet north of Beryl
Way, the prima facie speed limit shall be 30 miles per hour."
EFFECTIVE DATE: This Ordinance shall be effective 30 days after its adoption; and the city clerk
shall certify the adoption of this Ordinance and cause the full text of the Ordinance or a summary of
the Ordinance prepared by the city attorney to be published at least once in a newspaper of general
circulation in the City of Carlsbad within 15 days after its adoption.
