Recommended Action
Adopt a Resolution accepting an $861,163 donation from the Rosemary Falkenstein Estate and
any subsequent donation upon final distribution.
Executive Summary
Rosemary Falkenstein bequeathed a portion of her estate to the Carlsbad City Library, for the
purpose of purchasing history books. Per CMC 2.08.100 donations over $5,000 must be
approved by the City Council.
Discussion
In early 2017, the Carlsbad City Library received correspondence from the attorney for the
estate of Rosemary Falkenstein, which stated that ten percent of the estate had been left to the
library, for the purpose of purchasing history books. The estate has been finalized and the
Carlsbad City Library has received a distribution of $861,163. Following final payments of taxes
and attorney fees, the library could receive a subsequent final distribution if any funds remain.
Rosemary Falkenstein and her husband, Dr. Herbert Falkenstein retired to Carlsbad in 1975. Dr.
Falkenstein, a scholar, college professor and diplomat, served on the city library's Board of
Trustees from 1977-1988. As president of the Library Board in 1979-80, Falkenstein set goals to
increase the library service to the southern section of the city, ultimately resulting in the
construction of the Dove Library, which opened in 1999. Dr. Falkenstein built a significant
reputation as the creative force behind a series of popular, free and timely library lectures and
seminars, assisted by his wife Rosemary. He also founded a lively discussion group of local,
national and international issues called the North County Forum which met at the Carlsbad City
Library.
Dr. Falkenstein was 88 when he passed away in 1998. In addition to working for the State
Department and a successful career in banking and finance, Rosemary was known to be an avid
reader of financial news and information. Rosemary's death in 2017 was just months prior to
her 100th birthday.

Fiscal Analysis
The Falkenstein donation and any subsequent donation will be deposited in a library special
revenue account, with a designation for expenditures in support of history resources.
Next Steps
Library staff will request appropriation of the funds through the regular budget process or as
part of a capital project as appropriate, both subject to council approval, in accordance with
Rosemary Falkenstein's wish to preserve and support historical resources.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to scheduled meeting date.

FALKENSTEIN ESTATE AND ANY SUBSEQUENT DONATION UPON FINAL
DISTRIBUTION.

WHEREAS, Rosemary Falkenstein bequeathed a portion of her estate to the Carlsbad City
Library for the purpose of purchasing history books; and
WHEREAS, the Falkenstein donation of $861,163 and any subsequent donation will be
deposited in a library special revenue account; and
WHEREAS, library staff will request appropriation of the funds through the regular budget
process or as part of a capital project as appropriate, in accordance with Rosemary Falkenstein's wish
to preserve and support historical resources.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the City Council accepts a gift of $861,163 and any subsequent donation from the
Rosemary Falkenstein Estate, which will be directed to a library special revenue fund for
the purpose of preserving and supporting historical resources.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 11th day of December, 2018, by the following vote, to wit:
