Recommended Action Adopt a Resolution accepting an $88,577 donation from the Lee and Maria Elson Trust and any subsequent donation upon final distribution. Executive Summary Lee and Maria Elson designated the Carlsbad Senior Center Trust Fund as a beneficiary of their trust. Per CMC 2.08.100 donations over $5,000 must be accepted by the City Council. Discussion In late 2016, the Carlsbad Parks & Recreation Department received correspondence from the attorney for the Lee and Maria Elson Trust, which stated that one-third of the trust had been left to the Carlsbad Senior Center Trust Fund, for senior programs. The senior center has since received a distribution of $88,577 from the trust and could receive a subsequent final distribution following after-acquired assets. Fiscal Analysis The Elson trust donation, and any subsequent donation upon final distribution, will be deposited in the Carlsbad Senior Center Trust Fund, with a designation that all expenditures must be made in support of senior programs. Next Steps Parks & Recreation staff will request appropriation of the funds through the regular budget process or as part of a capital project as appropriate, both subject to council approval, in accordance with the Elsons' wishes to support senior programs. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. EXHIBIT 1 WHEREAS, Lee and Maria Elson designated the Carlsbad Senior Center Trust Fund as a beneficiary of their trust for the support of senior programs; and WHEREAS, the Carlsbad Senior Center received a donation from the Lee and Maria Elson Trust in the amount of $88,577; and WHEREAS, the Elson trust donation, and any subsequent donation upon final distribution, will be deposited in the Carlsbad Senior Center Trust Fund to support senior programs; and WHEREAS, Parks & Recreation staff will request appropriation of the funds through the regular budget process or as part of a capital project as appropriate, both subject to council approval, in accordance with the Elsons' wishes that their trust donation support senior programs at the Carlsbad Senior Center. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City Council accepts the trust donation of $88,577, and any subsequent donation upon final distribution, from the Lee and Maria Elson Trust, which will be directed to the Carlsbad Senior Center Trust Fund to support senior programs.
