Development Plan PDP 1-Encina Water Pollution Control Facil ity
Recommended Action
Adopt Ordinance No. CS-353 adopting an amendment to the Precise Development Plan PDP 1
for the: 1) Construction of a new Grit and Screenings Annex including applicable equipment; 2)
Repair, rehabilitation and replacement of existing aging infrastructure through the preliminary
and primary areas; 3) Construction of 21 new parking spaces to the east of the existing
administration building; and, 4) Construction of a waste hauling truck turn-around area within
the Mello II Segment ofthe. City's Local Coastal Program located at 6200 Avenida Encinas within
Local Facilities Management Zone 3.
Executive Summary /Discussion
Ordinance No. CS-353 was introduced and first read at the City Council meeting held on May 7,
2019. On a motion by Council Member Hamilton, seconded by Mayor Pro Tern Bhat-Patel, the
City Council voted 5/0 to introduce the Ordinance. The second reading allows the City Council
to adopt the ordinance which will become effective thirty days after adoption.
Fiscal Analysis
All required improvements to construct this project will be funded and constructed by the
Encina Wastewater Authority.
Next Steps
The City Clerk will have the ordinance or a summary of the ordinances published in a
newspaper of general circulation within fifteen days following adoption of the ordinance.
Environmental Evaluation (CEQA)
An Initial Study (IS), dated August 2018 by Woodard & Cu ran for EWA, was submitted to the
Planning Division with the application submittal. The IS determined that the project would not
have a significant impact on the environment. After reviewing the IS the City Planner has
determined that the project belongs to a class of projects that the State Secretary for Resources
has found do not have a significant impact on the environment, and it is therefore categorically
exempt from the requirement for the preparation of environmental documents pursuant to
CEQA Section 15301-Existing Facilities. A Notice of Exemption will be filed with the County
Clerk upon project approval.

ORDINANCE NO. CS-353
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ADOPTING AN AMENDMENT TO PRECISE DEVELOPMENT PLAN
PDP 1 FOR THE: 1) CONSTRUCTION OF A NEW GRIT AND SCREENINGS

WHEREAS, the City Council of the City of Carlsbad, California has reviewed and considered a
request to approve a Precise Development Plan Amendment (AMEND 2018-0007) for the Encina Water
Pollution Control Facility; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if
any, of all persons desiring to be heard, said City Council considered all factors relating to AMEND 2018-
0007 -Encina Water Pollution Control Facility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California,
ordains as follows that:
1. The above recitations are true and correct.
2. That the recommendation of the Planning Commission for approval of a Precise
Development Plan Amendment (AMEND 2018-0007), is approved, and that the findings
and conditions of the Planning Commission contained in Planning Commission
Resolution No. 7327, on file with the City Clerk and incorporated herein by reference,
are the findings and conditions of the City Council.
3. That Condition No. 2 of Ordinance No. NS-819, requiring the Applicant to provide copies
of the EWPCF "Odor Complaints Log" to the Planning Director on a quarterly basis, is no
longer needed as the City Planner has determined that over the years there have been
very few odor complaints.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City
Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary

of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general
circulation in the City of Carlsbad within fifteen days after its adoption.
