inspected 3,188 apartment/condominium buildings with three units or greater.
California Health and Safety Code Section 13146.3 mandates that the local fire department
inspect all public and private Schools once annually. The Fire Department has inspected 38
school facilities that total 254 buildings within these facilities.
In total, the Fire Department has conducted 3,605 mandated annual inspections during the 2018-
2019 fiscal year and has completed initial inspections of all known buildings and structures
required to be inspected within the California Health and Safety Code mandate. Further, the
acceptance of this compliance report and the recommended Resolution fulfill the statutory
requirements contained in California Health and Safety Code Section 13146.2, 13146.3 and
13146.4, as amended by SB 1205.

Pursuant to Public Resources Code section 21065, this action does not constitute a "project"

RESOLUTION NO. 2019-072
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING A REPORT ON THE STATUS OF ALL STATE-
MANDATED ANNUAL FIRE INSPECTIONS IN THE CITY OF CARLSBAD IN
CONJUNCTION WITH SB1205 AND THE CALIFORNIA HEALTH AND SAFETY
CODE SECTION 13146.4.
Exhibit 1
WHEREAS, California Health & Safety Code Section 13146.4 was added in 2018, and became
effective on September 27, 2018; and,
WHEREAS, California Health & Safety Code Sections 13146.2 and 13146.3 requires all fire
departments, including the Carlsbad Fire Department, that provide fire protection services to perform
annual inspections in every building used as a public or private school, hotel, motel, lodging house,
apartment house, and certain residential care facilities for compliance with building standards, as
provided and,
WHEREAS, California Health & Safety Code Section 13146.4 requires all fire departments,
including the Carlsbad Fire Department, that provide fire protection services to report annually to its
administering authority on its compliance with Sections 13146.2 and 13146.3 and,
WHEREAS, the City Council of the City of Carlsbad intends this Resolution to fulfill the
requirements of the California Health & Safety Code regarding acknowledgment of the Carlsbad Fire
Department's compliance with California Health and Sections 13146.2 and 13146.3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad that said City
Council expressly acknowledges the measure of compliance of the Carlsbad Fire Department with
California Health and Safety Code Sections 13146.2 and 13146.3 in the area encompassed by the City
of Carlsbad, as follows:
A. EDUCATIONAL GROUPE OCCUPANCIES:

Educational Group E occupancies are generally those public and private schools, used by more
than six persons at any one time for educational purposes through the 12th grade. Within the City of
Carlsbad, there lie 43 Group E occupancy campuses.
During fiscal year 2018, the Carlsbad Fire Department completed the annual inspection of 43
Group E occupancies, with a total building count of254 structures and/or facilities. This is a compliance
rate of 100 % for this reporting period.
B. RESIDENTIAL GROUP R OCCUPANCIES:
Residential Group R occupancies, for the purposes of this resolution, are generally those
occupancies containing sleeping units, and include hotels, motels, apartments (three units or more),
etc. as well as other residential occupancies (including a number of residential care facilities). These
residential care facilities have a number of different sub-classifications, and they may contain residents
or clients that have a range of needs, including those related to custodial care, mobility impairments,
cognitive disabilities, etc. The residents may also be non-ambulatory or bedridden. Within the City of
Carlsbad, there lie 3,351 Group R (and their associated sub-categories) occupancies of this nature.
During fiscal year 2018, the Carlsbad Fire Department completed the annual inspection of 3,351
Group R occupancies, buildings, structures and/or facilities. This is a compliance rate of 100 % for this
reporting period.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California,
as follows:
1. That the above recitations are true and correct.
2. That this Resolution, and all action taken subsequent hereto in connection herewith, is
taken pursuant to the provisions of California Health and Safety Code sections 13146,
et seq. (Article 2, State Board of Fire Services).

3. Words used in this Resolution and its subsequent action in connection herewith shall
be defined as outlined in said code sections.
4. That the City Council of the City of Carlsbad hereby declares that the City of Carlsbad is
in compliance with the state-mandated fire inspection requirements contained within
California Health and Safety Code sections 13146.2 and 13146.3.
5. That the City Council of the City of Carlsbad hereby declares that the Fire Department
has met its mandatory reporting requirements to the administering agency, as
required in California Health and Safety Code section 13146.4.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 21st day of May 2019, by the following vote, to wit:
