Formation of Ad-Hoc City Council Expressive Activities Ordinance

Recommended Action
Adopt a Resolution authorizing the formation of an ad-hoc City Council subcommittee comprised
of two City Council Members to meet with representatives of the North County Civil Liberties
Coalition, to listen to and discuss their concerns and recommendations and present a
recommended final draft Expressive Activities Ordinance for consideration by the full City
Council.
Executive Summary
This item presents a Resolution authorizing the formation of an Ad-Hoc City Council Expressive
Activities Ordinance Subcommittee, as directed by the City Council on May 14, 2019.
Discussion
On May 14, 2019, the City Council considered introducing an Expressive Activities Ordinance
amending Carlsbad Municipal Code Title 8, Chapter 8.17 regarding special events and Chapter
8.18 regarding expressive activity and waiving applicable park user fees. The City Council
approved a Minute Motion, directing staff to return with an agenda item to consider forming an
ad -hoc subcommittee to meet with representatives of the North County Civil Liberties Coalition
to discuss the proposed ordinance and present a recommended final draft of the ordinance for
consideration by the full City Council.
The duties of the subcommittee would include meeting with representatives of the North
County Civil Liberties Coalition, listening to and discussing their concerns and recommendations
and presenting a recommended final draft Expressive Activities Ordinance for consideration by
the full City Council.
The subcommittee would automatically be dissolved after 90 days, or upon City Council
adoption of an Expressive Activities Ordinance, whichever occurs earlier.

Next Steps
The Ad-Hoc Subcommittee will meet and present a recommended final draft Expressive Activities
Ordinance for consideration by the full City Council.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably foreseeable indirect physical change in the environment,
and therefore does not require environmental review.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to scheduled meeting date.

RESOLUTION NO. 2019-135
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA
AUTHORIZING THE FORMATION OF AN AD-HOC CITY COUNCIL EXPRESSIVE
ACTIVITIES ORDINANCE SUBCOMMITTEE
WHEREAS, the City Council of the City of Carlsbad, California has determined that formation of
an ad-hoc City Council subcommittee is needed to advise the City Council on an Expressive Activities
Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Carlsbad, California as
follows:
1. That the above recitations are true and correct.
2. That a City Council ad-hoc subcommittee comprised of the following two City Council
members is hereby formed:
(a) Council Member Blackburn; (b) Council Member Schumacher
3. That the duties of the ad-hoc subcommittee will include meeting with representatives of
the North County Civil Liberties Coalition, listening to and discussing their concerns and
recommendations and presenting a recommended final draft Expressive Activities
Ordinance for consideration by the full City Council; and
4. That the ad-hoc subcommittee will automatically be dissolved either after 90-days, or
upon City Council adoption of an Expressive Activities Ordinance, whichever occurs
earlier.
