Subject: Amend Carlsbad Municipal Code Chapter 2.28, Sections 2.15.050 and
2.12.125 to update the Traffic Safety Commission's name and duties.
Recommended Action
Introduce an Ordinance amending Carlsbad Municipal Code (CMC) Chapter 2.28, Sections
2.15.050 and 2.12.125 to update the Traffic Safety Commission's name and duties.
Executive Summary
At the annual goal setting workshop held on March 20, 2018, City Council directed staff to
amend the duties of the Traffic Safety Commission (TSC) to include advising the City Council on
matters related to implementation of the General Plan Mobility Element by April 2019. The
proposed amendments rename the TSC to the Traffic and Mobility Commission, adjust all
references to the TSC, update the duties of the TSC relating to multimodal transportation
systems, and remove sections from Chapter 2.28 of the CMC to eliminate redundancy with
Chapter 2.15, which relates to all boards and commissions. The proposed amendments expand
the duties of the TSC to be involved in matters concerning all modes of travel (not limited to
automobile travel) in addition to traffic safety issues.
On July 1, 2019, the proposed amendments were discussed at the TSC. The TSC unanimously
approved the amendments reflected in Exhibit 1.,
Discussion
A goal setting workshop was hosted by the City Council on March 20, 2018. City Council
approved Resolution No. 2018-052 on April 17, 2018 establishing the City <:;ouncil goals that
included the following:
By April 2019, amend the duties of the Traffic Safety Commission to include
advising the City Council on matters related to implementation of the General Plan
Mobility Element.
Staff is proposing specific changes to the CMC directly tied to this City Council goal and
feedback received from the current TSC Commissioners. Exhibit 1 includes the ordinance with

proposed CMC amendments relating to the TSC's change in name and expanded role and
duties.
• Revise CMC Section 2.28.010 to change the name of the TSC to the Traffic and Mobility
Commission, and replacing "created" with "established".
• Revise CMC Section 2.28.050 to change the duties of the renamed Traffic and Mobility
Commission relating to multimodal transportation systems, and create consistency in
the descriptions of subject matter areas between subsections (A), (B) and (C).
• Revise CMC sections 2.15.050, and 2.12.125 to reference the Traffic and Mobility
Commission instead of the TSC.
• Eliminate CMC sections 2.28.020 and 2.28.040 because sections found within Chapter
2.15 have been added or revised to address the same subject matter.
Additionally, City Council's adoption of CMC amendments relating to the TSC will assist in the
process of preparing a work plan for the TSC, which will guide the TSC's work over the next
year.
Fiscal Analysis
The proposed changes to the Carlsbad Municipal Code have no fiscal impact.
Next Steps
The Ordinance will be brought back to City Council on Aug. 27, 2019. The Ordinance will
become effective 30 days after adoption. Staff will finalize the draft work plan for the renamed
mobility commission. The work plan is expected to emphasize the commission's new duties and
City Council directive to have the mobility commission advise City Council on matters related to
implementation of the General Plan Mobility Element.
Environmental Evaluation (CEQA)
Pursuant to Public Resources Code Section 21065, the proposed amendments to the municipal
code do not constitute a "project" within the meaning of the California Environmental Quality
Act (CEQA) in that it has no potential to cause either a direct physical change in the
environment, or a reasonably foreseeable indirect physical change in the environment, and
therefore does not require environmental review.
Public Notification and Outreach
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.

and within the City of Carlsbad; and
WHEREAS, the City Council wishes to expand the scope of the traffic safety commission so that
the commission can assist the City Council in meeting this goal; and

A traffic and mobility commission for the city is established.
2.28.050 Duties.
It shall be the duty of the traffic and mobility commission to study matters concerning mobility
and traffic safety, including implementation of the General Plan Mobility Element, and to make
written recommendations to the city council and planning commission regarding measures that
should be taken to promote mobility and traffic safety within the city as follows:
A. Review staff studies and reports, and make recommendations to the city council and
planning commission on mobility and traffic safety matters, including but not limited to
those related to pedestrian, bicycle, vehicular, and transit modes of travel, and parking
and school safety;
B. Provide a public forum to review community input regarding mobility and traffic safety
matters, including but not limited to those related to pedestrian, bicycle, vehicular, and
transit modes of travel, and parking and school safety;

C. Review and provide recommendations for revision to the city codes and plans on
mobility and traffic safety matters, including but not limited to pedestrian, bicycle,

That Carlsbad Municipal Code Chapter 2.15, section 2.15.050 is amended to read
2.15.050 Appointments.
A. Appointments to the planning commission, parks and recreation commission, and traffic
and mobility commission, shall be made by the following process:
1. The mayor and each councilmember shall nominate one individual to serve on each of
the commissions for a term coinciding with the term of the councilmember making the
appointment. The mayor shall nominate two additional individuals to serve on each of the
commissions. All nominations shall be subject to ratification by a majority vote of the city
council. If a nominee is not approved by a majority vote of the city council, the
councilmember making the nomination may nominate another individual at the same or a
subsequent meeting. In the event that a member of the city council does not make any
nomination within 45 days of the date the councilmember is sworn into office or within 60
days of the occurrence of a vacancy, the appointment will be made by the mayor with the
approval of the city council.
2. Although each member of the city council elected by a district shall use his or her best
efforts to appoint individuals residing in that district to these commissions, members of
the city council may appoint individuals not residing in their districts in their discretion in
order to assure that the most interested and qualified individuals serve on the
commissions.
B. Appointments to all other city boards and commissions shall be made by the mayor with
the approval of the city council.
SECTION IV:

The city manager may attend any and all meetings of the planning commission, parks and

manager's own volition or upon direction of the city council. At such meetings which the city
manager attends, he or she shall be heard by such commissions, boards or committees as to all
matters upon which the city manager wishes to address the members thereof, and he or she
shall inform the members as to the status of any matter being considered by the city council, and
the city manager shall cooperate to the fullest extent with the members of all commissions,
boards or committees appointed by the city council.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City
Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a
summary of the ordinance prepared by the City Attorney to be published at least once in a
newspaper of general circulation in the City of _Carlsbad within fifteen days after its adoption.

A traffic and mobility safety-commission for the city is createdestablished.
2.28.020 Membership Appointment Terms.
The traffic mobility safety commission shall consist of five seven members. appointed by the mayor and
confirmed by the city council. Each member shall serve until their successor is duly appointed. The
members shall serve staggered terms at least PNO years apart. In order to stagger the terms, upon the next
appointment of commission members after the effective date of the ordinance from which this section
derives, two members will be appointed for terms expiring two years thereafter and three members will be
appointed for terms expiring four years thereafter. All subsequent appointments will be for four year terms.
Members of the commission may be removed by the mayor with the consent of the city council at any time.
The transportation director shall be an ex officio member and serve as secretary to the commission. The
ex officio member shall not be entitled to vote.
2.28.040 Officers Meetings Reports Conduct of meetings.
The commission shall elect a chair, a vice chair, and such other officers as it deems desirable. The officers
shall serve for a term of one year and until the election of successors. The commission shall hold meetings
no less than once during each calendar month (provided agenda items exist), and shall send a report of
each month's meeting to the city co uncil. The commission may adopt its own rules and regulations.
2.28.050 Duties.
It shall be the duty of the traffic and mobility safety-commission to study aJ.1.-matters referred to it concerning
traffic safety and pedestrian mobility and traffic safetyi including implementation of the General Plan Mobility
Element, and to make written recommendations to the city council and planning commission regarding

the city council may appoint individuals not residing in their districts in their discretion in
order to assure that the most interested and qualified individuals serve on the
commissions.
B. Appointments to all other city boards and commissions shall be made by the mayor with
the approval of the city council.

That Carlsbad Municipal Code Chapter 2.12, section.2.12.125 is amended to read
2.12.125 Attendance at commission meetings.
The city manager may attend any and all meetings of the planning commission, parks and
recreation commission, harbor commission, library commission, traffic and mobility commission
and any other commissions, boards or committees created by the city council, upon the city
manager's own volition or upon direction of the city council. At such meetings which the city
manager attends, he or she shall be heard by such commissions; boards or committees as to all
matters upon which the city manager wishes to address the members thereof, and he or she
shall inform the members as to the status of any matter being considered by the city council, and
the city manager shall cooperate to the fullest extent with the members of all commissions,
boards or committees appointed by the city council.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City
Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a
summary of the ordinance prepared by the City Attorney to be published at least once in a
newspaper of general circulation in the City of Carlsbad Within fifteen days after its adoption.
