Recommended Action Adopt a Resolution authorizing a 30-day extension for the term of the ad-hoc City Council Expressive Activities Ordinance Subcommittee. Executive Summary This item presents a Resolution authorizing a 30-day extension for the term of the ad-hoc City Council Expressive Activities Ordinance Subcommittee. Discussion On May 14, 2019, the City Council considered introducing an Expressive Activities Ordinance amending Carlsbad Municipal Code Title 8, Chapter 8.17 regarding special events and Chapter 8.18 regarding expressive activity and waiving applicable park user fees. The City Council approved a minute motion, directing staff to return with an agenda item to consider forming an ad-hoc subcommittee to meet with representatives of the North County Civil Liberties Coalition (NCCLC) to discuss the proposed ordinance and present a recommended final draft of the ordinance for consideration by the full City Council. On July 23, 2019, the City Council adopted Resolution No. 2019-135, authorizing the formation of an ad-hoc subcommittee to meet with the NCCLC representatives and appointing Council Member Blackburn and Council Member Schumacher. The subcommittee was to automatically be dissolved either after 90-days, or upon City Council adoption of an Expressive Activities Ordinance, whichever occurred earlier. Following meetings with NCCLC representatives, Council Member Blackburn and Council Member Schumacher requested that the term of the subcommittee be extended for an additional 30 days to allow further meetings to reach a recommendation on the draft Expressive Activities Ordinance. Oct. 15, 2019 Item #6 Page 1 of 3 Next Steps The Ad-Hoc Subcommittee will meet again with NCCLC representatives and subsequently present a recommendation on a final draft Expressive Activities Ordinance for consideration by the full City Council by the end of the 30-day extension (i.e. by Nov. 20, 2019). Environmental Evaluation (CEQA} Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M . Brown Act and was available for public viewing and review at least 72 hours prior to scheduled meeting date. Exhibits 1. City Council Resolution Oct. 15, 2019 Item #6 Page 2 of 3 RESOLUTION NO. 2019-208 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AUTHORIZING A 30-DAY EXTENSION FOR THE TERM OF THE AD-HOC CITY COUNCIL EXPRESSIVE ACTIVITIES ORDINANCE SUBCOMMITTEE WHEREAS, the City Council of the City of Carlsbad, California has determined that formation of an ad-hoc City Council subcommittee is needed to advise the City Council on an Expressive Activities Ordinance; and WHEREAS, on July 23, 2019 the City Council adopted Resolution No. 2019-135 authorizing the formation of an ad-hoc subcommittee to meet with the North County Civil Liberties Coalition representatives, and appointing Council Member Blackburn and Council Member Schumacher to serve on the Expressive Activities Ordinance subcommittee for a 90-day period; and WHEREAS, the subcommittee has requested an extension of 30-days to continue meeting with representatives of the North County Civil Liberties Coalition, listening to and discussing their concerns and recommendations and presenting a recommended final draft Expressive Activities Ordinance for consideration by the full City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: That the above recitations are true and correct. 1. 2. That a City Council ad-hoc subcommittee comprised of Council Member Blackburn and Council Member Schumacher is hereby extended for 30-days, or upon City Council adoption of an Expressive Activities Ordinance, whichever occurs earlier. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 15th day of October 2019, by the following vote, to wit: AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
