Recommended Action Adopt a Resolution revising the existing Recreation Supervisor job classification, revising Article 30 of the Carlsbad City Employees' Association (CCEA) Memorandum of Understanding (MOU), and revising the CCEA Salary Schedule. Executive Summary Throughout the year, the Human Resources Department works with city departments to ensure job classifications reflect current duties and certifications. Job classifications may be added, revised, or deleted to align with operational changes or changes to service delivery. This Staff Report recommends revising the Recreation Supervisor job classification, revising Article 30 of the CCEA MOU, and revising the CCEA Salary Schedule. Per Section 3 of the Personnel Rules, before any job classification becomes effective, it must first be approved by Resolution of the City Council at a public meeting. Per Title 2, Chapter 2.44 of the Municipal Code, any changes to the CCEA Salary Schedule must also be approved by Resolution of the City Council at a public meeting. Pursuant to California Government Code 3505.1, the amendment to the MOU is being presented to the City Council as the governing body for its consideration. Discussion Section 3 of the City of Carlsbad's Personnel Rules and Regulations states that the Human Resources Department will be responsible for preparing and maintaining job classifications for all full-time positions. Each job classification will include a list of typical duties and will describe duties which employees occupying the job classification may be required to perform. Before the full-time classification revisions become effective, they must be first approved by Resolution of the City Council at a public meeting. Prior to the submission of the classification revisions to the City Council for consideration, the affected employee organizations must be provided with written notice of the changes being proposed and an opportunity to meet and confer as to those matters that are within the scope of representation. Nov. 12, 2019 Item #2 Page 1 of 19 CCEA salary ranges are established after a salary analysis is done of the associated job duties .. Per Title 2, Chapter 2.44 of the Municipal Code, any c~anges to the CCEA Salary Schedule must also be approved by Resolution of the City Council at a public meeting. Per California Government Code 3505.1, if a tentative agreement is reached by the authorized representatives of the public agency and a recognized employee organization, the governing body shall vote to accept or reject the tentative agreement. Staff proposes revising the current Recreation Supervisor job classification by creating a flexible classification that includes a Recreation Supervisor I and Recreation Supervisor II. The journey- level supervisor is distinguished from the entry-level supervisor position in that the journey- level supervisor works with a greater degree of autonomy and has a higher level of responsibilities. The creation of a journey-level in this classification would allow for greater flexibility and developmental opportunities for staff. A compensation study indicates that the Recreation Supervisor II job classification would be leveled at grade 64 on the CCEA Salary Schedule. The Recreation Supervisor I would remain leveled at grade 54. Exhibits 2 and 4 attached to this Staff Report depict the specific changes being proposed. To address the addition of the Recreation Supervisor flexible classification, staff recommends that the City Council approve a side letter amending Article 30, Flexible Classifications, of the CCEA MOU. Exhibit 3 attached to this Staff Report depict the specific changes being proposed. Per the Personnel Rules, the city has met and conferred with CCEA concerning the changes affecting the represented employees. The CCEA Salary Schedule will be revised accordingly. Fiscal Analysis The fiscal impact associated with the addition of the Recreation Supervisor flexible classification is $30,000. Funding for this cost has been included in the fiscal year 2019-20 budget. Next Steps Staff will revise the Recreation Supervisor job classification, implement the approved change to the CCEA MOU, and amend the CCEA Salary Schedule. Environmental Evaluation (CEQA) Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonable foreseeable indirect physical change in the environment; and therefore, does not require environmental review. Public Notification and Outreach This item was noticed in accordance with the Ralph M. Brown Act and was available for viewing and review at least 72 hours prior to the meeting date. Exhibits 1. DISTINGUISHING CHARACTERISTICS: Recreation Supervisor I: This is the entry-level class in the Recreation Supervisor series. Employees is this classification normally work under close supervision performing more routine tasks and duties assigned to position within the series. Work is usually observed both during its performanc~ and upon completion and fits an established structure or pattern. Positions at this level are not expected to function with the same amount of knowledge or skill level as position at the Recreation Supervisor II level. Recreation Supervisor II: This is the journey level classification in the Recreation Supervisor series before management level. This classification works under general supervision and incumbents are expected to perform a variety of duties with only occasional instruction or assistance. Adequate performance at this level requires the knowledge of departmental procedures and policies, maintaining compliance, and the ability to work independently and offer alternative solutions in solving problems and in achieving greater effectiveness. Positions in this class are normally filled by advancement from the Recreation Supervisor I level. KEY RESPONIBILITIES: Plan, organize, and coordinate multiple recreation programs, and directly participate in a variety of citywide recreation program activities. Supervise and direct full-time and/or hourly staff in a variety of citywide recreation program activities. Make recommendations regarding the organization, scheduling, and staffing of various recreation program activities to department management. Develop recreation programs and procedures; oversee implementation within assigned area. Prepare periodic reports and news releases; maintain activity and progress records. Respond to citizen complaints and requests for information; present information to the public on event activities. Assist in budget preparation and administration for the department. Assist in the development of goals, objectives, and policies for the Recreation Department. Act as liaison with school district officials. Make recommendations and assist in contract administration. Assist in the coordination of recreation activities with other city departments and divisions, and with outside agencies. Perform related duties as assigned or requested . A typical way to obtain the knowledge and abilities would be: Equivalent to a bachelor's degree from an accredited college or university with major work in recreation or a related field. Two years of professional experience involving the development and supervision of a variety of recreation programs for all age groups. The Recreation Supervisor II will demonstrate the following in addition to the above: Four years of professional experience involving the development and supervision of a variety of recreation programs for all age groups, including two years as a Recreation Supervisor or an equivalent classification. SPECIAL REQUIREMENTS: Possession of a valid Class C California Driver's License. Must meet State of California Tuberculosis test requirements. If assignment involves working with minors, in accordance with the Health and Safety Code Section 10911.5 (a), cannot have any convictions related to drugs, sexual misconduct, assault or related offenses involving minors; and CA Penal Code Section 11165.9 requires responsibility to report suspected child abuse. Depending on the assignment the recreation supervisor may be required to issue notices of violation and field citations and use whatever judicial and administrative remedies are available under municipal code 1.10.020 General enforcement authority. · Work weekends, holidays, and evenings as assigned. Required Certifications when assigned to an Aquatics Facility: Within six months of appointment, as a condition of employment, satisfactory completion of a First Aid and CPR/AED certificates required. Some positions may occasionally require incumbents to lift or move moderately heavy equipment, or materials during the course of duties assigned. This position may also require frequent exposure to the weather during the course of performing the essential duties. DATE APPROVED: November 12, 2019 Nov. 12, 2019 Item #2 Page 7 of 19 Attachment B SIDE LETTER OF AGREEMENT TO THE 2018-2020 MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD CITY EMPLOYEES' ASSOCIATION EFFECTIVE: UPON CITY COUNCIL APPROVAL This side letter memorializes an agreement reached between the City of Carlsbad ("City") and the Carlsbad City Employees' Association ("CCEA") to change the 2018- 2020 Memorandum of Understanding ("MOU") entered into between the City and CCEA. All other terms and conditions of the existing MOU shall remain in full force and effect. The changes are as follows: Article 30 shall be replaced in its entirety with the following: An employee hired into one of the listed entry level positions shall be reclassified to the journey level position following twelve (12) months of successful service in the entry level position and upon meeting journey-level requirements, if any, as established by the City. Any City- established requirements must be identified in the classification description. The employee shall receive a five percent (5%) salary increase upon reclassification to the journey level position. If a five percent (5%) salary increase would result in a salary that is below the pay range minimum of the journey level position, the employee's salary will bet set equal to the pay range minimum. Positions assigned to this class are distinguished from the Recreation Specialist class by the scope and level of administrative and supervisory responsibility assigned. Positions in this class are normally filled by advancement from the Recreation Supervisor I level. KEY RESPONIBILITIES: Plan, organize, and coordinate multiple recreation programs, and directly participate in a variety of citywide recreation program activities. Supervise and direct full-time and/or hourly staff in a variety of citywide recreation program activities. Make recommendations regarding the organization, scheduling, and staffing of various recreation program activities to department management. Develop recreation programs and procedures; oversee implementation within assigned area. Attend meetings and assist in providing staff support to the Parks and Recreation Commission, including the preparation and presentation of technical staff reports. Respond to citizen complaints and requests for information; present information to the public on event activities. Assist in budget preparation and administration for the department. Assist in the development of goals, objectives, and policies for the Recreation Department. Act as liaison with school district officials. Make recommendations and assist in contract administration. Assist in the coordination of recreation activities with other city departments and divisions, and with outside agencies. Perform related duties as assigned or requested. The Recreation II Supervisor will demonstrate the following in addition to the above: • Perform difficult, complex technical and administrative work involving the use of independent judgement. • Demonstrate initiative and accuracy. • Manage multiple and complex program budgets. • Manage multiple projects and programs simultaneously. • Identify opportunities for greater effectives and recommend best practices. • Assist with preparation of staff reports for City Council Agenda's EXPERIENCE AND EDUCATION: Any combination equivalent to the experience and education that could likely provide the required knowledge and abilities is qualifying. A typical way to obtain the knowledge and abilities would be: Equivalent to a bachelor's degree from an accredited college or university with major work in recreation or a related field. · Two years of professional experience involving the development and supervision of a variety of recreation programs for all age groups. The Recreation Supervisor II will demonstrate the following in addition to the above: Four years of professional experience involving the development and supervision of a variety of recreation programs for all age groups, including two years as a Recreation Supervisor or an equivalent classification. SPECIAL REQUIREMENTS: Possession of a valid Class C California Driver's License. Must meet State of California Tuberculosis test requirements. If assignment involves working with minors, in accordance with the Health and Safety Code Section 10911 .5 (a), cannot have any convictions related to drugs, sexual misconduct, assault or related offenses involving minors; and CA Penal Code Section 11165.9 requires responsibility to report suspected child abuse. Depending on the assignment the recreation supervisor may be required to issue notices of violation and field citations and use whatever judicial and administrative remedies are available under municipal code 1.10.020 General enforcement authority.
