Recommended Action Conduct a Majority Protest Public Hearing and adopt a Resolution approving increases to recycling and trash service rates related to green waste, effective Jan . 1, 2020. Executive Summary Beginning Jan. 1, 2020, Assembly Bill (AB) 1594 eliminates the city's diversion credit for green waste used as Alternative Daily Cover (ADC) at landfills. Composting of the city's green waste will divert this material from the landfill and allow the city to continue meeting the state's 50% diversion mandate under AB 939, the Integrated Waste Management Act. On Oct. 15, 2019, City Council approved a contract amendment with Palomar Transfer Station (PTS), a wholly owned subsidiary of Republic Services, Inc. (Republic), to compost the city's green waste at Agromin -OC, LLC(Agromin), beginning Jan. 1, 2020. As a result of this new service, the disposal rate will increase from $44.15 per ton to $68.29 per ton. Due to the increased per ton rates, Coast Waste Management, lnc.'s (WM) base service rates related to green waste will increase approximately 6% to 9% for the city's residential and commercial customers. A Public Hearing is required for these increases to service rates under Article XIIID of the California Constitution, commonly known as Proposition 218. Discussion Green waste, also commonly referred to as "yard waste," includes plant debris, such as grass clippings, pruning, weedi ; branches, brush and other organic waste normally produced from gardens or landscaped areas. Beginning Jan. 1, 2020, AB 1594 eliminates the city's diversion credit for green waste that is used as ADC at landfills. ADC will no longer constitute diversion through recycling and will instead be considered waste disposal for measuring the jurisdiction's annual per capita disposal rate as required by Public Resources Code (PRC) Section 41781.3. Currently, the city's green waste is used as ADC at the Otay Landfill. As a result of the city's diversion programs, including the use of green waste as ADC, the city's annual per capita disposal rate is currently below the 8.4 pounds per person per day (ppd) Dec. 10, 2019 Item #11 Page 1 of 70 target issued by the California Department of Resources Recycling and Recovery (CalRecycle). In 2018, the city's per capita disposal rate was 7.8 ppd. For 2018, if the city's green waste was considered waste disposal and not diverted through recycling, then our per capita disposal rate would exceed the 8.4 ppd. target and be 9.1 ppd. On Oct. 15, 2019, to ensure that the city remains below the 8.4 ppd per capita target, City Council approved a contract amendment with PTS under Resolution No. 2019-203 to compost all the city's green waste at Agromin beginning Jan. 1, 2020. Agromin is a commercial compost facility, located in Oceanside and co-owned by Republic. In accordance with the PTS Agreement, city staff and Republic negotiated adjustments to the per ton rates that apply to the city's green waste in order to reflect the new composting services. As a result of this new service, the disposal rate at PTS will increase from $44.15 per ton to $68.29 per ton. Adjustments to trash and recycling rates in future years will be made as part of the city's budget adoption process each June. Customers were notified of the above rates via U.S. mail, city website, brochures at city facilities and newspaper announcements. The above rates, if approved, will go into effect Jan. 1, 2020. Proposition 218 Notice The city notified property owners and customers at I.east 45 days in advance of holding the Public Hearing by mailing written notices of the proposed property-related increa~es for Dec. 10, 2019 Item #11 Page 2 of 70 recycling and trash service rates related to green waste via U.S. mail on Oct. 21, 2019. As further described below (see Public Notification), those property owners and customers have the right to protest the proposed rate increases by submitting a written protest to the city clerk any time before close of the Dec. 10, 2019, Public Hearing. If less than a majority of the property owners and customers file written protests to the proposed rate increases, City Council may approve the proposed changes to the recycling and trash service rates related to green waste. Fiscal Analysis The proposed base service rate increases, effective Jan. 1, 2020, will be approximately 6% to 9% for residents and businesses. WM collects a franchise fee and AB 939 fee from solid waste related services to residents and businesses and remits it to the city quarterly. The franchise fee is 7.5%, which is allocated into the city's General Furid for governmental services such as public safety, libraries, parks and recreation . The AB 939 fee is 2%, which is allocated to the Solid Waste Enterprise Fund to pay_for city Recycling Programs. Adjustments to trash and recycling rates through fiscal year 2021-22, in accordance with the city's contract with WM, will be made as part of the city's budget adoption process each June. Next Steps If approved, the proposed rate increases will be effective Jan . 1, 2020. Environmental Evaluation (CEQA) The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15273 -CEQA does not apply to the establishment, modification, structuring, restructuring or approval of rates, tolls, fares, or other charges by public agencies. Public Notification California Constitution, Article XIIID, Section 6, states that local governments must hold a Public Hearing and notify property owners and customers at least 45 days in advance of Public Hearings related to proposed property-related new or increased fees and charges for recycling and trash services. At the Public Hearing, if it is determined that a majority of affected customers and property owners have submitted formal written protests, the proposed fee changes must be rejected. This is a requirement of Proposition 218, passed by California voters in 1996, to limit methods by which local governments can create or increase taxes, fees and charges without taxpayer consent. Any affected customer or property owner interested in objecting to the increases may file a signed written protest with the city clerk. The written protest must contain the address of service, the rate change being protested and be received prior to close of the Public Hearing. While protestors may appear at the Public Hearing and be heard on the matter, only written protests are considered as part of the majority protest. WHEREAS, the City of Carlsbad is proposing increases to recycling and trash rates related to green waste, to be effective Jan. 1, 2020, to reflect increased per-ton processing rates at Palomar Transfer Station for composting all ofthe city's green waste at Agromin -OC, LLC; and WHEREAS, the California Constitution Article XIIID, Section 6(a)(2) states that local governments must hold a Majority Protest Public Hearing and notify customers not less than 45 days in advance of the Public Hearing regarding increases in recycling and trash collection rates; and WHEREAS, the California Constitution Article XIIID, Section 6{a)(2) states that if a majority of affected property owners or customers submit a written protest prior to the close of the Public Hearing, then a rate increase shall not be imposed; and WHEREAS, the written protests received represent less than a majority of affected property owners and customers; and WHEREAS, Coast Waste Management, Inc. is the exclusive provider of residential and commercial recycling and trash solid waste services in the City of Carlsbad under a contract approved by City Council in 2012 by adopted Resolution No. 2012-033; and WHEREAS, the contract with Coast Waste Management, Inc. provides for adjustments to recycling and trash collection rates to be made as part of the city's budget adoption process through fiscal year 2021-22, as long as the rate increases meet certain requirements; and WHEREAS, on Oct. 21, 2019, affected property owners and customers were notified by U.S. mail of the proposed increases in recycling and trash rates related to green waste, thereby complying with the advance notice requirement of 45 days; and WHEREAS, on Dec. 10, 2019, the City Council of the City of Carlsbad held a Majority Protest Public Hearing regarding the proposed increases to recycling and trash rates related to green waste. I am on a fixed retirement income where annual COLA increases don't come close to mitigating increases in any of my utilities. 4. The city already requested a 1.1 % trash collection rate increase in 2017 (effective 2018?). 3. The city is also requesting water rate increases for 2020 and 2021 without any increase in quality or quantity. When will we ever see any real cost benefit from the desalination plant? 5. Past Governor Moonbeam's outrageous fuel and vehicle registration tax, rammed through the corrupt state legislature without a vote of the people, is still costing us hundreds of dollars each year. To people with intelligence, common sense, and logic, rate increases appear to be a clandestine way for employee pay raises. When does it end? When will COLA ever match actual real inflation? To the City Clerk of the City of Carlsbad, and the Honorable Carlsbad City Council Members: We would like to protest all of the proposed green waste rate increases proposed by the City of Carlsbad to become effective on January 1, 2020, if adopted at the public hearing on December 10, 2019, for the following reasons: The current monthly green waste rates are already too high, and we believe they should be reduced, not increased. Furthermore, we believe Coast Waste Management is already making an unreasonable profit under its exclusive and quasi-monopolistic long-term recycling and trash contract with the City of Carlsbad, thereby already unreasonably burdening all public residents and businesses of the city in its continuing quest for even more private profits. Moreover, Coast Waste Management has been unwilling in the past to produce any related basic income and expense information relating to its public services and contract previously requested by us in 2017, in numerous public record requests. Coast Waste Management claims such information does not exist. Coast Waste Management apparently does not maintain accounting books and records relating to its public service contract with the City of Carlsbad. Is this acceptable to the City Council of Carlsbad? Finally, the City's notice of public hearing flyer regarding the green rate increases does not provide any information at all supporting and discussing why the net rate increases proposed are necessary. lt only states the City's contractor guarantees its net rates will be in the lowest third of net rates being charged for similar services in all cities in San Diego County using a franchised collecti,on system. This is another reason why the City's new proposed green waste rate increases should not be adopted. The Carlsbad City Council must recognize its fiduciary oversight responsibility is to its public utility customer ratepayers. As publicly elected officials, the Carlsbad City C . uncil is supposed to be an independent ratepayer advocate for its ratepayers, obtaining and ma· taining the lowest possible public utility rates for them. I have 1 small recycle can and 2 large. Most weeks I only use the 1 small. Only a few times a year do I use all three. According to the new rates, it looks like I will be charged the listed highest rate because of my 2 large cans, even though most weeks I don't use them. I'm sure I'm not alone in having several sizes of recycle cans and probably not alone in mostly not using all 3. In fact I have another property with the exact same setup: 1 small and 2 large cans. It also usually only uses the 1 small can . The rates should be based on what is actually used, or at the very least divided among whatever sizes people have (even though this doesn't necessa rily coincide with their weekly usage). My reasons for protesting are as follows: The current fee schedule makes little sense. Residents who have 96 and 64 gallon carts should pay far more than those of use who have a 35 gallon cart. The costs should be proportional to the amount of trash, recyclables and green waste produced. There appears to be no accounting for the fact (no discussion of the fact in the staff report) that many people have multiple green waste bins. Will they continue to pay one set fee for multiple bins? While it would be preferable for low waste producers such as myself, to not have to use the city franchised system at all for waste removal, this is especially true for green waste. Some residents, such as myself, who mulch and compost all their green waste, should not have to pay for this service. Others who have g:m:ien~ who haul away their green waste should also not have to pay. The rewrt also provides no discussion of what cost will be paid by residents who have a variety of sized bins for trash, recyclables, and green waste. Will the cost be set by the la.rgest bin you have? This should be discussed in the report. It seems inaccurate to title the hearing ''Proposed Green Waste Rate Increases" when there is only one fee paid by residents for all waste services. The proposed green waste rate increase is before us now because the city has not made enough effort over the past several years to develop a program to properly use green waste as mulch and compost (instead we have opted to waste a valvable resource iis AnC), Wi1"1"e and recycling programs need to be a Council priority, Staff needs to be given the time and resources to develop a more comprehensive program to educate and incentivize residents to reduce their waste streams. I'm sure I'm not alone in having several sizes of recycle cans and probably not alone in mostly not using all 3. In fact I have another property with the exact same setup: 1 small and 2 large cans. It also usually only uses the 1 small can. The rates should be based on what is actually used, or at the very least divided among whatever sizes people have (even though this doesn't necessarily coincide with their weekly usage).
