accordance with all bid requirements may be determined the apparent low bidder. In
accordance with CMC Section 3.28.087, JOCs are awarded to the lowest responsive and
responsible bidder.
City staff determined needs in two work categories that are appropriate for job order
contracting: heating, ventilation and air conditioning, and sewer pipeline rehabilitation and
access hole replacement. On Nov. 4, 2019, a Request for Bids for these work categories was
advertised using the city's formal bidding procedures. A mandatory pre-bid meeting was held
on Dec . 5, 2019 with 12 contractors in attendance.
A bid opening was held on Dec. 13, 2019. Three sealed bids were received for the heating,
ventilation and air conditioning work category. Two bids were received for the sewer pipeline
rehabilitation and access hole replacement work category. Based on an evaluation of the bids
consistent with CMC Section 3.28.087, staff is recommending the city execute JOCs with the
lowest responsive and responsible bidders for each discipline as follows:
1. Acco Engineered Systems for heating, ventilation and air conditioning
2. HPS Plumbing Services for sewer pipeline rehabilitation and access hole replacement
The initial term for each JOC is three years, with the option tci extend for two additional one-
year periods, for a total term of five years.
Fiscal Analysis
For each JOC, the maximum contract value over the five~year term is $1 million, consistent with
CMC Section 3.28.087. Task orders for specific projects are executed against the value of each
contract. Task order values are constrained by the availability of project funding appropriated
through regular annual budgeting processes.
JOCs will be subject to annual price adjustments on the anniversary of the contract award date,
based on the widely recognized industry standard Construction Cost Index published by
Engineering News-Record.
Next Steps
As specific projects are identified, staff will execute task orders against the JOCs that include a
detailed scope of work, completion time and a total lump sum, fixed price.
Environmental Evaluation {CEQA)
Pursuant to Public Resources Code Section 21065, this action to award JOCs does not constitute
a "project" within the meaning of the California Environmental Quality Act (CEQA) in that it has
no potential to cause either a direct physical change in the environment, or a reasonably
foreseeable indirect change in the environment, and therefore does not require environmental
review.

RESOLUTION NO. 2020-041
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING JOB ORDER CONTRACTS
(JOCs) TO ACCO ENGINEERED SYSTEMS FOR HEATING, VENTILATION AND
AIR CONDITIONING, AND HPS PLUMBING SERVICES FOR SEWER PIPELINE
REHABILITATION AND ACCESS HOLE REPLACEMENT.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary,
desirable and in the public interest to perform repair and construction work for heating, ventilation
and air conditioning, and sewer pipeline rehabilitation and access hole replacement using job order
contracting; and
WHEREAS, job order contracting allows for recurring repair or construction work to be
completed under a single competitively bid contract using firm, fixed pricing; and
WHEREAS, Carlsbad Municipal Code Section (CMC) Section 3.28.087 provides definitions and
guidelines for the award, use and evaluation of JOCs; and
WHEREAS, a formal bidding process for JOCs in the categories of heating, ventilation and air
conditioning, and sewer pipeline rehabilitation and access hole replacement, was completed on Dec. 13,
2019;and
WHEREAS, Acco Engineered Systems submitted the lowest responsive and responsible bid for
heating, ventilation and air conditioning; and
WHEREAS, HPS Plumbing Services submitted the lowest responsive and responsible bid for
sewer pipeline rehabilitation and access hole replacement; and
WHEREAS, the initial term for each JOC is three years, with the option to extend for two
additional one-year periods, for a total term of five years; and
WHEREAS, each JOC has a maximum contract value of $1 million over the five-year term,
consistent with CMC Section 3.28.087; and
WHEREAS, CMC Section 3.28.087(D)(2) authorizes the city manager to issue task orders less
than the dollar amount specified in California Public Contract Code Section 22032(b); and
WHEREAS, expenditures against these JOCs are subject to availability of project funding
appropriated through regular annual budgeting processes.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the low bid submitted by Acco Engineered Systems for heating, ventilation and air
conditioning is accepted and the mayor is hereby authorized to execute a JOC for this
work.
3. That the low bid submitted by HPS Plumbing Services for sewer pipeline rehabilitation
and access hole replacement is accepted and the mayor is hereby authorized to execute
a JOC for this work.
4. That the city manager or designee is hereby authorized to issue task orders against JOCs
in accordance with the dollar amount specified in California Public Contract Code
Section 22032(b).
5. That the award of this contract is contingent upon Acco Engineered Systems and HPS
Plumbing Services executing the required JOCs and submitting the required bonds and
insurance policies, as described in the contract, within 20 days of adoption of this
Resolution. The city manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 25th day of February 2020, by the following vote, to wit:
