HomeMy WebLinkAbout2020-04-07; City Council; ; Authorize Deputy City Manager, Public Works, or designee to execute all necessary forms for payment programs through the California Department of Resources, Recycling andglass, plastic and bi-metal. Projects implemented by cities and counties will assist in reaching and maintaining this goal. The Public Works Branch, Environmental Management Department, wishes to continue utilitizing available funding to support these programs, and with City Counci l's approval, will apply for, accept and appropriate payment program funding through CalRecycle for a period of five years from the date of resolution adoption. Funding will be used on qualified expenditures in an effort to increase awareness through education and outreach to the community, increase availabilty of recycling opportunities, and pay for staff time related to program management. Cal Recycle is required to establish procedures governing administration of the payment programs. Their procedures require an applicant's governing body to declare by resolution certain authorizations related to administration of the payment program. With City Council's approval, the Deputy City Manager, Public Works, or designee will be authorized to execute all necessary forms for payment programs through Cal Recycle. Fiscal Analysis Cal Recycle payment programs require that the funds be expended within the 24-month term of the program. Any unused funds must be returned to Cal Recycle within 45 days of the end of the term. If the city's applications are approved for payment by Cal Recycle, funds are normally received annually in April for the Used Oil Payment Program, and in October for the Beverage Container Recycling Payment Program . The table below shows a summary of payments received by the city in the last five fiscal years from the CalRecycle Beverage Container Recycling Payment Program: Program Year Beverage Container Recycling Payment Program 2018-19 $28,231 2017-18 $28,347 2016-17 $28,339 2015-16 $28,166 2014-15 $29,160 No direct funding from the city is required to participate in the Cal Recycle program. Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of California Environmental Quality Act (CEQA) in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification and Outreach This item was noticed in accordance with the Ralph M. Brown Act and was ava ilable for public viewing and review at least 72 hours prior to scheduled meeting date. EXHIBIT 1 WHEREAS, pursuant to Public Resources Code Sections 48000 et seq., 14581, and 42023.l(g), the California Department of Resources, Recycling and Recovery (CalRecycle) has established various payment programs to make payments to qualifying jurisdictions; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Deputy City Manager, Public Works, or designee, is hereby authorized as Signature Authority to execute all documents necessary to implement, secure and appropriate payments. 3. This authorization is effective for five years from the date of its adoption.
