Executive Summary/Discussion Per California Elections Code Section 10263, the governing body shall adopt a resolution reciting the facts of the results of the March 3, 2020 Special Municipal Election. The San Diego County Registrar of Voters has completed the canvass for the Special Municipal Election held on March 3, 2020. As of March 2, 2020, the City of Carlsbad had 16,537 registered voters in District 1. The percentage of voter turnout for the March 3 Special Municipal Election was approximately 54%. The City of Carlsbad’s election was consolidated with the County of San Diego Primary Election and was held to elect a City Council Member from District 1 for a term ending in November 2022 to fill the vacancy resulting from the resignation of City Council Member Barbara Hamilton. Based on the results the Registrar of Voters has provided, Cori Schumacher was elected District 1 City Council Member for a term ending in November 2022. Fiscal Analysis The total election cost projection provided by the San Diego County Registrar of Voters for the March 3, 2020 election was approximately $7,500 - $19,500. The City Clerk’s department adopted budget for FY 2019-20 included the necessary funds to cover the costs related to the election. An invoice from the County of San Diego finalizing the election costs is pending. Next Steps The City Clerk will provide the Oath of Office to the elected official following adoption of the attached resolution. April 7, 2020 Item #1 Page 1 of 32 Environmental Evaluation (CEQA) Pursuant to Public Resources Code Section 21065, this action does not constitute a “project” within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1. City Council resolution April 7, 2020 Item #1 Page 2 of 32 RESOLUTION NO. 2020-053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON MARCH 3, 2020, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW Exhibit 1 WHEREAS, the City Council adopted Resolution No. 2019-217 on Nov. 8, 2019, calling a Special Municipal Election for the purpose of electing one Council Member to fill a vacancy from District 1 for a term ending in November 2022; and, WHEREAS, a Special Municipal Election was held and conducted in the City of Carlsbad, California, on Tuesday, March 3, 2020 as required by law; and, WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California; and, WHEREAS, the San Diego County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, and the results are received and attached hereto as Attachment A. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the number of ballots cast in the City of Carlsbad was 8,896. 3. That the names of the persons voted for City Council Member District 1 at the Special Municipal Election were as follows: Simon Angel Tracy Carmichael Cori Schumacher 4. That the City Council does declare and determine that Cori Schumacher was elected as Member of the Carlsbad City Council -District 1 for a term ending in November 2022. 5. That the City Clerk's Office shall enter in the records of the City Council of the City of Carlsbad, a statement of the results of the election showing: April 7, 2020 Item #1 Page 3 of 32 (1) The whole number of ballots cast in the City (2) The names of the persons voted for (3) For what office each person was voted for (4) The number of votes given at each precinct to each candidate. 6. That the City Clerk's Office shall immediately make and deliver to the elected person a Certificate of Election signed by the City Clerk and authenticated; that the Oath of Office shall be administered as prescribed in the Constitution of the State of California and shall have the elected person subscribe to it and file it in the City Clerk's Office. The elected person shall then be inducted into the respective elective office. 7. That the City Clerk shall certify to the passage and adoption of this Resolution. This gave the people the opportunity to vote for their representative which is respecting democracy. I fully respect the citizen's right to vote and now recognize that Council Member Schumacher has received" enough votes and will be the council member for District 1; Congratulations, to you; Council Member Schumacher. It is my hope you will be open and that your actions wiU be representative of ALL citizens and not those of special interest. I wish you only the best because that is what the Carlsbad citizens deserve. · However; today, we are at a critical point in time that requires full representation and essential to effectively govern on behalf of the people.
