Living Trust
Recommended Action
Adopt a resolution accepting a $50,000 donation from the Frank S. Sutton Revocable Living
Trust.
Executive Summary
The Frank S. Sutton Revocable Living Trust has donated $50,000 to the Carlsbad City Library to
support community programming. Carlsbad Municipal Code Section 2.08.100 requires
donations over $5,000 to be approved by the City Council.
Discussion
Frank S. Sutton attended films, concerts, exhibitions and receptions held at the Carlsbad City
Library on Dove Lane. His daughter Mary Jo Sutton reported that he loved “the generosity and
mission of the Dove Library. He grew up poor and appreciated the valuable services that
libraries provide.” She wrote that he “appreciated [the] vision of freely sharing and celebrating
the creative arts in a public venue… He loved theater, storytelling, dance, and music...” To help
ensure others have an opportunity to enjoy such events, the Frank S. Sutton Revocable Living
Trust has donated $50,000 to support the Carlsbad City Library’s community programming.
With gratitude to Mr. Sutton’s daughter and his estate, staff recommends the City Council
accept the donation.
Fiscal Analysis
The Sutton donation will be deposited in a Library & Cultural Arts special revenue account, with
a designation for expenditures in support of community programming.
Next Steps
Library staff will request appropriation of the funds through the regular budget process, both
subject to City Council approval and in accordance with Frank Sutton’s wish to support
community programming.

Environmental Evaluation (CEQA)
In keeping with Public Resources Code section 21065, this action does not constitute a
“project” within the meaning of the California Environmental Quality Act in that it has no
potential to cause either a direct physical change in the environment, or a reasonably
foreseeable indirect physical change in the environment, and therefore does not require
environmental review.
Public Notification and Outreach
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to scheduled meeting date.

RESOLUTION NO. 2020-095
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING A $50,000 DONATION FROM THE FRANK S.
SUTTON REVOCABLE LIVING TRUST.
Exhibit 1
WHEREAS, Frank S. Sutton bequeathed a portion of his estate to the Carlsbad City Library to
support community programming; and
WHEREAS, the Sutton donation of $50,000 will be deposited in a Library & Cultural Arts special
revenue account; and
WHEREAS, library and cultural arts staff will request appropriation of the funds through the
regular budget process, in accordance with Frank S. Sutton's wish to support community programming.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the City Council accepts a gift of $50,000 from the Frank S. Sutton Revocable Living
Trust, which will be directed to a Library & Cultural Arts special revenue fund to support
community programming.
PASSED, APPROVED AND ADOPTED at a Special Meeting of the City Council of the City of
Carlsbad on the 2nd day of June 2020, by the following vote, to wit:
