The City Council ratified this proclamation on March 17, 2020, and adopted the findings and determinations made by the director in support of the proclamation, which was to expire on May 15, 2020, at 5:00 p.m., unless otherwise lawfully extended or terminated earlier by the City Council. On May 12, 2020, the City Council extended the Proclamation of Local Emergency until the City Council takes further action, the need for which the City Council will review when the state and county states of emergency end. On April 2, 2020, the director ordered the prohibition of parking on: Carlsbad Boulevard, from Pine Avenue to La Costa Avenue Ponto Drive, from Ponto Road to the south terminus Ponto Road, in its entirety The director’s action was necessary to deter the public from congregating on the beaches within Carlsbad in violation of the state executive order and county public health order. Exhibit 3 shows the locations of the subject no parking zones. June 4, 2020 Item #1 Page 1 of 26 On April 7, 2020, the City Council ratified and codified the director’s order by enacting urgency Ordinance No. CS-372, which added Section 10.40.300 to the Carlsbad Municipal Code (Exhibit 4). Since April 7, 2020, the state executive order and county public health order have been amended to allow increasing public use of beaches. Effective June 2, 2020, the county public health order began allowing some passive use of beaches, including sunbathing, which is expected to significantly increase the number of beach goers. The anticipated increase in beach use has created an urgent need to repeal Carlsbad Municipal Code Section 10.40.300 to ensure the related vehicle traffic and parking impacts do not harm the public peace, health and safety. Discussion Under Carlsbad Municipal Code Section 6.04.100(A)(6)(a), the director of emergency services is empowered to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency. However, such rules must be confirmed by the City Council. The director of emergency services has been directed and authorized by the City Council to address any impacts and conditions caused by the spread of COVID-19. On March 27, 2020, the San Diego County health officer ordered that, “Government entities shall enforce social distancing requirements at all beaches and parks; if a government entity is unable to enforce social distancing at a beach or park, it shall be closed to the public.” This order was effective on March 29, 2020. To deter ongoing violations of the county public health order, on April 7, 2020, the City Council ratified and codified an April 2, 2020 order of the director by enacting urgency Ordinance CS- 372, which added Section 10.40.300 to the Carlsbad Municipal Code, temporarily establishing no parking zones on:  Carlsbad Boulevard, from Pine Avenue to La Costa Avenue  Ponto Drive, from Ponto Road to the south terminus  Ponto Road, in its entirety This ordinance prohibited parking on both sides of these roadways. Parking in these areas constitutes a parking violation under Chapter 10.42 of the Carlsbad Municipal Code. The ordinance and any corresponding authorizations were to remain in effect until expiration of the local emergency declared as a result of the spread of COVID-19. Effective June 2, 2020, the county public health order was amended to begin allowing some passive use of beaches, including sunbathing. This amendment is expected to significantly increase the number of visitors to Carlsbad beaches. Under Carlsbad Municipal Code Section 6.04.100(A)(6)(a), the director of emergency services is empowered to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency. The director of emergency June 4, 2020 Item #1 Page 2 of 26 services has determined that the anticipated increase in beach use creates an urgent need to increase parking capacity near Carlsbad beaches to protect the public peace, health and safety. Without an increase in parking capacity near Carlsbad beaches, the director anticipates the following adverse impacts will occur: excess speeding, reckless driving, illegal turns, illegal parking, disregard for pedestrian and bicyclist safety, and other unsafe actions. Consequently, the director recommends the City Council adopt an urgency ordinance repealing Carlsbad Municipal Code Section 10.40.300. The June 2, 2020, amended public health order, through a link to the Physical Distancing and Safety Plan for County of San Diego – Parks and Beaches, also removed the restriction of half- capacity maximum on reopening of the parking lots in public parks. Staff recommends adoption of a resolution to open all parking lots in city parks to full capacity effective Friday, June 5, 2020 no later than 2 p.m. Regarding beach parking lots, State Parks opened the beaches within the city limits of Carlsbad for certain uses in keeping with the state executive order and county public health order, but the State Parks parking lots near the beaches remain closed. When State Parks decides to open beach parking lots per the Governor’s direction, staff will notify the City Council of the decision. Fiscal Analysis At this time, the repeal of Carlsbad Municipal Code Section 10.40.300 is expected to have limited fiscal impact. Next Steps Under California Government Code Section 36937, subdivision (b), the urgency ordinance repealing Carlsbad Municipal Code Section 10.40.300 will become effective immediately upon passage by a four-fifths vote of the City Council. If the urgency ordinance is adopted, staff will expeditiously remove signage and barricades and reopen parking in the affected streets no later than 2 p.m. on Friday, June 5, 2020. Upon the City Council’s adoption of the resolution to reopen all parking lots in city parks to full capacity, staff will expeditiously remove signage and barricades no later than 2 p.m. on Friday, June 5, 2020. Upon notification of State Parks’ decision to reopen beach parking lots per the Governor’s direction, staff will notify the City Council of the decision. Environmental Evaluation (CEQA) The project is exempt from the California Environmental Quality Act under State CEQA Guidelines Section 15301(c) – minor alteration of existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion. Public Notification and Outreach This item was noticed in accordance with the Ralph M. Brown Act and was available for public viewing and review at least 24 hours prior to the scheduled meeting date. EXHIBIT 1 WHEREAS, on March 16, 2020 the Director of Emergency Services (Director) signed a Proclamation of Local Emergency as a Result of the Spread of COVID-19; and WHEREAS, the City Council ratified the Proclamation of Local Emergency on March 17, 2020, and adopted the findings and determinations made by the Director in support of the proclamation; and WHEREAS, the Proclamation of Local Emergency will remain in effect until further action by the City Council, the need for which will be reviewed when the state and county states of emergency end; and WHEREAS, to reduce the spread of COVID-19, the County Health Officer ordered, effective March 29, 2020, that "Government entities shall enforce social distancing requirements at all beaches and parks; if a government entity is unable to enforce social distancing at a beach or park, it shall be closed to the public"; and WHEREAS, because social distancing requirements were not being followed at Carlsbad beaches and to deter further ongoing violations of the County Health Officer's order, on April 2, 2020, the Director ordered the prohibition of parking on Carlsbad Boulevard from Pine Avenue and La Costa Avenue, on Ponto Drive from Ponto Road to the south terminus, and on Ponto Road; and WHEREAS, on April 7, 2020, the City Council introduced and adopted urgency Ordinance No. CS-372, ratifying and codifying the Director's order by adding Section 10.40.300 to Title 10, Chapter 10.40 of the Carlsbad Municipal Code; and WHEREAS, since the City Council's enactment of Carlsbad Municipal Code Section 10.40.300, the County Health Officer's order has been amended to permit some public use of the beach; and WHEREAS, the permissible public use of the beach has resulted in traffic and parking impacts adversely affecting the public peace, health and safety; and WHEREAS, the adverse effects include excess speeding, reckless driving, illegal turns, illegal parking, disregard for pedestrian and bicyclist safety, and other unsafe actions; and June 4, 2020 Item #1 Page 5 of 26 WHEREAS, on June 2, 2020, the County Health Officer's order was amended to allow additional public use of the beach, including sunbathing; and WHEREAS, the additional public use of the beach is expected to substantially increase the number of beach visitors, exacerbating the traffic and parking impacts and further adversely affecting the public peace, health and safety; and WHEREAS, the further adverse effects are expected to include a shortage in available Americans with Disabilities Act (ADA)-compliant parking spaces, an increase in excess speeding, reckless driving, illegal turns, illegal parking, disregard for pedestrian and bicyclist safety, and other unsafe actions; and WHEREAS, to accommodate the substantial increase in the number of beach visitors, reduce the related traffic and parking impacts and protect the public peace, health and safety, the Director has recommended the City Council immediately repeal Carlsbad Municipal Code Section 10.40.300 and eliminate the no parking zones on Carlsbad Boulevard from Pine Avenue and La Costa Avenue, on Ponto Drive from Ponto Road and the south terminus, and on Ponto Road. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, ordains as follows that: 1. The above recitations are true and correct. 2. That Carlsbad Municipal Code Section 10.40.300 is repealed in its entirety. 3. That the City Council finds and declares that the adoption and implementation of this ordinance is an urgency measure required for the immediate preservation of the public peace, health and safety for the reasons stated in the recitals. 4. That under California Government Code Section 36937, subdivision (b), this ordinance shall take effect immediately upon its passage by a four-fifths vote of the City Council. WHEREAS, COVID-19, a novel coronavirus, is a respiratory disease with symptoms including cough and shortness of breath or difficulty breathing, for which outcomes range from mild to severe, and in some cases death; and WHEREAS, on January 30, 2020, the World Health Organization declared the spread of COVID-19 a "public health emergency of international concern"; and WHEREAS, on January 31, 2020, United States Health and Human Services Secretary Alex M. Azar II declared a Public Health Emergency for the United States, effective January 27, 2020, to aid the nation's health care community in responding to the spread of COVID-19; and WHEREAS, on February 14, 2020, the San Diego County Health Officer declared a Local Health Emergency as a result of the spread of COVID-19, which was subsequently ratified by the Board of Supervisors on February 19, 2020; and WHEREAS, on March 4, 2020, the State of California declared a State of Emergency as a result of the spread of COVID-19; and WHEREAS, on March 11, 2020, the World Health Organization began characterizing COVID-19 as a pandemic; and WHEREAS, on March 13, 2020, the President ofthe United States declared a national emergency as a result of the spread of COVID-19; and WHEREAS, the Director of Emergency Services has determined that conditions of extreme peril to the safety of persons and property have arisen within the City of Carlsbad caused by the spread of COVID-19 and the conditions require an emergency response, with the potential need for resources beyond the capacity and control of the services, personnel, equipment, and facilities of the City of Carlsbad; and WHEREAS, on March 16, 2020, the Director of Emergency Services issued a Proclamation declaring a Local Emergency as a result of the spread of COVID-19, as authorized by Government Code section 8630 and Carlsbad Municipal Code Chapter 6.04, which was ratified by the City Council on March 17, 2020; and June 4, 2020 Item #1 Page 9 of 26 WHEREAS, the Proclamation of Local Emergency directs and authorizes the Director of Emergency Services, or a designee, to address any and all impacts and conditions caused by the spread of COVID-19 and to obtain any and all aid and assistance from local, county, state, or federal agencies, including but not limited to aid and assistance pursuant to the California Disaster Assistance Act, California Government Code Section 8680 et seq.; and WHEREAS, the Proclamation of Local Emergency will remain in effect until further action by the City Council, the need for which will be reviewed when the state and county states of emergency end; and WHEREAS, Executive Order N-25-20 issued by the Governor of the State of California on March 12, 2020 orders that "All residents are to heed any orders and guidance of state and local health officials, including but not limited to the imposition of social distancing measures, to control COVID-19"; and WHEREAS, on March 19, 2020, the Governor of the State of California issued Executive Order N-33- 20, which ordered all individuals living in the State of California to stay home or at their place of residence except as needed to maintain continuity of operations of the federal critical infrastructure sectors; and WHEREAS, effective March 23, 2020, the City of Carlsbad temporarily closed city parks, trails and parks to help slow the spread of COVID-19; and WHEREAS, on March 27, 2020, an update to the San Diego County Health Officer's order required cities to close parks, trails, and parks where members of the public were not following social distancing rules; and WHEREAS, on April 24, 2020, the San Diego County Health Officer issued an order, effective April 27, 2020, which required the City of Carlsbad to submit and implement Social Distancing and Sanitation Protocols in order to open public parks and recreation areas, including public parks, for walking, hiking, equestrian or bicycle riding; and WHEREAS, on April 30, 2020, the San Diego County Health Officer issued an updated order which included sections pertinent to the City Council's consideration of allowing access to the city's parks; and WHEREAS, the city allowed access to the city's parks as of Monday, May 4, 2020, at 2 p.m.; and WHEREAS, the access to these parks was limited to the passive areas only, and all community centers, aquatic centers, athletic fields, sports courts, playgrounds, dog parks, skate parks and similar areas remained closed; and WHEREAS, all other park sites (and school sites under joint use agreements) containing only active areas, such as those described above, remained closed; and June 4, 2020 Item #1 Page 10 of 26 WHEREAS, this access was more restrictive than the county's protocol for parks, which stated "All active sports areas, such tennis and basketball courts, shall be limited to use by members of a single family/household"; and WHEREAS, the park parking lots complied with the county's protocol for parks, which stated "Parking limitation -reduce number of available spaces by 50%"; and WHEREAS, the June 2, 2020 amended public health order, via a link to the Physical Distancing and Safety Plan for County of San Diego -Parks and Beaches, removed the restriction of half-capacity maximum on reopening of the parking lots in public parks. CS-372 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ESTABLISHING A NO PARKING ZONE ON CARLSBAD BOULEVARD BETWEEN PINE AVENUE AND LA COSTA AVENUE, AND ON PONTO DRIVE BETWEEN PONTO ROAD AND THE SOUTH TERMINUS, AND ON PONTO ROAD WHEREAS, on March 16, 2020 the Director of Emergency Services (DES) signed a Proclamation of Local Emergency as a Result ofthe Spread of COVID-19; and WHEREAS, the Proclamation of Local Emergency was ratified by the City Council on March 17, 2020 and the City Council adopted the findings and determinations made by the DES in support of the proclamation; and WHEREAS, the Proclamation of Local Emergency shall expire on May 15, 2020 at 5:00 p.m. unless otherwise lawfully extended or terminated earlier by the City Council; and WHEREAS, the DES has been directed and authorized to address any impacts and conditions caused by the spread of COVID-19; and WHEREAS, under Carlsbad Municipal Code Section No. 6.04.l00(A)(G)(a) the DES is empowered to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency, however such rules must be confirmed by the City Council; and WHEREAS, the County Health Officer ordered on March 27, 2020, effective on March 29, 2020, that "Government entities shall enforce social distancing requirements at all beaches and parks; if a government entity is unable to enforce social distancing at a beach or park, it shall be closed to the public."; and WHEREAS, social distancing requirements are not being followed at Carlsbad beaches; and WHEREAS, a stated purpose of the County Public Health order is to decrease the likelihood that gatherings will attract people from a broad geographic area and to prevent gatherings of a large number of people at a single location; and WHEREAS, the prohibiting of parking on Carlsbad Boulevard between Pine Avenue and La Costa Avenue, on Ponto Drive from Ponto Road to the south terminus, and on Ponto Road would discourage large gatherings of people from a broad geographic area at the beaches of Carlsbad; and Exhibit 4 June 4, 2020 Item #1 Page 24 of 26 WHEREAS, on April 2, 2020 the DES ordered the prohibition of parking on Carlsbad Boulevard between Pine Avenue and La Costa Avenue, on Ponto Drive from Ponto Road to the south terminus, and on Ponto Road; and WHEREAS, California Government Code Section No. 8634 allows the City Council, as the governing body, to make orders and regulations necessary to provide for the protection of life and property; and WHEREAS, the City Council finds that there is an emergency necessitating immediate adoption. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, ordains as follows that: 1. The above recitations are true and correct and are each incorporated by reference. 2. That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended by the addition of Section 10.40.300 to read as follows: 10.40.300 Parking Restricted on Carlsbad Boulevard between Pine Avenue and La Costa Avenue, on Ponto Drive from Ponto Road to the south terminus, and on Ponto Road: There will be no parking on each side of Carlsbad Boulevard from Pine Avenue to La Costa Avenue, on each side of Ponto Drive from Ponto Road to the south terminus, and on each side of Ponto Road. 3. This Ordinance shall remain in effect until the expiration of the Local Emergency as a Result of the Spread of COVID-19. To the extent that it conflicts with Carlsbad Municipal Code Sections No. 10.40.041 and 10.40.127, this ordinance shall control. 4. The City Council finds and declares that the adoption and implementation of this Ordinance is an emergency measure required for the immediate preservation of the public peace, safety, health, and welfare, for the reasons set out herein and pursuant to Government Code Section No. 36937, and shall take effect immediately upon its adoption by four-fifths of the City Council. EFFECTIVE DATE: This Ordinance shall be effective immediately upon its adoption; and the City Clerk shall certify the adoption of this Ordinance and cause the full text of the Ordinance or a summary of the Ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. The beaches, stores and restaurants are now open for additional activities and that will bring larger crowds to the beach that will stay at the beach for longer periods of time. This is going to increase demand on parking spaces in an already overcrowded parking area. The increased crowds will need to cross Carlsbad Blvd from the residential areas and this will increase the probability of a pedestrian-vehicle accident along this space. The residents who live adjacent to the beach have already seen parking spaces at a premium for their own use and if Carlsbad Blvd parking 'is not restored., the problem will become unmanageable. The number of persons with the virus have decreased over the last few weeks and the people in Carlsbad have adhered to the rules. Most medical experts seem to think the safest place to be during this virus is in the sun and open spaces. The beach creates the best place for people to go to be best protected from the virus. Carlsbad is in a unique situation where there are not thousands of parking places available for beach goers. Even with parking along Carlsbad Blvd, the beach will not be (or ever has been) overcrowded, so distancing can easily be accomplished without putting pedestrians at risk crossing the street and allow more disabled persons to access the beach from a greater number of places. I have now seen men's bare hairy butts as they change with no regards for whom they moon, men and children pissing on properties, changing dirty diapers on homeowners grass and leaving them there, arguments with property owners because of blocked driveways and out of control speeding just to get out of the neighborhood chaos. Running my usual route from Los Robles North to Cannon Drive, heading East on Cannon, I cross El Arbol. To my point, as drivers release frustration, they speed out of our neighborhood. As I approached El Arbo I, a non-resident with no intention of stopping at the stop sign, appeared to look left to see if it was clear and continued faster than rolling speed through the stop sign within feet of me. He never made eye contact, hence my hesitation and changing my stride to a near stop. All the while, he continued his right turn, never even knowing he nearly ran me over. At the time, cars stacked on both sides of the street, a family walking with a stroller, a fellow neighbor running towards me as well as a surfer suiting up. They all stopped and were simply in amazement, this guy never stopped and never knew he narrowly ran me over. Carlsbad Municipal Code 4 Public Health Orders •Since late April, state and county public health orders have been amended to allow increasing public use of beaches •Effective June 2, 2020, the county public health order allowed some passive uses of beach, including sunbathing, which is expected to significantly increase the number of beachgoers •Anticipated increase in beach activity has created an urgent need to repeal Carlsbad Municipal Code Section 10.40.300 to ensure the related vehicle traffic and parking impacts do not harm the public peace, health and safety 5 Parking Lots in City
