Chapter 22.06 HISTORIC RESOURCES, HISTORIC LANDMARKS AND HISTORIC DISTRICTS
22.06.010 Establishment of historic resources inventory.

The city shall establish and adopt a histo{ic resources inventory. (Ord. NS-433 § 3, l 997; Ord. NS-141 § 4, 1991 ; Ord.
9776§1,1985)
22.06.020 Criteria for historic resources inventory.
A historic resource may be considered and approved by council for inclusion in the hi storic resources inventory based on
one or more of the following:
A. It exemplifies or reflects special elements of the city's cultural, social, economic, political, aesthetic,
engineering or architectural history; or
B. It is identified with persons or events significant in local, state or national history; or
C. It embodies distinctive characteristics of a style, type, period or method of construction, is a valuable example
of the use of indigenous materials or craftsmanship or is representative ofa notable work of an acclaimed builder,
designer or architect; or
D. It is an archaeological, paleontological, botanical, geological, topographical, ecological or geographical site
which has the potential of yielding information of scientific value; or
E. It is a geographically definable area with a concentration of buildings, structures, improvements, or objects
linked historically through location, design, setting, materials, worlunanship, feeling and/or association, in which the
collective value of the improvements may be greater than the value of each individual improvement. (Ord. NS-433 §

22.06.030 Historic site and landmark designation procedures.
Historic sites and landmarks shall be established by the city council in the following manner:
A. Any person, association, or agency may request the designation of a site, landscape feature, or improvement as
a historic landmark by submitting a written request for such designation to the historic preservation commission. The
historic preservation commission, planning commission, design review board, or city council may also initiate such
proceedings by motion.
B. Any such request shall be filed with the development processing department upon prescribed fonDS and shall
include the following data:
1. Name and address of property owner and assessor's parcel number and address of site;
2. Description of the proposed historic site or landmark, including special aesthetic, cultural, archaeological,
paleontological, architectural, or engineering interest or value of a historic nature, including information about
the architecture, notable features, construction and other information indicating the historical significance of the
site;
3. Sketches, photographs, or drawings;
4. Statement of condition of structures;
5. Explanation of any known tlu-eats to the improvement of the site;
6. Additional information:
a. Site plan in appropriate scale;
b. Legal description of the property;
c. Photographs, old and recent;

C. With in 45 days of the date of the request, the commission shall hold a public hearing to review th e landmark
application according to the criteria of Section 22 .06.020.
D. Notice of the public hearing shall be given as provided in Section 2_1_.54._060(2) of this code. In addition, notice
of the elate, place, time and puipose of th e hearing shall be mai l eel, reh1rn receipt requested, to the owner of the
proposed landmark property as shown on the last equalized assessment roll at least 14 days prior to the date of the
publi c bearing. Failure to send notice by mail to any properly owner when the address of such owner is not on the
lates t equalized assessment role sball not invalid ate any proceedin gs in connection witb the proposed designation.
E. After the public hearing, th e co1ru11ission shall by resolution make a report and recommendation to the city
council. If the commission determines that the improvement does not meet landmark criteria, the process shall
te1111inate and the commiss ion shall notify the property owner and applicant of sucb termination in wri ting within 10
days of the commission's determination. lf the commission determines that tbe res ource warran ts hi stori c site or
landmark designation and the property owner has consented to same in writing, then the commission shall submit a
written recommendation to the city council incorporating its reasons in support of th e proposed designation. Without
the property owner 's consent to the proposed designation, a site shall not be designated a histodc site or landmark.
Permits shall be required to work on a designated hi storic landmark as specified in Chapter 22.08 of thi s code. Permit
fees shall be established by resolution of the city council.
F. The city council shall hold a public hearing on the proposed historic designation within 30 clays of tbe receipt of
the recommendation for the commission.
G. At the conclusion of tb e public hearing on the proposed designation, the city cotmcil shall, by res olution,
designate or conditiona lly designate, or disapprove the designation of the historic landmark. Written notice of the city
council action shall be mailed to the property owner. (Orel. NS-433 § 3, 1997; Orel. 9835 § 2, 1987; Orel. 9776 § 1,

• 22.06~040 Historic district de_signation procedl;lres.
Historic distri cts shall be established by th e city council in the following manner:
A. The prncedures for designating a historic district sha ll be the same as for designating a hi storic landmark,
except as otherwise provided in this section.
B. Any application for des ignation of a historic district shall be filed with the planning division upon th e prescribed
form and shall include the fo llowing data:
1. Boundaries of the proposed district and a list of names and addresses of property owners, assessor's parcel
numbers and addresses of properti ~s vv ithin the boundaries;
2. Descrip tion of the proposed historic di strict, including special aesthetic, culLural , architectural, or
engineering interest or value of a historical nature;
3. Sketches, photographs o.r drawings;
4. Statement of condition of struch1res and imp rovements within the di strict;
5. Explanation of any known threats to any cultural resource within tbe di strict;
6. Other information requested by the planning divis ion.
C. If written consent of all of the owners of property within the proposed district to the proposed designation is not
obtained at the time of the hi storic preservation commission hearing, the process shall terminate and the commission
shall notify the property owners and applicant of such termination within 14 clays of the co mmission 's determination.
D. If the comrn.ission determines that the area warrants historic district designation, it sha ll submit a written
recom mendation to th e city council incorporatin g its reasons in support of th e proposed historic district des ignation,

within 14 clays of reaching its decision. Such reco111111enclation shall include a report contain ing the following
in formation:
I. A map show in g the proposed boundaries oftbe hi storic district identifying all structures within the
boundaries;
2. An explanation of the significance of the proposed district and descrip tion of the cultural resources within
tl1e proposed boundaries;
3. Recommendations as to appropriate permitted uses, special uses, height and area regulations, minimum
dwelling size, floor area, sign regulations, parking regulations, and any other modification to existing
development standards necessary or appropriate to the preservation of the proposed hi storic district. (01'd. NS-
