ENG. WATER LINE PROJECT IN THE CITY OF CARLSBAD - CMWD PROJECT NO. 89-101 DEPT. HO. F RECOMMENDED ACTION: Adopt Resolution No. 737 for acceptance, execution and award of contract for The Construction of the Jefferson Street Water Line Project in the City of Carlsbad, CMWD Project No. 89-101. ITEM EXPLANATION: The project will involve replacing of older, substandard water mains in Jefferson Street from Grand Avenue to Laguna Drive and from Buena Vista Way to the I-5 bridge; also in Arbuckle Place, Home and Hope Avenues. Water system reliability, domestic water distribution, and fire flow capability will be improved to meet City/District Standards by awarding this contract. Construction traffic control will be in conformance with City approved traffic control plans. Plans and specifications for discussed project were prepared by the District engineering staff. In accordance with section 3.28.A.20 of the Municipal Code, Notice to Bidders was published. Thirteen responses were received, opened, witnessed and recorded on May 15, 1991. The lowest responsive bidder for the contract was Sun Valley Construction Co., Inc., 13675 Highway 8 Business, El Cajon, California 92021 for $254;244.01. FISCAL IMPACT: Funds in the amount of $500,000 have been appropriated in the 1990-1991 budget for water main yreplacement projects in the downtown area. That the bid of Sun Valley Construction Co, Inc., 13675 Highway 8 Business, El Cajon, California 92021, in the amount of $254,244.01 is hereby accepted. 2. That the President of the Board of Directors of the Carlsbad Municipal Water District is hereby‘authorized and directed to execute an agreement, a copy of which is attached hereto marked Exhibit lrBtr for and on behalf of the Carlsbad Municipal Water District. Contractor shall, under the direction and to the satisfaction of District, furnish all labor, materials, equipment, transportation and services for: CONSTRUCTION OF THE JEFFERSON STREET WATERLINE PROJECT IN TEE CITY OF CARLSBAD. in the principal sum of $254.244.0X in accordance with the plans and contract specifications documents, all of which are incorporated herein by reference and made a part hereof. Contractor shall pay to any laborer, mechanic or apprentice employed, the prevailing rate of hourly wages and rates for legal holidays, overtime work, .and standard apprentice wages as set forth in the Advertisement for Bids and keep adequate records thereof. Contractor shall, accordingly, pay as a penalty to the District the sum of up to One Hundred Dollars ($100.00) for each calendar day or portion thereof for each workman paid less than the prevailing and standard wage under this contract, by Contractor and/or any sub- contractor. Contractor shall commence construction within ten (10) calendar days from receipt of Notice to Proceed and pursue said work in a diligent and workmanlike manner without interruption and complete construction thereof within ninety (90) calendar days as noted in the Notice to Proceed. District agrees to pay and Contractor agrees to accept proportionate payments as Work progresses according to specification, subject to additions and deductions provided therein, all in accordance ,with the applicable provisions of Standard Specifications for Public Works Construction which sums shall be computed for the prices set forth in the bid submitted by the Contractor. The Contractor will commence the work required hereunder when required by the Notice to Proceed, and shall complete the work within the following times thereafter: Ninety (90) Calendar Days -l- 4 The Contractor agrees to pay as liquidated damages, the sum noted in Paragraph SP 6-9 in Section 00800 of these specifications, after the stipulated completion date(s) that the work remains uncompleted. 6. This agreement shall be binding upon all Parties hereto and their respective heirs, executors, administrators, successors, and assigns, but shall not be assigned by either Party without the express written consent of the other.
