AMENDMENT OF LOCAL CONFLICT OF
INTEREST CODE
RECOMMENDED ACT
Adopt Resolution No. , amending the Local Conflict of Interest Code for the
Carlsbad Municipal Water District.

The Political Reform Act of 1974 requires all local agencies to amend their Local Conflict of
Interest Codes when circumstances change. The Carlsbad Municipal Water District is an
“agency” within the meaning of the Act; and, therefore, must amend its code.
The proposed amended code is consistent with the City’s Code, and has been incorporated into
one document in order to facilitate the duties of the Filing Officer. The amended code will
become effective immediately upon approval by the Board, and will repeal Title 9 of the
Administrative Code of the Carlsbad Municipal Water District.
FISCAL IMPACT
Costs to implement the amendment will be the amount of staff time required for additional
Resolution No. 35 7 , amending the Local Conflict of Interest Code.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT AMENDING THE LOCAL CONFLICT OF INTEREST CODE OF THE 5
WHEREAS, the District has previously adopted and amended
its local conflict of interest code: and
WHEREAS, provisions of the Political Reform Act of 1974
("the Act"!) (Government Code Section 81000 et seq.) require an
amendment to said code due to changed circumstances, changed duties
or new positions; and
WHEREAS, the Board of Directors of the Carlsbad Municipal
Water District is the code reviewing body within the meaning of the
Act; and
WHEREAS, Government Code Section 87200 has been amended
to require city treasurers and other public officials who manage
public investments to make disclosure under Article 2 of Chapter 7
of the Act; and
WHEREAS, the City has revised job duties, functions and
descriptions and created new positions; and
WHEREAS, the Carlsbad Municipal Water District is a
subsidiary district of the City of Carlsbad and a separate legal
entity and local agency within the meaning of the Act which must
adopt and amend its local conflict of interest code: and
WHEREAS, the existing conflict of interest code of the
District must be repealed upon adoption of this code,
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors
of the Carlsbad Municipal Water District as follows:

Municipal Water District and the Appendix to that Code setting
forth the designated positions and disclosure categories are hereby
approved.
3. Title 9 of the Carlsbad Municipal Water District
Administrative Code entitled I'Conflict of Interest" is repealed and
the executive manager is authorized to implement its repeal and
substitute this code in its place.

ARTICLE I. GENERAL
SECTION I: Title: This Code shall be known and may be cited as "Conflict of Interest Code of the City of Carlsbad and the Carlsbad Municipal Water District."
SECTION II: Authoritv: This Code is adopted pursuant to the provisions of the vPolitical Reform Act of 1974", Title 9 of the Government Code commencing with Government Code Section 81000 and Section 18730 of Article 2 of Chapter 7 of Division 6 of Title 2 of the California Code of Regulations.
SECTION III: Pumose: This Code is adopted in order to:
a. Assure that all employees designated herein perform their duties in an impartial manner, free from bias caused by financial interests;
B. Enumerate and differentiate the positions of employment within the City which involve the making of decisions which may foreseeably have a material effect upon a financial interest;
C. Require the disclosure of such interests, by setting forth the specific types of interests which are reportable for each position;
D. Require that designated employees disqualify themselves from participation in City decision-making which may involve a conflict of interest.
SECTION IV: Incorooration bv Reference: The provisions of Title 2 California Code of Regulations Section 18730, except Section 8.5 thereof, a copy of which is attached hereto marked Exhibit @*A", are hereby incorporated by this reference and constitute the Conflict of Interest Code of the City of Carlsbad and the Carlsbad Municipal Water District.

SECTION V: &!gQ&g&: Section 4 of the Code found in Title 2 California Code of Regulations Section 18730 is replaced with the following Section 4:
Section 4: All designated employees shall file the statements of economic interests required hereinwiththe City Clerk for the City of Carlsbad. Where the person filing such statements is required to file multiple statements on account of his or her capacity in both City and Agency, filing may be made on a single form(s), specifying therein that it is filed in both capacities.
APPENDIX
A. Persons holding positions listed in the Appendix are required to file the initial, annual, and leaving office statements of financial interest required by this Code for the types of interests in the categories set forth in the column f*Disclosure Categoriesf@ opposite the column "Designated Positions". It has been determined that the,se persons make or participate in making decisions which foreseeably may have a material effect on such financial interests.
B. Where the disclosure category requires disclosure of interests in real property, the designated employee need only disclose real property which is located in whole or in part within or not more than two miles outside the boundaries of the jurisdiction or within two miles of any land owned or used by the local government agency. i C. Where the disclosure category requires disclosure of investments or sources of income, the designated employee need only disclose investments in business entities and sources of income which do business in the jurisdiction, plan to do business in the jurisdiction or have done business in the jurisdiction within the past two years. In addition to other activities, a business entity is doing business within the jurisdiction if it owns real property within the jurisdiction.
D. Where the disclosure category requires disclosure of business positions, the designated employee need only disclose positions of director, officer, partner, trustee, employee, or any position of management in organizations or enterprises operated for profit.

SECTION VII: Desianated emnlovee: ' "Designated employeeff means any officer, employee, commission or board member or consultant to the City whose position with the City is listed in the Appendix of this Code.
SECTION VIII: Desianated oosition: "Designated position" means a position with the City specified in the Appendix of this Code and requiring disclosure as provided in this Code because the position entails the making or participating in the making of decisions which may foreseeably have a material effect on a financial interest.
SECTION IX: Resulations: ffRegulationsfl mean the regulation of the Fair Political Practices Commission adopted pursuant to Title 9 of the Government Code and reported at Title 2 of the California Code of Regulations commencing with Section 18100.
'ECTION X: Reoeal: This Code shall repeal and supersede the onflict of Interest Code of the City of Carlsbadff adopted October 1979 and Title 9 of the Carlsbad Municipal Water District inistrative Code.

0 18730. Proviaiona of Conflict of Intereat Codes.
(a) Incorporation by reference of the terms of this regulation along
with the designation of employees and the formulation of disclosure cate-
gories in the Appendix nferxed to below constitute the adoption and pro-
mulgation of a con&t of interest code within the meaning of Govem- J
ment Code section 87300 or the amendment of a conflict of interest code
within the meaning of GovernmentCode section 87307 if the terms of this regulation are substituted for terms of a conflict of interest code already
in effect. A code so amended or adopted and promulgated requires the re-
porting of reportable items in a manner substantially equivalent to the re- quirements of article 2 of chapter 7 of the Political Reform Act, Govem-
ment Code sections 81000, et seq. The requirements of a conflict of
interest code ate in addition to other requirements of the Political Reform
Act, such as the general prohibition against conflicts of interest contained
in Government Code section 87100, and to other state or local laws per- taining to conflicts of interest.
(b) The terms of a conflict of interest code amended or adopted and
promulgated pursuant to this regulation are as follows:
(1) Section 1. Definitions.
The definitions contained in the Political Reform Act of 1974, mgula-
tions of the Fair Political Ractices Commission (2 Cal. Code of Regs.
sections 18 100 et seq.), and any amendments to the Act or regulations,
ate incorpora@ by nference into this conflict of interest code. (2) Section 2. Designated Employees.
The persons holding positions listed in the Appendix are designated
employees. It has been determined that these persons make or participate
in the making of decisions which may foreseeably have a material effect
on financial interests. (3) Section 3, Disclosure Categories.
This code does not establish any disclosure obligation for those desig-
na$ecl employees who arc also specified in Government Code section 87200 if they are designated in this code in that same capacity or if the
geographkal jurisdiction of this agency is the same as or is wholly in-
cluded within the jurisdiction in which those persons must report their fi-
nancial interests pursuant to article 2 of chapter 7 of the Political Reform
Act, Government Code sections 87200, et seq.’ Such persons are covered
by this code for disqualification purposes only. With mspect to all other
designated employees, the disclosure categories set forth in the Appendix
specify which hinds of financial intetcsts are reportable. Such a desig-
nated employee shall disclose in his or her statement of economic inter-
ests those financial intemsts he or she has which are of the hind described
in the disclosum categories to which he or she is assigned in the Appen-
dix. It has been determined that the financial interests set forth in a desig-
nated employee’s disclosure categories are the kinds of financial interests
which he or she foreseeably can affect materially through the conduct of
his or her office. (4) Section 4. Statements of Economic Interests: Place of Filing. The code reviewing body shall instruct all designated employees with-
in its code to file statements of economic interests with the agency or with i the code reviewing body, as provided by the code reviewing body in the agency’s confIict of interest code2

(5) Section 5. Statements of Economic Interests: Time of Filing,
(A) IF’” 1 Statements. All designated employees em@ed by the
agency o,.. .IC effective date of this code, as originally adc. ,. promul-
gated and approved by the code reviewing body, shall file statements
within 30 days after the effective date of this code. Thereafter, each per-
son already in a position when it is designated by an amendment to this
code shall fk an initial statement within 30 days after the effective date
of the amendment.
(B) Assuming Office Statements. All persons assuming designated
positions after the effective date of this code shall hle statements within
30days after assuming the designated positions, or if subject to State Sen-
ate confutation, 30 days after being nominated or appointed.
(C)Annual Statements. All designatedemployees shall file statements
nolaterthanApril1.
(II) Leaving Office state ments. All persons who leave designated po-
sitions shall file statements within 30 days after leaving office.
(5.5) Section 5.5. Statements for Persons Who Resign 30 Days After Appointment.
Persons who *sign within 30 days of initial appointment are not
deemed to have assumed office or left office provided they did not make
or participate in the making of, or use their position to influence any de&-
sion and did not receive or become entitled to receive any form of pay-
ment as a result of their appointment. Such persons shall not file either
an assuming or leaving office statement.
(6) Section 6. Contents of and Period Covered by Statements of Eco-
nomic Interests.
(A) Contents of Initial Statements.
Initial statements shall disclose any reportable investments, interests
in real property and business positions held on the effective date of the
code and income received during the 12 months prior to the effective date
of the code.
(B) Contents of Assuming Office Statements, Assuming office statements shall disclose any reportable investments,
interests inreal property and business positions held on the date of assum-
ing office or, if subject to State Senate confVmaron or appointment, on
the date of nomination, and income received during the 12 months prior
to the date of assuming office or the date of being appointed or nominated,
respectively.
(C) Contents of AMud Statements. Annual statements shall disclose
any reportable investments, interests in real property, income and busi-
ness positions held or received during the previous calendar year pm-
vided, however, that the period covered by an employee’s first annual
statement shall begin on the effective date of the &de or the date of as-
suming office whichever is later.
(D) Contents of Leaving Office Statements.
Leaving office statements shall disclose reportable investments, inter-
ests in real property, income and business positions held or received dur- ing the period between the closing date of the last statement filed and the
date of leaving offke.
(7) Section 7. Manner of Reporting. Statements of economic interests shall be made on forms prescribed
by the Fair Political Practices Commission and supplied by the agency,
and shall contain the following information:
(A) Investment and Real Property Disclosure.
When an investment or an interest in real property3 is m+red to be
reported,’ the statement shall contain the following: 1. A statement of the nature of the investment or interest;
2. The name of the business entity in which each investment is held,
and a general description of the business activity in which the business entity is engaged;
3. The address or other precise location of the real property;
4. A statement whetherthe fairmarket value of the investment orinter-
est in real property exceeds one thousand dollars ($l,OOO), exceeds ten
thousand dollars (SlO,OOO), or exceeds one hundred thousand dollars
(%1oo*ooo). Page 2 of 5
(B) Per- ‘d Income Disclosute. When personal income isxquired to
be tcporte~, rht statement shall contain:
1. The name and address of each souse of income aggregating two
hundred fifty dollars ($250) or more in value, or fifty dollars ($50) or
more in value if the income was a gift, and a general description of the
business activity, if any, of each source.
2. A statement whether the aggregate value of income from each
source, or in the case of a loan, the highest amount owed to each source,
was one thousand dollars ($1,000) or less, greater than one thousand dol-
lars ($l,OOO), or greater than ten thousand dollars ($10,000); 3. A description of the consideration, if any, for which the income was
received; 4. In the case of a gift, the name, address and business activity of the
donor and any intermediary through which the gift was made; a descrip- tion of the gift; the amount or value of the gift; and the date on which the
gift was received;
5. In thecase of a loan, the annual interest rate and the security, if any,
given for the loan.
(C) Business Entity Income Disclosure. When income of a business
entity, including income of 8 sole proprietorship, is required to be rc-
portd6 the statement shall contain:
1. The name, address, and a general description of the business activity
of the business entity;
2. The name of every person from whom the business entity received
payments if the filer’s pro rata share of gross receipts from such person
was equal to or gmater than ten thousand dollars ($10,080).
(D) Business Position Disclosure. When business positions am re
quired to be reported, a designated employee shall list the name and ad-
dress of each business entity in which he or she is a director, officer, part-b
ner, trustee, employee, or in which he or she holds any position of
management, a description of the business activity in which the business
entity is engaged, and the designated employee’s position with the busi-
ness entity.
(E) Acquisition or Disposal During Reporting Period. In the case of an
annual or leaving office statement, if an investment or an interest in real
propertywaspartiaUyorwhollyacquiredordisposedofduringtheperiod
covered by the statement, the statement shall contain the date of aquisi-
tion or disposal.
(8) Section 8. Disqualification.
No designated employee shall make, participate in making, ot in any
way attempt to use his or her official position to influence the making of
any governmental decision which he or she knows or has reason to know
will have a reasonably foreseeable material financial effect, distinguish-
able from its effect on the public generally, on the official or a member
of his or her immediate family or on:
(A) Any business entity in which the designated employee has a direct
or indirect investment worth one thousand dollars ($1,000) or more;
(B) Any real property in which the designated employee has a dir& or indirect interest worth one thousand dollars ($1,000) or mm;
(C) Any source of income, other than gifts and other than loans by a commercial lending institution in the regular course of business on terms
available to the public without regard to official status, aggregating two
hundred fifty dollars ($250) or more in value provided to, received by or
promised to the designated employee within 12 months prior to the time
when the decision is made,
(D) Any business entity in which the designated employee is a director,
officer, partner, trustee, employee, or holds any position of management;

(E) Any donor of, or any intermediary or agent for a donor of, a gift or gifts aggregating $250 or more in value provided to; received by, or
promised to the designated employee within 12 months prior to the time
when the decision is made. (8.3) Section 8.3. Legally Required Participation. Page 3 of 5
No detiated employee shall be prevented from making*oarticipat-
illgintht .&ing of any decision to the extent his or her p ipation is
kgally required for the decision to be made. The fact that the vote of a
designated employee who is on avoting body is needed to break a tie does
not make his or her participation legally my&d for purposes of this sec-
tion.
(8.5) Section 8.5. Disqualification of State Officers and Employees.
In addition to the general disqualification provisions of section 8, no
state administrative official shall make, participate in making, or use his
or her official position to influence any governmental decision directly
relating to any contract where the state adminisnative official knows or
has reason to know that any party to thecontmct is a person with whom
the state administrative official, or any member of his or her immediate
family has, within 12 months prior to the time when the official action is
to be taken: (A) Engaged in a business transaction OT transactions on terms not
available to members of the public, regarding any investment or interest
inmalproperty;or
(B) Engaged in a business transaction or transactions on terms not
available to members of the public regarding the rendering of goods or
services totaling in value one thousand dollars ($1,000) or more.
(9) Section 9. Manner of Disqualification.
When a designated employee determines that he or she should not
make a governmental decision because he or she has a disqualifying in-
terest in it, the determination not to act must be accompanied by disclo-
sure of the disqualifying interest. In the case of a voting body, this deter-
mination and disclosure shall be made part of the agency’s official
record; in the case of a designated employee who is the head of an agency,
this determination and disclosure shall be made in writing to his or her
appointing authority; and in the case of other designated employees, this
determination and disclosure shall be made in writing to the designated
employee’s supervisor.
(10) Section 10. Assistance of the Commission and Counsel.
Any designated employee who is unsure of his or her duties under this
code may request assistance$om the Fair Political Practices Commis-
sion pursuant to Government&de section 83 114 or from the attorney for
his or her agency, provided that nothing in this section requires the attor-
ney for the agency to issue any formal or informal opinion.
( 11) Section 11. Violations.
This code has the force and effect of law. Designated employees vio-
lating any provision of this code axe subject to the administrative, crimi-
nal and civil sanctions provided in the Political Reform Act, Government &de sections 81000-91014. In addition, a decision in relation to which
a violation of the disqualification provisions of this code or of Covem-
ment Code section 87 100 or 87450 has occtuxed may be set aside as void
pursuant to Government Code section 91093.

The positions and categories within the City listed in this appendix are "designated positions." Any person whose position with the City is a designated position is a designated employee. NOTICE IS HEREBY GIVEN that the Board of Directors of the Carlsbad Municipal Water
District will hold a public hearing on October 15, 1991 at 6:00 p.m. in the City Council
Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, pursuant to the Political
Reform Act of 1974 (Title 9, commencing with Section 81000, et sea. of the Government
Code) to consider amending its Local Conflict of Interest Code.
The proposed amendment will update the list of designated positions to reflect current
titles and classifications and will update the disclosure categories for the designated
positions.
Section 87311 of the Government Code requires that the review and preparation of Conflict
