RECOMMENDED ACTION:
Adopt Resolution No. 398 quitclaiming a water line easement over a portion of Fairways, Carlsbad Tract 89-16, CMWD Project No. 82-405.
ITEM EXPLANATION:
This item is a request by the owners of Fairways, Carlsbad Tract 89-
16, CMWD Project No. 82-405, to quitclaim a water line easement no longer required.
The Water District Engineering staff has reviewed the request and concurs with the owner's contention. This easement will no longer be necessary as it no longer contains water system facilities. The water line has been removed, and the easement is no longer required.

None.

A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF CARLSBAD, CALIFORNIA, APPROVING QUITCLAIM OF A WATER LINE EASEMENT OVER A PORTION OF FAIRWAYS, CARLSBAD TRACT 89-16, CMWD PROJECT NO. 82-405
WHEREAS, Fieldstone/La Costa Associates Limited
Partnership have submitted a request for quitclaim of a water line
easement over a portion of Fairways, Carlsbad Tract 89-16, CMWD
Project No. 82-405; and
WHEREAS, the Board of Directors of the Carlsbad Municipal
Water District has determined it to be in the public interest to
quitclaim said water line easement:
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors
of the Carlsbad Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying an easement for
water line purposes to Fieldstone/La Costa Associates Limited
Partnership, which is on file with the Carlsbad Municipal Water
District and is incorporated by this reference;.is approved.
3. That the President and the Secretary are authorized
