RECOMMENDED ACTION:
Hold public hearing and adopt Ordinance No. and Resolution Yn No. ROW authorizing and approving fees for engineering services.
ITEM EXPLANATION:
Ordinance No. 40 , authorizes fees for engineering services. The
amount of the engineering services fees shall be established by resolution of the Board of Directors. From time to time said fees are reviewed and evaluated to maintain an adequate fee structure recovering costs for engineering services.
The District has been collecting fees for potable water facilities per Ordinance No. 29. The District will now be reviewing potable and reclaimed water systems and sewage facilities within the City to provide plan checking services. The fees shown in Exhibit A are fair and reasonable relative to the services provided. The Board may adopt the fees after a public hearing.
The engineering staff has reviewed and determined the cost of providing general engineering services and recommends the Board of Directors adopt the ordinance, the resolution and the fee schedule in Exhibit A attached as a part of Resolution No. mc .
FISCAL IMPACT:
The revised engineering service fees have been determined to consider the additions in plan checking to incorporate the reclaimed water system and the sewer system as well as the potable water system. These fees are established upon past history and previously estimated construction costs. The District will encounter costs due to the plan check by staff, however, these fees are predicted to cover those costs.

ORDINANCE NO. 40
ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT REPEALING ORDINANCE NO. 29 AND ESTABLISHING FEES FOR ENGINEERING SERVICES
WHEREAS, the Carlsbad Municipal Water District provides
engineering services to the public in connection with the
development of real property within the District; and
WHEREAS, such engineering services include the review and
approval of potable water, reclaimed water, and sewer facilities,
including main line and lateral installation, replacement and
relocations in connection with the developmental review process of
the City of Carlsbad; and
WHEREAS, the Carlsbad Municipal Water District has been
collecting fees from developers based upon the estimated cost of
the engineering services for potable water facilities per Ordinance
No. 29, Section 9.2: and
WHEREAS, the District has estimated, based on past
experience, the actual cost of providing engineering plan checking
services for projects of various sizes: a summary of the
information on which this estimate is based has been available to
the public for not less that ten (10) days;
_- NOW, THEREFORE, BE IT ORDAINED by the Board of Directors
of the Carlsbad Municipal Water District as follows:
SECTION I: Ordinance No. 29 is hereby repealed.
SECTION II: The Engineering Service Fees shall be
established by resolution of the Board of Directors of the District
and are for the purpose of defraying the cost of processing review
and approval of potable water, reclaimed water, and sewer
facilities, including main line and lateral installation,

replacement and relocation in connection with the developmental
review process of the City of Carlsbad;
1. Policv. The Engineering Department shall provide
plan checking services for potable and reclaimed water and sewer
facilities services to be constructed and added to the systems of
the City and the District at a charge of estimated cost of
providing such services.
2. Fees. The fees shall be charged based upon the
estimated construction costs of the potable, reclaimed and sewer
systems only, as determined by the District Engineer or his
designee upon review of the plans submitted in connection with any
type of development within the City and the District. The fixed
fees shall be established by resolution of the Board of Directors
of the District.
SECTION III: ATof The
District shall periodically review the fees charged for engineering
services to insure that the fixed fees do not exceed the estimated
costs of providing the services, and are fair and appropriate.
Adjustments to the fixed fees may be made at any time by
resolution.
SECTION IV: When Paid. Fees shall be payable after -- .
submission of plans for plan check, and prior to completion of plan
check and approval of plans by the District Engineer.
EFFECTIVE DATE: This Ordinance shall be effective thirty
days after its adoption, and the Secretary shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF CARLSBAD, CALIFORNIA, ESTABLISHING FEES FOR ENGINEERING SERVICES
WHEREAS, the Carlsbad Municipal Water District has the
authority to establish fees for engineering services; and
WHEREAS, from time to time said fees are reviewed and
evaluated to maintain an adequate fee structure recovering costs
for engineering services, and adoption of Ordinance No. 40 ,
Section II states the fees shall be established by resolution of
the Board of Directors of the Carlsbad Municipal Water District for
the purpose of defraying the cost of the review and approval of
potable water, reclaimed water and sewer facilities, including main
line and lateral installation, replacement and relocations in
connection with developmental review process of the City of
Carlsbad; and
WHEREAS, the Board of Directors has determined the cost
of providing general engineering services; and
WHEREAS, the Board of Directors finds it necessary to
recover the costs for general engineering services: and
WHEREAS, the Board of Directors has determined that the
fees shown in Exhibit A, attached hereto and made a part hereof,
are fair and reasonable in reaction to the services received: and
WHEREAS, the Board of Directors has held the necessary
public hearing and allowed the public comment on the establishment
of said fees.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal
Water District of the City of Carlshad, California that the fee

schedule shown in Exhibit A attached, hereto and made a part
hereof, is hereby adopted and shall become the official fee
schedule for the Carlsbad Municipal Water District. Any fee area
' not included in said list shall remain under the control of
previous resolution by this Board. All fees shall become effective
on the effective date of Ordinance No. 40 I establishing
procedure for setting fixed fees for engineering services for
1 potable and reclaimed water and sewer facilities.

Municipal Water District on the 1st day of SEPTEMBER I

ESTABLISHMENT OF PROCEDURES FOR SETTING FEES FOR
ENGINEERING SERVICES
NOTICE IS HEREBY GIVEN that the Board of Directors of the Carlsbad Municipal Water District will hold a public hearing at the City Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m., on Tuesday, September 1, 1992, to consider establishing procedures to set fees for engineering services for potable and reclaimed water and sewer facilities within the District, and to consider setting the fees.
If you have any questions regarding this matter, please call Bob Coates, District
Engineer, at the Carlsbad Municipal Water District, 438-3367, ext. 124.
If you challenge the establishment of the procedures for setting fees for engineering services for potable and reclaimed water and sewer facilities within the District and/or the fees in court, you may be limited to raising only those issues raised by you or someone else at the public hearing described in this notice, or in written correspondence delivered to the City of Carlsbad City Clerk's Office at or prior to the public hearing.

RECOMMENDED ACTION:

ITEM EXPLANATION:
The Carlsbad Municipal Water District provides ,engineering services to the public in connection with the development of real property within the City of Carlsbad and the District; and such engineering services include the review and approval of potable water, reclaimed water and sewer facilities, including main line and lateral installation, replacement and relocations in connection with the development review process of the City of Carlsbad.
The District has been collecting fees from developers based upon the . estimated cost of engineering services for potable water facilities per Ordinance No. 29. The District will now provide plan checking only. The construction inspection and collection of inspection fees will now be administered by the City Engineering Department.
The revised plan checking fees shall be based upon the estimated construction costs of the potable, reclaimed and sewer systems within the City and the District and in accordance with Ordinance No. which will repeal Ordinance No. 29.
FISCAL IMPACT:
Engineering service fees shall be established as per Section II of the procedures for setting fixed engineering service fees. The revised - engineering service fees have been calculated to reflect the changes in plan checking to include the reclaimed water system and the sewer system as well as the potable water system. These fees are based upon estimated construction costs. The District will experience costs due to the plan check by staff, however, these fees are anticipated to cover those costs.
