RECOMMENDED ACTION:
Staff is asking for Commission recommendation of approval for reimbursement of construction
costs for improvements to be made to the Meadowlark Water Reclamation Facility.
lTEM EXPLANATION:
Staff will be making presentation on this project.
This project is to construct algae removal facilities at the Meadowlark Water Reclamation
Facility. This project is further described in the attached draft agenda bill.

Adopt Resolution No. for approval of reimbursement to
Vallecitos Water District for construction costs of modifications to Meadowlark Water Reclamation Facility, CMWD Project No. 91-302,
contracted with DVY Construction Company.
JTEM EXPLANATIOYt
This project involves modifications to the Meadowlark Water
Reclamation Facility to provide reclaimed water service to City of Carlsbad customers. Carlsbad has received a conceptual approval letter from the State Water Resources Board Office of Recycling for the Wastewater Reclamation Loan Program for the construction of the Encina Basin Project - Phase I. CMWD and Vallecitos are in the process of constructing the project in accordance with the terms and conditions as set forth in the approval letter. Since CMWD is the loan recipient and part of the loan proceeds are earmarked for improvements to the Meadowlark plant, we have entered into an agreement whereby Vallecitos shall participate in the construction of the Project. We have also agreed that and whereby Vallecitos shall be the owner responsible for the design, construction and operation of the Vallecitos facilities, and when the work is completed by Vallecitos and accepted by CMWD, CMWD would reimburse Vallecitos as CMWD receives monies from the State loan proceeds. The referenced agreement is the agreement between Vallecitos and Carlsbad whereby Carlsbad purchases reclaimed from Vallecitos to serve customers in
Carlsbad. This agreement was executed by the District on June 13,
1991. Vallecitos requested and held a public bid opening on May 25,
1993, and the following results were tabulated:

The Contract will be awarded to DVY Construction Company as the lowest, responsive, responsible bidder for a contract amount of $863,000.00. The Engineer's Estimate was $1,011,500.00. The
modifications constructed to Meadowlark Water Reclamation Facility are of direct benefit to CMWD, as all of the reclaimed water produced will be purchased by CMWD. The staff recommended approval to the Water Commission. The Water Commissionhas met and is recommending approval to the Board of Directors. DRAFT

BNVIRONMENTAL REVIEW:
The environmental process for this project (EIA 91-10) has been approved on September 12, 1991, and the California Coastal Commission has issued Permit No. 6-92-45.
FI6CAL IMPACT:
The contract amount for this work is $863,000.00. The District has been approved for a State loan of $2,429,240.00 for reclaimed water related projects. The District has entered into a Loan Contract with The State Water Resources Control Board for the Encina Basin Project, Phase I and part of the loan proceeds are designated for improvements to the Meadowlark Plant. The loan will be paid back from the proceeds of the sale of reclaimed water.
The estimated District-funded project costs are as follows:

WHEREAS, the Board of Directors of the Carlsbad Municipal
Water District has determined the modifications to the Meadowlark
Water Reclamation Facility will be of direct benefit to the
Carlsbad Municipal Water District, as all of the reclaimed water

Water District; and
WHEREAS, Carlsbad Municipal Water District has received

selected as the lowest responsive, responsible bid for the
construction of said project in the amount of $863,000.00, and CMWD
staff has determined estimated project costs to be a total
appropriation of $992#450.00 with additional funding of $183,851.00
to be appropriated from the General Water Fund:
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. That the above recitations are true and correct.
2. That project cost amount of $1,1761301.00 is hereby
accepted, and the President is hereby authorized to designate
$992#450,000.00 be appropriated from State loan proceeds and the
additional funds of $183,851.00 be appropriated from the General
Water Fund.
PASSED, APPROVED AND ADOPTED by the Board of Directors
of Carlsbad Municipal Water District at a regular meeting held on
