Adopt Resolution No. 899 accepting a bid and awarding a contract for the construction of Twin ‘D’ Reservoir
Improvements, CMWDxject No. 84-l 11, Contract No. 3376.
ITEM EXPLANATION:
I
On February 8, 1994, the Board of Directors authorized the advertisement of bids for construction of Twin ‘D’
Reservoir Improvements Project. Five (5) sealed bids were received May 5, 1994, as follows:
1. T.C. Construction Co., Inc., Santee CA
2. Trusco Tank Inc., San Luis Obispo, CA
3. Mingus Constructors, Inc, Cottonwood, CA
4. Pitt-Des Moines, Inc., Sacramento, CA
5. Cass Construction, Inc., El Cajon, CA

This project will involve construction to expand the reservoir capacity by 6 million gallons to meet existing
growth and fire flow requirements in the southwest portion of the City. There are two existing reservoirs on
the existing site with a total capacity of 2.5 million gallons, One of the existing tanks has been converted to
a reclaimed water reservoir, and the second reservoir will also be converted to reclaimed water as a part of
this project. In order to gain the 6 million gallons of storage an 8.5 million gallon reservoir needs to be
constructed. Construction is anticipated to require approximately three hundred sixty-five (365) calendar days
to completion. The Engineer’s estimate for construction was !§3,550,000.
Plans and specifications for the construction of the Twin ‘D’ Reservoir Improvements were prepared by the
District engineering staff and were available for review at the District offices. In accordance with Section
3.28.120 of the Municipal Code, an Invitation to Bid was published. Five responses were received, opened,
witnessed and recorded on May 5, 1994. Project Manager and Purchasing staff have reviewed the complete
bid documents from all parties in detail and concluded that the lowest responsive, responsible bidder is T.C.
Construction Co., Inc., 10510 Prospect Avenue, Santee, California, 92071, for a contract amount of
$2,221,740.55.
At the June 14, 1994 Board of Directors meeting, staff recommended rejection of all bids because of a verbal
statement made at a pre-bid meeting was not followed up in writing. After considerable discussion and
testimony from T.C. Construction, the apparent low bidder, the Board directed staff to return at the next Board
of Directors meeting with the necessary documents to allow an award of the construction contract to the
apparent low bidder, T.C Construction Co., Inc.
ENVIRONMENTAL REVIEW:
The City of Carlsbad had conducted an environmental review of the project pursuant to the Guidelines for
Implementation of the California Environmental Quality Act and the Environmental Protection Ordinance of the
City of Carlsbad. As a result of said review, a Negative Declaration (declaration that the project will not have
a significant impact on the environment) was issued for the subject project, Case No. EIA 91-15, and is on
file with supportive documents at the Planning Department, 2075 Las Palmas, Carlsbad. The California
Coastal Commission has issued a permit authorizing the District to proceed with construction of this project,
permit number 6-93-91.

FISCAL IMPACT:
Funds in the amount of $4,900,000 have been appropriated in the 199394 Budget as part of the Capital
Improvements Program. As of December 31, 1993, $4.4 million is available. The total remaining cost
estimated for this project $3,300,000. Therefore, there are sufficient funds available for this project.
The construction bid for the project is $2,221,740.55. The estimated District-funded project costs are as
follows:

WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has previously
authorized the advertisement for bids for the construction of Twin ‘D’ Reservoir Improvements Project,
I CMWD Project No. 64-l 11, Contract No. 3376; and,
WHEREAS, fiie (5) sealed bids were received on May 5, 1994, for said project; and,
WHEREAS, all bid documents received from all bidders have been reviewed in detail and
the Board of Directors does hereby find that the lowest responsive, responsible bid received for the
~ construction of said project was submitted by T.C. Construction Co., Inc., 10510 Prospect Avenue, San&e,
California, 92071, for a contract of $2,221,740.55.
NOW, THEREFORE, BE IT RESOLVED, as follows:
i. That the above recitations are true and correct.
2. That the bid amount in the amount $2,221,740.55 submitted by T.C. Construction
Co., Inc. is hereby accepted, and the President is hereby authorized to execute a contract thereafter.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 26th day of JUNE , 1994, by the following vote to wit:
