CMWD RESERVOIRS, CMWD PROJECT NO. 95-107, CONTRACT NO. 3488 - CARLSBAD MUNICIPAL WATER DISTRICT - AGEN RECOMMENDED ACTION: Adopt Resolution No. qL9 rejecting bids received and giving approval to readvertise with additional funding for recoating the “C” and Ellery Steel Tank Reservoirs, CMWD Project No. 95107, Contract No. 3488. ITEM EXPLANATION: On December 19, 1995, the Board of Directors authorized Agenda Bill No. 297, adopting Resolution No. 914, authorizing the advertisement of bids for recoating the “c” and Ellery Steel Tank Reservoirs project. This project will involve recoating the interior of the “C” and Ellery Steel Tank reservoirs. Construction is anticipated to require approximately one hundred and fifty (150) calendar days to completion. The Engineer‘s estimate for construction was listed as $200,000. Plans and specifications for recoating the interior of the “C” and Ellery Steel Tank Reservoirs were prepared by the District engineering staff. In accordance with Section 3.28.120 of the Municipal Code, an Invitation to Bid was published. Five (5) sealed bids were received, opened, witnessed and recorded on February 1, 1996, as follows: 1. Southwest Coatings, Inc. $183,000.00 2. Robinson-Prezioso, Inc. $322‘880.00 3. West Coast Industrial $342‘718.00 4. Professional Restoration $420‘262.50 5. Techno Coatings, Inc. $426,126.00 The Project Manager and Purchasing staff, have reviewed the complete bid documents from all parties in detail and agree with the/City Attorney’s office conclusion that the bids should be rejected under Public Contract Code Secti* 20166 and re-advertised. There are several reasons for rejecting the bids. First a letter was received from the low bidder, Southwest Coatings, Inc., requesting to withdraw their bid due to error. The second low bidder, Robinson-Prezioso, Inc., also made an error in the total cost given in the bid sheet for each reservoir in their bid, and the remaining bids exceeded the Engineers estimate by more than $140,000 and were widely divergent from one another. A letter was received from the second low bidder, Robinson-Prezioso, Inc., requesting consideration for them to be awarded the contract. Their letter is attached for reference, and states that their error be considered as an informality. Staff has considered their statement and recommends rejecting all bids. ENVIRONMENTAL REVlEIiVz This project is categorically exempt from the environmental review process, in accordance with Article 19 Categorical Exemptions, Section 15,300. and 15,301.‘ (Existing Facilities). The California Coastal Commission does not require a permit for this project. / - Page 2 of Agenda Bill No. 3 J& FISCAL IMPACT: Funds in the amount of $200,000 have been appropriated in the Capital Improvement Budget as part of the reservoir rehabilitation program. However, it is requested that the total appropriation be increased to $340,000.00 reflecting an increase of $140,000 over the original amount. There are two reasons for the increase. First, the Engineer‘s estimate of $300,000 was incorrectly given in the Notice Inviting Bids as $200,000. Second, in reviewing the bids received, an additional appropriation in the amount of $140,000 is necessary for Construction, Inspection/Lab/Administration Costs. It is recommended that $140,000 be appropriated from the Water Capital Replacement Fund since rehabilitation of the reservoirs affects both current and future residents and businesses. There is a sufficient available balance in this fund for the additional appropriation.
