Adopt Resolution No. I, 000 for quitclaim of a temporary water pipeline easement for
construction purposes across Lot 6, Carlsbad Tract 94-09, Map No. 13357, Carlsbad Ranch,
Unit 1, CMWD Project No. 97-269, granted to the Carlsbad Municipal Water District for
temporary use until the permanent water pipeline was completed in Armada Drive.
ITEM EXPLANATION:
This item is a request of the KREG-OC, L.P., owners of the development, to quitclaim the
temporary water line easement for construction purposes now that the permanent water
pipeline has been completed in Armada Drive. The Engineering staff has reviewed the
request and concurs with the owner’s contention that the temporary easement will no longer
be necessary, because it will not contain a water pipeline.

None.

DISTRICT FOR QUITCLAIM OF A TEMPORARY WATER
PIPELINE EASEMENT FOR CONSTRUCTION PURPOSES
ACROSS LOT 6, CARLSBAD TRACT 94-09, MAP NO.
13357, CARLSBAD RANCH, UNIT 1, CMWD PROJECT
NO. 97-169
WHEREAS, KREG-OC, L.P., has submitted a request for quitclaim of
a temporary water pipeline easement for construction purposes across Lot 6,
Carlsbad Tract 94-09, Map No. 13357, Carlsbad Ranch, Unit 1, CMWD Project No.
97-269; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water
District has determined it to be in the public interest to quitclaim said easement;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
the Carlsbad Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying a temporary water pipeline
easement for construction purposes across Lot 6, Carlsbad Tract 94-09, Map No.
13357, Carlsbad Ranch, Unit 1, CMWD Project No. 97-269, which is on file with the
Secretary and is incorporated by this reference; is approved.
