CMWD ( SCHOOL SITE, CMWD PROJECT NO. 98-C.481 RECOMMENDED ACTION: Adopt Resolution No. /O 3 0 for approval and execution of two quitclaim deeds of pipeline easements over a portion of the Pacific Rim Elementary School Site, CMWD Project No. 98- C.481. ITEM EXPLANATION: This item is a request of Carlsbad Unified School District, owner of the Pacific Rim Elementary School Site at the north west corner of Hidden Valley Road and Camino De Las Ondas. The engineering staff has reviewed the request and concurs with the owner’s contention that the water and sewer pipelines were moved into the public right-of-way and will no longer be necessary since both sewer and water pipelines have concurrently and adequately been provided for within the public right-of-way. Within the past year the City Attorney’s Office determined that sewer pipeline easements should be granted to the City of Carlsbad and potable and reclaimed water pipeline easements should be granted to the Carlsbad Municipal Water District. The sewer pipeline easement was originally granted to the District before this determination was made. Therefor, the District is in agreement with the owner that the two original pipeline easements granted to the District can be quitclaimed to the owner. FISCAL IMPACT: This item has no fiscal impact. The original easements were granted to the District for a no cost acquisition of the property, and the District will quitclaim the easements for a no cost return of the property. That the above recitations are true and correct. 2. That the two Quitclaim Deeds conveying pipeline easements over a portion of the Pacific Rim Elementary School Site, CMWD Project No. 98-C-481, located at the North West corner of Hidden Valley Road and Camino De Los Ondas granted to the Carlsbad Municipal Water District, which no longer contain water system facilities and will no longer be necessary, which is on file with the Secretary and in incorporated by this reference; is approved. 3. Resolution No. 1030 approved the execution of two deeds which quitclaim pipeline easements, which are no longer needed, to the Carlsbad Unified School District, (CUSD). Also enclosed are two original and fully executed Quitclaim Deeds. As these deeds benefit the CUSD, and they were prepared with CUSD under the “Recording Requested By” area, they will need to be processed for recordation by your agency.
