MTG. 2l8100 PUBLIC HEARING FOR MAERKLE DAM CHOLORINATION
FACILITY RISK MANAGEMENT PROGRAM INCLUDING
DEPT. CMWD OFFSITE CONSEQUENCES
RECOMMENDED ACTION:
Hold a Public Hearing to receive citizen comments on the Facility Risk Management
Program (RMP), including Off-Site Consequences Analysis for Maerkle Dam chlorination
facilities; no Board action is requested.
ITEM EXPLANATION:
On June 21, 1996, the Environmental Protection Agency finalized the Chemical Accident
Prevention Provisions regulations in accordance with the Clean Air Act Amendments of
1990. These regulations require that any facility that handles, stores, uses or produces a
listed regulated substance in excess of a predetermined threshold quantity must prepare
and submit a Risk Management Program (RMP).
The Maerkle Dam Chlorination Facilities store chlorine gas in excess of 2,500 pounds and
was required to prepare Risk Management Programs. At its meeting of April 6, 1999, the
Board approved a contract in the amount of $43,245 with Tracer Environmental Sciences
and Technologies, Inc., to perform the necessary technical studies, develop the Prevention
Programs and submit the RMP to the EPA by the required submission date of June 21,
1999. The consultant’s scope of work included all four of the District and City’s chlorination
facilities; Maerkle Dam Upper and Lower Chlorination Stations, the “D” Reservoir
Chlorination Station and the City’s Swim Complex.
In August 1999, the Chemical Safety Information, Site Security and Fuels Regulatory Act
(PL 106-40) was signed. This law requires that the Carlsbad Municipal Water District hold
a public meeting to discuss the local implications of the District’s Maerkle Dam Chlorination
Facilities Risk Management Programs, including a summary of the Off-Site Consequences
Analysis. This analysis contains sections on worst case release scenarios for chlorine gas,
potential off-site impacts and identification of pubic and environmental receptors of such a
release. On January 25, 2000, the Board received a report from staff on results of this
work and set a Public Hearing for February 8, 2000, to receive citizen comments.
FISCAL IMPACT:
Total cost of the consultant contract was $43,245. There are no other fiscal impacts as a
result of this action.
